상황은 이렇습니다. 제가 오픈마켓에서 소액 4천원 상당 물건 13개를 주문했습니다. 그런데 9개만 왔더군요. 물건이 덜왔다 판매자에게 연락을 했으나 판매자는 정량 보냈다며 배째라고 나오는 상황입니다. 다행이 가정용 CCTV에 택배 도착부터 개봉하여 꺼내는 과정이 모두 녹화가 되어 있습니다. 이 경우 저는 판매자를 사기죄로 고소가 가능할까요? 가능하다면 물품가액 외 어느정도까지 피해보상을 요구할 수 있을까요? 그까이거 16천원 별거 아닌데 판매자 태도가 너무 괘씸해서 혼내주고 싶습니다. 최대한 괴롭히고 싶네요. 변호사 선임하는게 가장 확실하겠지만.... 배보다 배꼽이 너무 커져서 혼자 해보려고 합니다. 2. 형사고소의 경우
결론적으로 상대방이 사기죄로 처벌되기는 어렵습니다. 사기의 고의가 입증되기 어렵고, 상대방이 덜보낸게
확인되더라도 착오라 주장하면 딱히 반박하기가 어렵기 때문입니다. 수사도중에 동일한 수법으로 인한
피해자가 다수 발견된다거나, 동종전과 있다거나 하면 사기로 처벌될 가능성도 있긴 하지만 그것은 알 수 없는 일입니다.
다만 최종적으로 사기죄로 처벌이 되지 않더라도 조사만 받게 되어도 상대방은 매우 괴로울 것이며
형사고소에서 고려해야할 위험인 무고죄 성립가능성은 없으니 번거로움을 제외하면 형사고소 자체는 가능합니다.
피해가 워낙 소액이어서 경찰에서 별로 하고싶어하진 않긴 할텐데..-_- 이건 어떤 경찰을 만나냐에 따라 달라서
예측하기 어렵습니다만 정식으로 고소장을 넣으시면 몇번 취하를 권유해보고.. 안되면 상대방에 전화해서
주라고 얘기해보고.. 그렇게 진행될텐데 일처리가 빨리빨리 되진 않을 가능성이 높습니다.
결국 귀찮음과 귀찮음, 괴로움과 괴로움의 등가교환....혹은 2:1교환-_-정도로 손해를 볼 가능성이 높아
그다지 권하고 싶지는 않습니다..만 위험이 있는건 아니라서 말리지도 않을..정도의 일이 되겠습니다.

분쟁조정위의 피해구제절차가 있는데 이게 강제력은 없지만 비용이 안들고 조사를 위원회에서 하며 비교적 빠른 편입니다.
(오픈마켓이 개인간 중고거래라는 의미시라면 이 절차를 이용하실 수는 없습니다)
