상황설명을 드리겠습니다. 출첵 스터디에 가입하여 지난달부터 활동하고 있었습니다. 출첵스터디란, 생활습관 관리 등을 위해 자신이 정한 장소에 자신이 정한 시간까지 가서 카톡으로 사진찍고 인증하는 겁니다. 지각이나 결석을 할 경우 벌금을 각각 천원, 이천원씩 내는게 규칙입니다. 저 포함 대략 8명이 있었고 2주간 자신이 정한 장소와 시간은 변경하지 못한다는 룰이 있었습니다. 그런데 제가 불가피한 사유로 원래 인증하던 장소에 아예 출입을 하지 못하는 상황이 생겼습니다. 저는 원래 제가 정한 장소에 갈 수 없으니, 인접한 다른 장소에서 제시간에 인증을 했습니다. (2주를 다 채우기전에 부득이하게 장소변경을 할 경우에 대한 스터디 내 규칙은 따로 존재하지 않습니다. 면접, 입원 등의특별한 사유로 결석을 하게 될경우 출석으로 인정한다는 룰은 존재합니다.) 2주간은 변경하지 못한다는 룰 때문에, 저는 이 룰에 따른다면 출첵을 아예 하지 못하고 결석 벌금을 내야 하는 상황이 생겼습니다. 그래서 출첵스터디를 도맡아 하던 분과 상의해본 결과, 규칙이란게 있는거고 타인과의 형평성 문제도 있으니 자신 혼자 판단하긴 힘들다고 했고, 그래서 저는 투표를 통해 타 스터디원에게 양해를 구하는게 어떻냐고 물어봤고, 그 분은 이에 동의하여 투표를 진행하게 되었습니다. 저와 그 분을 제외한 총 6명중, 제 장소변경을 허용해준 사람이 5명, 반대한 사람이 1명이었습니다. 저는 과반수가 동의했으니 장소변경을 모두 허락해주신걸로 알고 별도의 페널티 없이 변경된 장소에서 인증하겠다고 했는데, 갑자기 몇 시간이 지난 뒤 스터디 진행하던 분이 만장일치가 아니니 규칙대로 벌금을 부과하겠다는 겁니다. 저는 지각을 한 것도 아니고, 부득이한 사유에 의해 어쩔수없이 원래 인증하던 장소에서 인증을 못하니 인접한 곳에서 인증을 하겠다고 한건데 결석과 똑같이 취급하여 벌금을 내는건 말이 안되며, 투표 진행할 당시엔 과반수나 만장일치라는 조건을 달지 않았는데 과반 이상의 찬성이 나오자 뒤늦게 만장일치여야한다고 뒤집어 버린것도 말이 안된다고 생각했습니다. 그래서 스터디 하차 의사를 밝히고, 보증금 9천원을 돌려달라고 하였는데, 저 분은 장소 변경한 이틀도 결석으로 쳐서 5천원만 돌려주겠다는겁니다. 제가 생각하기에 제가 맡긴 보증금은 제 돈이지, 그 분이 제 동의없이 멋대로 유용할 수 없다고 생각합니다. 내일 오전 9시까지 입금해달라고 했는데, 만약 입금을 안하면 경찰에 고발을 하는 등의 법적 조치를 취하고 싶습니다. 1. 몇 천원으로도 고발이 되나요? 2. 출첵스터디 가입 당시 맡긴 보증금은 법적으로 제 돈이라고 생각합니다. 가입 당시 한 달 이내 하차하면 돌려줄 수 없다는 규칙이 있으나, 이 경우 팀장의 동의를 구하고 진행한 투표에서 구성원 과반수 이상의 동의를 얻은 사안에 대해 스터디 팀장이 만장일치여야한다며 돈을 돌려줄 수 없다며 견해가 충돌하는 상황입니다. 법적으로 제 돈을 돌려받을 수 있나요? 3. 저는 사건 당사자라 객관적인 입장에서 여러분들이 판단해주셨으면 합니다. 추가적인 상황설명이 필요하면 최대한 객관적으로 설명드리겠습니다 Warning: Use of undefined constant no - assumed 'no' (this will throw an Error in a future version of PHP) in /home/redtea/html/a_skin/bbsd/view.php on line 133 Warning: Use of undefined constant no - assumed 'no' (this will throw an Error in a future version of PHP) in /home/redtea/html/a_skin/bbsd/view.php on line 146 Warning: Use of undefined constant vote - assumed 'vote' (this will throw an Error in a future version of PHP) in /home/redtea/html/a_skin/bbsd/view.php on line 161 0 |
