http://likms.assembly.go.kr/bill/billDetail.do?billId=PRC_A1Q7Z0R5S1C7S1T0P4P7U3G7F1G2R3 전제가 되는 개정안은 6904/6905 의안번호입니다 개인적으로 양면적인 문제가 있는 법안이라는 생각이 듭니다. 노무사 직업권리 보호라는 문제는 일단 제쳐두고 노동자 입장에서만 고려해 보겠습니다. 1. 처리의 부담 증가 조직되지 않은 노동자는 전체 노동자의 9할입니다. 그리고 이 9할이야말로 행정청과 사법부 없이는 부당노동에 저항하기 힘든 분들이죠. 지방노동위원회나 근로감독관 및 노무사들의 역할은 이러한 비조직화된 노동자들이 하루라도 빨리 적절한 생활의 안정을 찾기 위해 되도록 빠르게 사건을 해소해야합니다. 조직화된 노동자들에 비해 이분들은 도움받을 곳이 워낙 없거든요. 노동법원이 공법이든 사법이든 결국 법리체계 안에서 움직일텐데, 법 분쟁의 특성상 청구인과 피청구인, 혹은 피고인과 피의자간에 비교적 동등한 권리를 보장하게 됩니다. 그 말은 '돈 있는 쪽이 시간끌기 시작하면 한도끝도 없다'는거죠. 본 개정안에는 노동법원이 없어서 노동자가 오랜 시간 소송에 이끌려다녔다고 하지만 사실 사측이 법원에 적극적으로 나서기만했어도 훨씬 일찍 끝났을 겁니다. 노동법원이 있다고 해서 짧아질 시간이 아니죠. 게다가 개별 노동자라면? 이는 더욱 더 큰 문제가 되게됩니다. 상대를 압박할 수단이 별로 없죠.. 노동위원회와 근로감독관의 경우 행정지도를 통해(물론 가처분정지나 행정소송을 통해 막을 수 있지만) 사용자측이 이익을 계량할 수 밖에 없게끔 만듭니다. 재판까지 가긴 싫은 사용자들이 여기서 보통 합의를 보지요. 그런데 만약 재판으로 일원화가된다면? 끝까지 가보자고 할 사람이 늘어날 가능성도 있습니다. 반면 개별 노동자의 부담은 늘어난다고 봐야하고요. 노동법원의 규모가 어마어마하게 크지 않다면요.. 2. 간접적인 노동조합의 약화 사실 노동조합을 해서 갈등을 통해 힘으로 얻어내는 방식은 고달프고 힘듭니다. 하지만 확실하죠. 법은 오히려 혼란스럽습니다. 판사따라 갈라지고 변호사 따라 갈라지고.. 노동자 입장에서는 '성공적인 단협'이 '공정한 판사'보다 더 절박합니다. 그리고 단협을 이끌 수 있는 조직된 힘이 있다면 재판까지 가지 않고도 많은 권리를 획득할 수 있죠. 그런데 노동법원이 일반화되면 대부분의 개별 노동자들은 가뜩이나 부담스러운 노동조합을 더 꺼리게 될 수도 있습니다. 꺼리더라도 노동자 개별권익이 잘 보호되면 좋을텐데, 실상은 현재 조합되지 않은 노동자들이 사측 법무팀과 붙었을때 와장창 소리나게 털려나가는것만 봐도 알수있죠...소송까지 가기도 어렵고요. 노동법원으로 위원회의 역할이 줄고 법원중심으로 갈등이 귀결된다면 노동자 입장에서는 노조보다는 개별적 법률조정을 신청할 동인이 꽤 있다고 생각합니다. 하지만 실제로 진행해보면 정말 어려울테고, 그걸 알게 된 뒤에는 노동조합으로 돌아가기조차 어려울수도 있지요. 법과 법원이 같는 든든한 느낌과 노동조합이라는 말이 갖는 껄끄러운 느낌... 