학교 주변에 방을 구하고 있습니다. 돈이 부족하다보니 아무래도 보증금 적고 월세 싼 곳 으로 알아보고있는데, 선택지가 고시원, 원룸텔 들 밖에 없더라고요. 발품을 여러 곳 판 결과, 현실적인 예산 범위 내에서 가장 마음에 드는 곳을 정했고 어제 등기부등본이랑 건축물대장을 열람했는데.. 이거 계약해도 될 지 잘 모르겠네요. 각 서류의 마지막 부분에서 중요사항들만 간략하게 적습니다. 등기부등본이랑 건축물대장을 캡쳐해서 편집하려고 했는데 쉽지 않네요 ;; 등기부등본 표제부 건물내역 알씨조 및 벽돌조 평슬래브 4층 근린생활시설 및 주택 지층 149.61m^2 근린생활시설 (가내수공업) - 실제론 지하층도 원룸텔이었습니다. 1층 123.3m^2 근린생활시설 (소매점) - 세탁소입니다. 2층 128.7m^2 (사무실) - 역시 실제로는 원룸텔이었던 것 같습니다. 3층 143.5m^2 주택 (1가구) - 역시 호수는 여러개... 4층 143.5m^2 옥탑 16.8m^2 - 제가 본 곳이 여기였습니다. 구조 : 알씨조-지,1,2,3층 벽돌조-4층 등기부등본 갑구 박XX 씨와 김XX씨가 건물지분 1/2씩 공유지분으로 소유하고 있다고 나와있습니다. 거주지와 생년월일로 미루어보아 부부인것같습니다. 2009년, 2011년 압류되었던 적이 있습니다. 압류등기는 모두 압류되었던 해(2009,2011)에 말소되었습니다. 권리자는 서울특별시 성북구였고, 주택관리과에 의해서 압류되었었네요. 2011년 해당 원룸텔이 있던 성북구에서 합정 쪽으로 전거하고, 전거로인한 등기명의인표시변경은 2013년 3월에 등기접수를 했다고 나와있습니다. 등기부등본 을구 2003년 소유주이외에 다른 분인 고XX씨를 채무자로 4천만원 근저당권 설정되었다가, 2003년 근저당권설정등기말소되었습니다. 2008년 5천만원의 전세금으로 전세권 설정이 있었습니다. 1년후인 2009년 전세권등기 말소됩니다. 2004년 5억2천의 근저당권설정이 있었습니다. 해당 건물과, 당시 서류상 소유주 거주지였던 다른 건물, 그리고 토지 를 공동담보로 하였네요. 2009년 3억9천의 근저당권설정이 있었습니다. 공동담보는 5억2천짜리랑 동일합니다. 새마을금고가 채무자입니다. 위 근저당권설정들은 2013년 3월에 등기말소되고, 동일자인 2013년 3월 채무자 하나은행으로 4억8천의 근저당권설정이 잡힙니다. 담보는 현재 갑구에서 거주지로 나와있는 아파트와 이전 근저당권설정에서도 담보로 잡았던 토지입니다. 갑구 내역 중 전거로 인한 등기접수가 똑같이 동일자인 2013년 3월로 있습니다. 그리고 이 근저당권은 현재 말소되지 않고 남아있는 상태입니다. -- 다음은 건축물대장입니다. 일반건축물대장(갑) 이란 제목과 함께, 위반건축물이라는 글씨가 쓰여져있습니다. 호수/가구수/세대수 각각 0호/1가구/0세대 입니다. 지역은 일반주거지역, 지구는 주차장정비지구 층수는 지하1층/지상4층으로 나와있고요. 주용도는 주택(1가구)로 표기되어 있습니다. 96년 1월 신축, 08.12.31 주택관리과-21529(2009.01.05)호 의거 위반건축물표기 [위반내용 : 주거(판넬/판넬) 50m^2] 입니다. --- 그럼 질문입니다. 가장 궁금한건 계약을 할 경우 보증금을 온전히 돌려받을 수 있는가가 핵심입니다. 살게된다면 2월 말까지는 확정적으로 살고, 차후 제 사정을 보면서 6월말까지 연장할 수도 있고, 안할 수도 있습니다. 2월말까지만 산다면 4개월 남짓 사는거라 6개월 미만의 일시거주입니다. 건물에 근저당권설정이 되어있고, 건축물대장에 위반건축물로 찍혀있습니다. 제가 본 방은 옥탑층(5층)에 여러 호수들 중 한 방인데요, 건축물대장에서는 지상4층으로 나와있고, 용도는 주택(1가구)이지만 실제로는 층마다 호수가 여러개입니다. 그런데 0호/1가구/0세대 로 나와있네요..뭔가 찝찝합니다. 왜 위반건축물로 찍혔는지도 잘 모르겠고.. 고시원(근린생활시설)로 등록해놓고 취사시설을 설치한 건물에 들어가면 문제가 생길 수도 있다고 알고있어서 불안합니다. 건축물대장을 뗐는데 고시원은 아니고 주택으로 등록되어있는거같긴한데.. 서류를 떼보니 오히려 더 모르겠네요. 주변 자취하는 친구들한테 물어보니 오히려 등기부등본같은 서류를 안뗀 친구들이 많더군요 ;;; 자기들도 잘 모르겠다고... 근데 다들 만족하면서 알아서 잘 살고있으니 저도 그냥 계약해버릴까 고민이기도 합니다. 보증금 100에 관리비포함 월세38로 개별화장실, 개별냉난방,에어컨,전자렌지,세탁기,냉장고,침대,책상 이면 나름 괜찮다고는 생각되는데, 북향에다가 옥탑층, 벽에다 푹신푹신한 단열재벽지를 두름, 온수나오는 속도가 늦다는 점에서 소음문제와 난방문제가 우려됩니다.. 푹신푹신한 단열재벽지두른건 여러 방 돌면서 여기서만 봐서 걱정이 되네요 첫 자취라서 기왕이면 좋게 첫출발을 좋게 시작하고 싶은데 아무래도 집안 지원을 전혀 받지않고 독립하는거라 예산이 없으니 너무 힘드네요..ㅠㅠ 서류상의 문제 뿐 아니라 본인의 자취 경험담을 토대로 조언해주셔도 좋습니다. 현재 예산은 보증금 최대 200, 월세 관리비포함 월 40까지 낼 수 있는 능력이에요.... 지역은 성북구 모 대학근처입니다. 그리고 고시원(근생)으로 해놓고 취사시설을 놓은 집에 들어가면 문제가 된다?? 이건 무슨 말씀이신지 모르겠습니다. 입주자 입장에서는 법적으로는 문제가 없어 보이는데요.... 전입신고같은걸 말씀하시는걸까요?
