부제: 갈등해결기제와 사회안전망이 존재해야 구조조정이 제대로 이뤄진다 상편: https://new.redtea.kr/?b=3&n=2892 지난번 글에서는 STX의 법정관리 결정(법원의 결정이 아니라, 신청하기로한 결정)을 계기로 '왜 이 나라에서는 그토록 선제적 구조조정이 어려운지'를 얘기하기 위해 다른 선진산업국가들의 '갈등해결기제' 내지 '제도'를 살펴봤습니다. 저는 '제도주의 경제학', 혹은 '역사제도주의 정치경제' 쪽을 특히 좋아해서, 광의의 제도는 사람들의 행태를 바꾸고, 그렇게 바뀐 행태는 사람들의 사고방식을 바꾼다는 생각을 갖고 있습니다. 현재 미국과 서유럽의 코포라티즘 국가/다원주의 국가들이 예전의 모습을 그대로 간직하고 있지는 않지만, '경로의존성'에 따라 여전히 지속되는 흐름은 남아있다는 전제하에 글을 쓰고 있습니다. 결국은 STX얘기, 한 산업의 얘기가 아니라 한국의 제도와 정책, 그리고 시스템에 대한 얘기를 하고 있다는 얘기지요. 어쨌든, 그 다음 얘기를 이어가겠습니다. 2. 한국과 일본 1)일본-동아시아 발전모델과 기업코포라티즘: 두 개의 특수성 일본은 후발 산업국가로 가장 성공한 나라지요. 최소 200년 길게는 300~400년의 산업-정치 혁명의 과정은 당연히 일본에서는 다소 압축적으로 나타났습니다. 그리고 통상성 관료와 대기업집단이 함께 발전전략을 짜서 이끄는 이른바 '동아시아 발전모델'을 구축하게 됩니다. 산업화와 경제발전 과정에서 필연적으로 나타나는 '노동의 문제' 즉 '노동과 자본의 갈등'을 어떻게 해결할 것인가의 문제 또한 '일본식 방법'으로 풀어냅니다. 뭔가 수학 문제를 풀듯 풀어낸게 아니라 여러 역사제도적 조건들이 만들어낸 나름의 해법이었던 것이지요. 일본의 갈등해결 기제란, 학자마다 다르긴 하지만, '국가없는 코포라티즘', '기업 코포라티즘'이라는 이름으로 불리는 것입니다. 일본에는 서구의 '사회적 코포라티즘'의 특징인 중범위/혹은 국가차원의 단일정상노조는 없는 기업별 노조의 형태여서 영국과 같이, 사업장/기업별 단일노조의 형태와 비슷하지만, '국가 주도 발전모델'의 특성에 고도성장이 더해저 노조가 힘을 가질 수가 있었습니다. (지금은 아니지만요) 그래서 1960년대 고도성장시기부터 노동자들이 정상조직의 강력한 집행력 없이도 통일적인 임금교섭이 가능했습니다. 집단 협상 방식으로서의 '제도화된 춘투'라는 게 존재했던 것이지요. 그러면 상대편 파트너는요? 원래 관료와 파트너십을 형성하던 경단련 등의 기업연계 조직이 존재했습니다. 노동 입장에서도 대화 상대가 존재했다는 얘깁니다. 중소기업을 산업 내에 계열화시켜 '포섭할 수 있는 힘'이 있던 일본의 대기업집단과 그 연계망은 자신들이 대기업 노조들 위주의 '춘투세력'과 협상한 결과를 산업 전체의 합의로 만들 수 있는 힘이 있던 것이지요. 정리해보겠습니다. 일본식 (국가없는) 기업코포라티즘 = '춘투'로 상징되는 '거대정상조직 노조의 대체물'+'경단련을 비롯한 기업연계망'이라는 '자본측 파트너'의 합의. 이 과정에서 일본에서의 '복지'는 주로 기업차원에서 제공하는 것이 됩니다. 그래서 일본이 잃어버린 20년을 맞이하기 전까지 아니 잃어버린 10년까지 시기만 해도 '기업복지국가'의 형태를 띠게 되는 겁니다. (다른 얘기이지만, 이게 잃어버린 10년동안 일본 내의 구조조정을 막는 요인이 되기도 합니다.) 2)한국: 국가코포라티즘에서 기업복지로. 