1년짜리 전세 계약이 된 집을 매수하게 됐습니다. 몰랐는데 1년 짜리 계약은 임차인이 임의로 1년 더 산다고 하면 임대인은 받아들여야만 하는가 보더군요. 이럴거면 1년짜리 계약은 아예 못하게 하던가... 아무튼 이제 계약만료가 석달 정도 남아서 임차인에게 계약 끝나면 우리가 들어가려고 하니 나가달라고 전화를 했습니다. 나간다고는 하는데 뭔가 석연치가 않네요. 전세금 10% 보내준다고 계좌번호를 알려달라고 해도 답이 없구요. 임차인이 집을 비워준다는 가정 하에 현재 세들어 살고 있는 집주인에게도 연락을 하고 이후 과정들을 진행해야 하는데 문득 걱정이 되네요. 만약에 이러다가 두어달쯤 지난후에 임차인이 더 살겠다고 하면 어떡해야 하나 해서요. 통화는 녹음을 못했는데 문자만 남아 있어도 이게 법적효력이 있나요? 임대차 보호법상 임대차계약은 2년 단위입니다. 1년짜리 계약은 법으로 아예 못하게 막은 것입니다. 그럼에도 당사자 간 1년짜리 계약을 했다면 그 위험은 임대인이 부담하는 것입니다... 강행규정으로 임차인이 1년 살고 나가는 거에 동의를했어도 막상 안 나가면 2년 살게 해줘야합니다. 심지어 임차인 임대인 간 제소전화해를 했어도 소용이 없습니다.
안 나가면 어쩔 수 없습니다...