실제로 노동자들에게 어떤게 더 힘이 될 수 있을까 하면 노동조합이 그나마 더 좋은 방식이 아닐까 하는 생각이 듭니다. 물론 둘 다 잘되면 좋지만요. 그런면에서 노동법원이 제대로 기능하려면 노사관계법과 노동조합법, 손배소관련 법안, 파업 및 단결권 관련 법안들이 먼저 개정되어야 한다고 생각합니다. 노조도 튼튼하고 노동법원도 제대로 기능해야만 부작용을 줄일 수 있다고 봐요. 그렇다면 장점은 뭐가있을까요.. 역시 전문 법원의 탄생과 권한의 집중으로 인해 사측에 대한 행정력이 강화될 수 있다는 점을 기대해 볼 수 있습니다. 즉, 사측이 소송까지 가겠다는 노동자가 많으면 귀찮고 짜증나지니까 지금보다 부당노동행위를 덜 할 가능성도 있는거죠.(물론 제가 보아온 바로는 꽤 큰 사용자들일수록 회사의 손해가 노조를 깨는 비용보다 낮아도 노조 깨고 노동자 깨는걸 중요시 했습니다만) 이익을 잘 계량하는 회사라면요. 또 한가지는 개별 비조직 노동자들이 지금보다는 더 나은 노동관련 서비스를 국가에 기대해 볼 수 있다는 점일겁니다. 근로감독관 숫자도 너무 적고 권한도 적어서 조금만 합의가 어려워지면 바로 검찰에 수사요청해야하고 그러면 검사한테 지휘받아야하는데 검사님들은 워낙에 바쁘니 제대로 의욕갖고 수사하기도 어렵고... 소액이고 개인일수록 회사의 부당노동에 대해 항의하기가 어려웠는데 바로 노동전문법원을 통해 소송을 걸 수 있다는건 어느정도 여유가 있고 본인을 갈아넣을 수 있다면 싸움을 시작하기 좋아졌다는 장점도 있을 것 같습니다. 마지막으로는 노동 법원의 탄생과 확대가 노동관련 법안의 변화와 노동법안 관련 법조인들의 전문적인 역량강화정도 겠네요. 개인적으로는 이걸 약간은 반대합니다. 노사갈등과 노동자탄압의 본질은 위원회냐 법원이냐는 아닌거같아요. 노동자 입장에서 회사랑 갈등을 해도 되는가, 갈등을 하게 되면 내 편이 될 수 있는 힘을 만들어도 되는가, 갈등 이후에도 비지니스를 지속할 수 있는가. 세가지가 엄청 중요한데 이 세가지에 대한 법의 기울어진 판단들과 그 기준들이 수정되지 않는다면 노동법원은 또 하나의 요식기관이 될 수 있다는 생각을 하거든요. 하지만 장점이 없는 것도 아니니 판단은 각자의 몫인거 같아요. 이 법안들이 노동자 권한을 직접적으로 악화시킨다고 얘기하긴 조금 어렵지 않나 싶었습니다. 선제적으로 개선할 것들을 개선 먼저 해줬으면 하는 마음이 드네요. 근데 사실 그런건 더민주 포지션에서는 동의 못할거 같아요. 문재인 대통령도 노조에 별로 친화적이지 않고, 포지션도 그렇고....그렇습니다. 이건 개인적 생각이에요. 저도 이 사안을 잘 아는 건 아니지만 노동법원 설립은 아마 동의하는 분들이 많을겁니다.
기본적으로 판사들조차 노동 관련 법안을 그렇게 잘 알지 못한다고 하더군요. 그래서 전문적인 법원이 필요하고
이에 대해 크게 반대하진 않는다고 합니다. 다만 위원회를 통해 처리할 시 노동자에게 좀 더 빠르고
간편함이 있지만 적당히 타협하는 결론이 나고, 법원으로 가면 변호사를 통해야 해서 시간과 비용이 증가하는 반면에
판결로 끝까지 결론이 나는 흐름으로 알고 있습니다. 장단이 있는거죠. 노동자에게 이득인지는 모르겠네요.