그리고 아무것도 없었다. 한국은 일본의 경제성장 전략을 많이 따라하긴 했지만, 일본보다 더 기반 없는 상황에서 후후발 국가의 위치에서 급속한 성장을 해야했기에, 또한 북한이라는 실체적 위협이 코앞에 있는 상황이었기에, 그리고 군사권위주의 정권에 의해 주도된 발전전략이었기에 '노동-자본'갈등 해결 기제는 좀 다르게 나타났습니다. 노동부문 자체가 국가의 의해 완전히 조직화되고 포섭돼 '한국노총'이라는 어용 정상조직만이 존재하는 '국가코포라티즘'의 형태를 띠었던 겁니다. 근로기준법을 비롯한 노동법은 그저 이상적으로 설정만 해 놓은 뒤에 기업은 안지키면 그만. 국가는 노총 밖의 운동은 탄압. 이런식의 제도를 취하게 되는 거지요. 국가코포라티즘적 형태는 보통 파시즘에서 나타나는데, 이게 권위주의 체제다 보니 비슷한 방식을 구사할 수 있었다는 겁니다. 즉 갈등해결기제가 아예 없는 상태에서 노동을 '누른 채' 성장을 이끌었다는 거죠. 그런데 1987년 이후 민주노조 운동이 거세지면서, 개별 사업장별로 각 노조는 자신의 소속 기업을 상대로 '기업이 제공하는 복지체제'를 얻어내게 됩니다. 그리고 이는 IMF 이전까지 이어집니다. 기본적으로 한국의 노동-자본 관계는 갈등적 다원주의 형태(영국처럼)로 바뀌어가는데, 국가는 예전처럼 '임금가이드라인'을 제시하기도 하고 노사갈등을 중재하거나 노동을 탄압하는 등의 적극적 개입을 시도합니다. 특정한 정권의 문제가 아니라 제도나 시스템이 그렇게 흘러갔다는 얘기입니다. '국가의 힘'이 강하게 존재하는 상황, 즉 '국가 코포라티즘'의 유산이 남아있는 상태에서 개별노조의 전투적 노동운동은 기업단위로부터의 개별적 승리를 많이 이끌어내지만, IMF 외환위기와 IMF 프로그램에 따른 급속한 구조조정 국면이 오자 급격히 무너지게 되고, 한국의 정치경제-산업 시스템에서 '구조조정을 둘러싼 사회적 합의'를 이끌어 낼 수 있는 제도는 형성되지 않은 채 '갈등해결기제'는 영원히 '공란'으로 남게 됩니다.(최소한 지금까지는) 물론 김대정 정부 시절 '노사정 위원회'를 활용하는 갈등해결기제 마련 노력이 없었던 건 아니지만, 어차피 낮은 노조 조직율(당시 10% 정도)의 양대 노조, 그것도 산별노조가 조금 형성되다가 말아버린 상황에서는 지지부진할 수밖에 없었고 금방 유명무실해집니다. 이후 한국 기업들은 기업별로 여건에 따라 복지를 제공함으로써 달랠건 달래고 다른 비용은 '비정규직 고용'과 하청업체 비용전가로 해결하면서, 갈등은 해결되지도 않고 봉합만 되면서 지금까지 흘러오게 됩니다. 지금 이 상황에서 어떤 큰 기업/산업 단위에서 구조조정 필요성이 제기 돼도, 우리는 IMF 외환위기와 강제된 프로그램 가동에 의한 방법 말고는 제대로 된 갈등해결 기제를 가져본 적이 없기에, 선제적 구조조정도 이뤄지기 어렵고, 막상 엄청난 위기가 닥쳐도 문제가 해결되기 어려운 상황이 됩니다. 노동자 입장에서 보면, 기업 복지 밖으로 나가는 순간 복지는 커녕 사회 안전망도 제대로 갖춰져 있지 않기에 쉽게 합의를 할 수도 없고, 이후의 재고용이나 대책을 국가가 보장할 수도 없기에(그런적도 없기에), 더욱 완강하게 버티게 되죠. 