아래에 제가 쓴 글과 같은 책의 같은 챕터에 나온 것인데, 이건 꼭 올려야 할 것 같네요. 뇌절인 것 같은데... 관련내용을 총 합하면 12페이지 가량 되는 글인데, 어찌 올려야 할지 고민을 해야겠읍니다... 자각해야 할 것 한편 이러한 자숙요청이나 도시봉쇄는 이동이나 여행의 자유와 같은 사권（私権）의 제약을 동반하게됩니다. 이것에 관하여 독일의 메르켈 수상은 3/18일 국민에게 연설을 하였습니다. 연설은 "친애하는 독일 거주민 여러분"으로 시작하여, "코로나바이러스는 현재 우리나라의 생황을 극적으로 변화하고 있습니다"로 이어집니다. 그리고. 다음과 같은 내용이 나옵니다. "개방된 민주주의에 필요한 것은 우리들의 정치적결단을 투명하게 하여, 설득하는 것, 우리들의 행동의 근거를 될수 있는 한 제시하여 그것을 전달 함으로서 이해를 얻으려 노력하는 것 입니다. (중략) 연방정부와 각주가 합의한 폐쇄조치가 우리들의 생활에, 그리고 민주주의적인 자기인식에 얼마나 엄격하게 개입하게 되는지 저는 알고 있습니다.(중략) 저는 보증합니다. 여행 그리고 이동의 자유가 역경을 극복하여 획득한 권리 임을 실감하고 있는 저에게는 이러한 제한은 절대적으로 필요한 경우에만 정당화 될 수 있는 것 입니다.이러한 조치는 민주주의사회에 있어서 결코 가볍게 결정되어서는 안되며, 일시적인 경우에만 허용해야 합니다. 그렇지만, 그것은 지금, 생명을 구하기 위해서 불가피합니다." 이동이나 여행이 개인의 자유로서 주어지지 않았던 동독출신으로서, 이러한 권리는 하늘로 부터 부여받은 것이 아닌 스스로가 쟁취해야 하는 것이라는 것을 누구보다 잘 알고 있는 그녀 조차도 [자유를 제한 할 필요가 있다]고 국민의 양해를 요구한 발언이었습니다. 사권의 제한은 그정도로 사회나 개인에게 큰 고통을 줄 수 있는 예외적인 조치입니다. 지금은 경제활동을 재개 하려는 길을 모색하고 있는 시기입니다. 그러나, 언젠가 또다시 저희들의 외출이 제한되고 도시의 봉쇄가 요구되는 시기가 다가올 지도 모릅니다. 이러한 때이기에, 사권의 존재형태와 제한에 관해서는 그것을 요청하는 측도, 수용하는 측도 자각하지않으면 안됩니다. 적어도 저는 자각해야 된다고 생각하고 있습니다. 이것은 포스트 코로나 사회에 있어서도 감염예방을 위해서는 강한 감시국가가 좋은 것인가, 시민의 권한부여에 의한 민주주의적 수법에 따른 사회가 좋은 것인가라는 의논으로도 연결이 됩니다. 자칫 잘못하면 긴급시의 강권적인 사권의 제한은 그 후의 일상에도 그림자를 남길 수 있습니다. 이러한 것도 자각할 필요가 있겠지요. 저는 학부시절에는 기초학문을 전공해서 그런지 권리는 절대적이라는 것에 대해 별로 의문이 없었는데, 대학원에 와서 공부해보니 막상 어떠한 이익형량(공익과 사익의 비교)도 허용하지 않는 절대적인 권리는 흔치가 않더군요. 우리나라에서 소송상으로 인정되는 절대적인 권리라고 한다면 생명권이나 사전검열금지원칙 정도? 결국에는 본안판단으로 들어가면 법익의 형량으로 들어가게 되고, 코로나 시국에 문제가 되는 거주이전의 자유나 경제적 자유도 그 대상에서 완전히 자유롭지는 않더군요. 처음에는 지나치게 타협적인 것 아니냐? 이런 생각을 했는데, 점차 ... 더 보기

결국에는 그 권리가 아무리 소중하다고 해도 모두가 모여 살아가는 세상에서 어떤 권리를 100% 보장한다는 것은 이상론에 가깝습니다. 테스트 같은 것을 해보면 저는 리버태리언에 가깝게 나오는데, 그럼에도 불구하고 코로나 시국에는 권리의 "제한"은 어쩔 수 없는 부분이 있다고 생각합니다. (물론 그럼에도 "침해"는 안되겠지만..) 저는 방역당국의 제한조치를 비행기 탑승시의 안전벨트 착용 정도의 감각으로 이해하려고 생각합니다.
그렇다고 해서 권리에 대한 논쟁이 무의미한 것은 아니고, 반대로 그럴수록 권리에 대해서 더 이야기하고 고민할 필요가 있지 않을까 생각합니다.

결국에는 그 권리가 아무리 소중하다고 해도 모두가 모여 살아가는 세상에서 어떤 권리를 100% 보장한다는 것은 이상론에 가깝습니다. 테스트 같은 것을 해보면 저는 리버태리언에 가깝게 나오는데, 그럼에도 불구하고 코로나 시국에는 권리의 "제한"은 어쩔 수 없는 부분이 있다고 생각합니다. (물론 그럼에도 "침해"는 안되겠지만..) 저는 방역당국의 제한조치를 비행기 탑승시의 안전벨트 착용 정도의 감각으로 이해하려고 생각합니다.
그렇다고 해서 권리에 대한 논쟁이 무의미한 것은 아니고, 반대로 그럴수록 권리에 대해서 더 이야기하고 고민할 필요가 있지 않을까 생각합니다.
