마스오카 후지오 전 도호쿠대학 교수는 1986년 도시바 재직당시 NAND flash 메모리를 발명합니다. 하지만 도시바가 마스오카 후지오 교수에게 준 상여금?은 100만엔, 여기까지라면 마스오카 교수는 참을 수 있었지만, 마스오카의 든든한 후원자였던 반도체기술소장 연구소장이 91년에 급사하고 새로운 소장이 부임하게 되면서 새로운 국면을 맞게 됩니다. 바로 그의 모난 성격에 대해서 이야기가 나오기 시작합니다. 새로운 연구소장은 상사에게 직언도 불사하는 성격으로 주변사람들과 많은 충돌을 빚었던 그를 부하연구원, 연구비도 없는 한직(직위는 연구소 넘버2)으로 승진 시킵니다. 꿈과 희망을 잃어버린 그는 94년 도시바를 퇴직하고 박사학위를 취득한 도호쿠대학 교수로 부임합니다. 그리고 2004년 도시바를 상대로 소송을 내게 됩니다. 발명자의 기여도 20%, 약 40억엔, 그중 10억엔을 요구하지만 결국 8700만엔으로 합의를 보게 됩니다. 현재 그는 교수직 정년퇴임후 일본의 전자회사인 Unisantis의 CTO로 재직중입니다. 나카무라 쇼지 교수는 니치아 화학공업에서 근무 당시 발명한 고휘도 청색발광다이오드를 발명하여 2014년 노벨 물리학상을 수상했습니다. 하지만 당시 발명의 대가로 회사에게 받은 보너스는 약 2만엔. 미국 연수중에 만난 동료교수들이 회사의 노예라는 별명으로 놀렸을 정도로 터무니 없는 가치라고 나카무라는 생각했습니다. 거기다가 연구원 생활도중 박사학위 취득하고 그즈음 청색 발광 다이오드가 출시되며, 여기저기 강연을 다니는 스타 연구자는 되었지만 정작 연구직에서 관리직으로 승진하게 되면서 연구에서는 멀어지게 되는 것을 참을 수 없던 나카무라교수는 99년 회사를 사직하고 미국 UCSB교수로 취임하게 됩니다. 그리고 2001년 니치아를 상대로 특허권 양도 및 특허대가 증액으로 소송을 하게 됩니다. 1심은 200억엔 지불을 판결했지만, 도쿄고등법원의 화해권고 끝에 약 8억엔에 양측은 합의를 보게 됩니다. 이게 사회적으로 이슈가 되어 404특허 소송으로 부르게 됩니다. 그렇다고 회사가 무조건 악당이라고 볼 수 없는 것이, 이 두 연구자들의 연구원 재직 당시 회사는 전폭적인 지원을 했다고 합니다. 마스오카 인터뷰를 찾아보면 당시 연구분위기를 그리워하며, 연구자가 몰입하고 회사가 뒷받침해줘야 과학이 발전할 수 있으며 그렇게 지원한 도시바에 회사분위기를 굉장히 고마워했다고 합니다. 나카무라 교수 역시 니치아 공업이 대기업은 아니었음에도 불구하고 본인에게 연구를 아낌없이 지원해준 회사 특히, 회사오너에게 추후 감사의 뜻을 전하기는 했습니다. 하지만 결국 그렇게 아낌없이 투자한 기술로 창출한 이익에 대해서는 공유하는 것을 회사는 절대로 허락하지 않습니다. 회사안에서 나온 모든 이익은 회사의 것이다라는 생각에서는 한발도 물러서지 않습니다. 결국 404특허소송이후 일본은 2015년 특허법을 개정하게 되는데, 직무로 인한 특허기술이 발명하게 되면 개정전에는 직무에 종사한 종업원에게 귀속되어 회사에게 "상당한 대가"를 지불받고 승계해야 했으나, 개정후에는 원시사용자(회사)에게 귀속되는 것을 선택할 수 있고, 종업원은 "가이드 라인(유학, 스톡옵션등등) 이 정해진 상당한 이익"을 받을 수 있다. 즉 그동안 발명자주의에서 사용자주의로 전환하게 된 것입니다. 작년 노벨의학상 수장자 인 혼조 다스쿠 교수 또한 비슷한 분쟁을 하고 있습니다. 면역항암제인 옵디보(Opdivo)에 대해서 교수는 1%로 설정되어있는 특허료를 인상을 원하지만, 오노제약회사는 그동안 연구비용을 투자한것을 이유로 거절합니다. 소송이 진행중인지는 모르지만, 혼조교수 담당 변호사는 준비하고 있습니다. 전세계 어디에나 있을 수 있는 일이라고 하신다면 할말은 없습니다만, 제가 바라보는 일본이라는 나라의 명암을 잘 보여준다고 생각합니다. 정말 잉여로워 보이는(하지만 포텐은 있는) 연구들을 자기가 좋아서 열심히 합니다. 그리고 그것을 회사나 학교는 꾸준히 지원합니다. 그리고 정말 놀라운 결과를 가져오는 경우가 종종 있습니다. 하지만, 그 결과에 대해서 인센티브는 박하다는 생각이 듭니다. 간혹 일본의 장인정신이라는 구호는 프로파간다가 아닌가 하는 생각이 듭니다. 결국 다른말로 하면 열정페이니까요. 아카데미와 비지니스가 함께 가는데, 선을 지켜야합니다. 이선균처럼요. 지금은 직무발명 보상금에 대한 대법원 판례도 많이 확립이 되어서.... 어마어마한 금액까지는 아닐 수 있어도 적어도 서로가 납득할민한 합리적인 수준 안에서의 보상은 이뤄지고 있는 편입니다. 물론 그렇게 까지 하는 기업은 어디까지나 대기업 수준에서지만요.....
제 전직장에 계시는 분은 매년 특허 관련된 보상금으로 천만원에서 이천만원 정도 꾸준히 받아가시는 분도 있었습니다. 예전에 비해선 많이 나아진 수준이죠.
