https://www.khan.co.kr/opinion/column/article/202305080300065 학교폭력은 엄벌이 답이라며 급하게 만든 교육부의 학교폭력 종합대책이 얼마 전 발표되었다. 이 대책 중 피해학생과 관련된 내용은 생각보다 많지 않다... 대부분은 가해학생에 관련된 내용인데, 가해학생 학폭위 조치사항을 학생부에 4년까지 보존하고 대입 입시에도 직접 반영하겠다는 것이 전면에 강조되었다. 문제는 이 대책 속 결정과 조치들은 모두 소송으로 연결되어 법정 싸움이 될 수 있다는 것이다. 학교폭력에 관한 소송이라면 피해학생이 가해자를 고소하면서 열리는 형사소송을 떠올리기 쉽지만 실상은 다르다. [가해학생이 제기하는 소송이 훨씬 많다.] 학생부 기록이 중요한 학생은 학폭위 결정을 다투며 행정심판이나 행정소송을 건다. 학급교체 조치를 당한 학생은 법원에 집행정지 신청을 낸다. 사건 진행 과정에서 자신의 편을 들지 않거나 서운하게 한 교직원을 아동학대로 고소하거나 위자료를 달라며 민사소송을 건다... 피해학생을 보호하고 가해학생을 선도·교육하며 그 둘의 관계 회복을 도모하자고 만든 [학폭위는 이겨야 하는 전쟁터]가 되어버렸다. 피해학생은 가해학생이 더 강한 처분을 받도록, 가해학생은 더 낮은 처분을 위해 온갖 증거를 모으고 변호사를 선임한다. [남소(소송남발)는 소송을 걸 여력도 없는 가난하고 취약한 상황의 학생들을 더 힘들게 만든다]... 설상가상으로 이번 대책은 가해학생 학생부 기록을 삭제하려면 피해학생의 동의를 받도록 했는데, 이 동의를 받아내려고 [피해학생을 압박하거나 쌍방 폭력으로 무리하게 몰아가는 것에 대한 대비책은 전무]하다. 소송이 폭증할 수밖에 없는 구조가 수년간 고착화되면서 학교는 법적 꼬투리를 잡히지 않는 기계적 업무처리에 더 신경 쓸 수밖에 없게 되었다. 그러나 그 와중에도 학교폭력을 교육적으로 해결하기 위한 현장의 노력도 이어져왔다... 학교의 노력은 회복적 생활교육, 학교 밖 관계회복 지원단, 관계가꿈 프로젝트 등 여러 이름으로 지속되어 왔으나 예산이나 인력의 부족으로 지역 간 상황이 고르지 않다... 학교라는 특수성을 무시한 채 들어선 법치만능주의는, 변호사는 웃게 할지 몰라도 학교 안을 살아가는 사람들에게는 불안과 부담이 될 뿐이다.. 지난 칼럼도 볼 만해서 같이 가져옵니다. https://www.khan.co.kr/opinion/column/article/202303130300095 ...안타깝게도 지난 몇 년간 형사사법체계에서 피해자의 설 자리는 급격히 좁아졌다. 사건 시작부터 난관이다. 원래 피해자는 경찰과 검찰 어디에라도 자신이 당한 범죄를 알릴 수 있었다. 그런데 2021년부터 시행된 검경 수사권 조정으로 검찰에 알릴 범죄와 경찰에 알릴 범죄가 복잡하게 쪼개지더니 대부분의 사건을 검찰에 말할 수 없게 되었다... 겨우 사건을 접수시켰다고 하더라도 산 넘어 산이다. 수사권 조정으로 경찰이 수사종결권을 가지게 되면서, 확실한 증거가 있는 사건은 검찰에 송치되지만 그렇지 않은 사건은 경찰이 종결할 수 있게 바뀌었다... 수사권 조정 전에는 모든 사건이 검찰로 송치되어 피해자는 저절로 두 번째 기회를 얻었지만, 이제는 애써 이의를 제기하는 소수의 피해자만 검찰에 사건을 보낼 수 있다. 여기에 작년 봄 휘몰아친 검수완박 입법으로, 이의송치된 사건에 대한 검찰 보완수사도 제 기능을 잃게 되었다. 민주당이 이의송치 사건에 대한 검찰의 보완수사를 ‘동일성’ 안에서만 하라고 법을 바꿨기 때문이다. 불송치 결정에 대한 ‘고발인’의 이의신청권도 별다른 이유 없이 이때 삭제되었다. 천신만고 끝에 사건이 송치되어도 피해자의 눈물은 이어진다. 수사권 조정 때 검찰 작성 피의자신문조서의 증거능력이 없어진 것에 더하여 검찰의 수사지휘권까지 없어지면서, 경찰과 검찰 누구도 사건을 책임지지 않는 합법적 ‘핑퐁’ 지옥이 시작되었다. 검찰은 ‘보완수사요구’라는 간단한 방법으로 사건 관리 목록에서 사건을 날릴 수 있게 된 반면, 경찰로 몰린 수사업무의 과부하로 보완수사요구는 산처럼 쌓여간다... 70년 넘게 이어온 형사사법체계를 불과 3년 만에 뒤죽박죽 바꾸면서 피해자가 형사사법제도를 통해 영광을 찾을 기회는 점점 요원해지기만 한다... 실제 삶의 현장에 지나치게 큰 거시적 명분이 개입하는 경우 대체로 남아나는 게 없지요.. 선이냐 악이냐 죄이냐 벌이냐만 남고 미시적인 진실은 휘발되어버림. 자정 기능이 중요한 이유..
