제목 그대로 해고예고 수당과 방법에 대한 문의입니다. 몇가지 정보는 - 현재 수습기간 3개월 포함 7개월째 근무 중 - 법정 근로시간과 정시출근 정시퇴근 준수 - 해당 업무에 대한 숙지와 능력이 부족하다는(사수의) 지적 - 그래서 직원과 대화를 가져본 결과 해당 업무를 위해 필요한 프로그램이 몇 개 있는데 이력서에는 본인의 실력이 최상이라고 적음(채용의 큰 이유) 그러나, 테스트 결과 기초도 제대로 모름. 그런데 왜 그렇게 적었냐고 했더니 자기 기준에 잘 하는줄 알았다고 함... - 입사해서 현재까지 본인 업무에 대한 프로젝트가 완성이 된 적이 없었음 몇 가지 더 적었었는데 보는 시각에 따라 객관적이지 못하다고 생각할 수 있어서 삭제했습니다. 그래서 사측에서는 해고를 하려고 합니다. 그런데 요즘은 근로기준법에 해고를 하려면 해고 예고와 함께 해고예고 수당을 지급해야 한다고 하는데 해고예고 수당은 무조건인가요. 직원을 잘못 뽑은 인사과의 책임으로 회사가 부담해야하는건가요;; 해고 예고 30일 전에 하던가, 즉시 해고를 하려면 예고수당을 줘야 한다고 하는데 해고 예고를 하고 한 달 동안 저같아도 퇴사할 회사 일 제대로 안할것 같은데 ㅎㅎ 근로기준법을 보니 ①근로자가 근로한 기간이 3개월 미만인 경우 ②천재/사변 그 밖의 부득이한 사유로 사업을 계속하는 것이 불가능한 경우, ③근로자가 고의로 사업에 막대한 지장을 초래하거나 재산상 손해를 끼진 경우로서 고용노동부령으로 정하는 사유에 해당되는 경우 이렇게 세 항목이 있고 근로기준법 시행규칙 제4조에서는 해고 예고의 예외가 되는 근로자의 귀책사유에 대해 ‘별표’를 통해 규정하고 있다고 하는데 1. 납품업체로부터 금품이나 향응을 제공받고 불량품을 납품 받아 생산에 차질을 가져온 경우 2. 영업용 차량을 임의로 타인에게 대리운전하게 하여 교통사고를 일으킨 경우 3. 사업의 기밀이나 그 밖의 정보를 경쟁관계에 있는 다른 사업자 등에게 제공하여 사업에 지장을 가져온 경우 4. 허위 사실을 날조하여 유포하거나 불법 집단행동을 주도하여 사업에 막대한 지장을 가져온 경우 5. 영업용 차량 운송 수입금을 부당하게 착복하는 등 직책을 이용하여 공금을 착복, 장기유용, 횡령 또는 배임한 경우 6. 제품 또는 원료 등을 몰래 훔치거나 불법 반출한 경우 7. 인사/경리/회계담당 직원이 근로자의 근무상황 실적을 조작하거나 허위 서류 등을 작성하여 사업에 손해를 끼친 경우 8. 사업장의 기물을 고의로 파손하여 생산에 막대한 지장을 가져온 경우 9. 그 밖에 사회통념상 고의로 사업에 막대한 지장을 가져오거나 재산상 손해를 끼쳤다고 인정되는 경우 가 있는데 이력서에 허위사실로 취업을 했다면 해고예고 수당의 예외가 발생하는지 알고싶습니다.