마찬가지로 기업은 정말 망하기 직전까지는 계속적인 '외주화'와 '하청업체 갑질'을 통해 버틸 수 있기에 구조조정 유인이 생각보다 약합니다. 그리고 IMF 때의 기억, 즉 망하기 전에 혹은 망하더라도 기간산업이거나 덩치가 클 경우 국가가 살려주긴 하겠지 라는 믿음도 강하죠. 3. 의회를 활용하는 것이 현재로선 최선이지만... 철도파업을 기억하시는지요? '민영화'라는 이슈가 핵심이었는데, 역시나 구조조정을 수반할 수밖에 없는 이슈였고 갈등은 극으로 치달을 수밖에 없었습니다. 마주앉아 서로의 입장을 얘기하고 대안을 모색하는 상황 자체가 어려웠는데요, 그나마 그때 김무성의 제안으로 의회 내에 '철도소위'가 꾸려집니다. 그 의도와 성과는 차치하더라도, 현재 한국사회에서 이런 종합적인 갈등, 특히 '구조조정 이슈'가 만들어내는 폭발적 갈등을 해결하거나, 최소한 실마리를 풀 수 있는 곳은 의회밖에 없다는 생각이 듭니다. 물론 큰 기대는 안합니다만. IMF 외환위기가 지나고 한국사회에 타의에 의한 '구조조정'이 정리해고와 비정규직 확산 중심으로 급격히 진행된지 20년이 지났습니다. 이제 우리는 만들어놓은 우리만의 갈등해결 기제를 만들 때가 됐습니다. 이미 늦었다고도 할 수 있지만. 다들 왜 제때, 골든타임에 구조조정을 못하느냐고 준엄하게 꾸짖기만 하는데, 이 상태로는 어차피 무한반복입니다. 이제 우리만의 갈등해결시스템, 특히 산업구조조정과 변화 속에서 벌어지는 갈등을 조정하고 합의할 수 있는 우리만의 제도를 실험적으로 자꾸 만들고 시도해보고 바꿔보고 해야합니다. 저도 대안은 없습니다만, 왜 안되는지도 모르고 혹은 생각하지도 않고 자꾸 준엄한 꾸짖음으로만 일관하는 분위기에서 한 마디는 남기고 싶어서 글을 써 봤습니다. 이상 마칩니다. P.S. 4조가 아니라 더 들 수도 있었다(STX가 법정관리를 일찍 신청했으면)라는 의견이 있습니다. 설득력이 있는 의견이지만, 관점에 따라 그리고 어떻게 평가하느냐에 따라 크게 달라지는 부분입니다만, 그 기본 로직은 나중에 관련이슈가 크게 불거질 때 얼마전 업계 전문가로부터 들은 해설을 옮겨보도록 하겠습니다. 가끔씩은 궁금한 것이 성공한 구조조정이란 무엇인가.... 성공한 구조조정이라는 것은 존재하는 것인가... 입니다.
과거 MB가 대통령이 될 때, 가장 황당했던 것이 잃어버린 10년이였습니다.
지난 10년간의 경제정책은 실패였다고 주장하는데,
그 기준이 중국에 비해서 경제성장이 떨어진다는 것이였습니다.
그 당시 중국은 신흥경제국가였고,
한국은 중국처럼 고성장하는 것이 불가능 또는 이상한 국가였기 때문에,
중국수준으로 성장했으면 인프레이션 때문에 엄청난 고통을 받았을 겁니다.

실제로 보면 기존 사업을 정리하거나 안락사 시키는 것이 대부분입니다.
물론 운이 좋으면 새로운 사업이 나와서 성공하기도 합니다만 그것이 과연 계획된 것인지는...
(하지만 GE가 제조업을 버리고 금융으로 갔다가 다시 금융을 버리고 제조업으로 가는 것을 보면 사업 몰라요..)
그런 점에서 비용을 들여가면서 사회적 피해를 최소화 하기만 해도 구조조정을 성공적이라고 생각해야할 터인데,
대부분의 사회구성원은 자기 자신만의 기준으로 평가를 해서 그런지,
어떻게 해도 실패를 논한다는 점에서 '준엄한 꾸짖음'만 난무하는 것 같습니다.
