| Subject | 검찰이 박근혜 대통령을 '피의자' 신분으로 확정한 것에 대한 개인적인 생각 |

저는 소위 말하는 정알못 법알못입니다만 제가 알고있는 범주 안에서만 현재 시국에 대해 말해보겠습니다 어제 검찰이 박근혜 대통령을 직권남용권리행사 방해, 공무상비밀누설, 강요 등의 혐의로 최순실씨와 안종범 전 청와대 정책조정수석, 정호성 전 청와대 부속비서관 등과 공범 관계에 있다고 보고 박 대통령을 피의자로 입건했습니다. 박 대통령이 피의자로 입건된 것이 어떤 의미가 있는지에 대해 말해보겠습니다. 일반적으로 피의자로 입건됨과 동시에 검찰은 해당 피의자를 강제소환하여 조사를 할 수 있게됩니다. 하지만 박근혜 대통령은 현직대통령이므로 헌법이 정한 권리로 인하여 합법적으로 검찰의 소환과 조사를 거부할 수 있습니다. 그 유명한 불소추 특권이죠. 그렇다면 어차피 조사도 못하는거 피의자로 입건된 것과 참고인 신분인 것에 무엇에 차이가 있느냐고 하면 박근혜 대통령이 '현직 대통령' 신분을 상실함과 동시에 일반 피의자와 같은 신세(강제소환 및 조사)가 이루어 질 수 있다는 점이 가장 큰 차이입니다. 참고인이었다고 하면 다시 피의자로 기소하는 절차를 거쳐야하는데, 피의자로 입건된 이상 대통령에서 내려오는 순간 바로 끌려가는거죠. 또한 정치권에 '대통령이 법을 어겼다'는 확실한 메세지를 전해주면서 발화점에서 왔다갔다하던 탄핵논의에 갑자기 횃불을 던져넣은 꼴이 되었습니다. JTBC, TV조선 등 많은 언론들이 대통령의 범법행위 증거들을 밝혀내고 전국민이 이에 대해 알고있을 정도로 말 그대로 기정사실화 된 대통령의 범죄행위였지만 이게 사법기관에서 정식절차를 거쳐서 결과물로 나오지 않는 이상은 어디까지나 '의혹'에 불과한 것이었는데 어제 검찰의 피의자 입건은 말 그대로 '오피셜'이 뜬거죠. 이제 정치권으로서는 반가운 일이든 아니든간에 탄핵을 향해 움질일 수 밖에 없게 되었습니다. 그렇다면 대체 왜 이렇게 되었는가... 떡검이 무슨 일로 제대로 일을 하고있나? 라는 생각이 듭니다. 검찰이 이런 초강수를 둔 것은 두가지 측면에서 생각해볼 수 있을 것 같습니다. 첫번째로는 초강수라고는 하지만 그게 당연히 해야될 일이기 때문에 그럴겁니다. 기존에 언론에서 밝혀낸 것만 해도 이미 대통령의 범죄행위를 삼척동자도 알 수 있을 정도로 '대통령이 법을 어겼다'는 것이 전국민에게 알려져 있는 상황이니만큼 검찰에서 조사를 제대로 했다면 그보다 범죄사실에 대해 더 밝혀내면 밝혀내었지 더 이상 감출 수는 없는 상황이었을겁니다. 게다가 검찰 입장에서는 나름대로 해명의 기회를 준다고 서면/방문 조사 얘기를 꺼냈는데 박근혜 대통령 측에서 이걸 냅다 차버렸죠. 그런데 사실 박 대통령이 점잖게 조사받을 수 있는 기회를 왜 차버렸을까, 그냥 뇌가 없어서 그랬을까? 그렇게 보지는 않습니다. 여기서 두번째 이유를 생각해볼 수 있습니다. 특검이죠. 국회에서 17일에 특검법안이 통과됩니다. 박 대통령이 유영하 변호사를 통해 검찰의 조사 거부의사를 밝힌 것이 16일로 하루 빠르긴 합니다만 대통령 측(이라고 쓰긴 하지만 전 그냥 김기춘이라고 생각합니다)이 하루 전날 특검이 통과될 줄도 몰랐다고 생각하진 않습니다. 박 대통령의 판단에 대해서 좋게 얘기하자면 어차피 특검이 발동되면 검찰조사를 아무리 성실하게 받았다고 한들 특검에서 재차 조사받는건 불가피한 일이니만큼 두 번 조사받느니 한 번 조사받겠다 하는 생각이었을겁니다. 안 좋게 얘기하자면 자기가 뽑아놓은 법무부 장관과 검찰총장조차도 믿지 못하는 무능하고 오만한 판단이었다 정도로 말할 수 있겠죠. 이제와서 궁예짓하는 것 같습니다만 특검법이 확실하게 통과된 시점부터 검찰 측이 초강수를 둘 것은 어느정도 예상된 일이라고 봅니다. 검찰에게는 박근혜 대통령에 대해 두가지 선택지가 있었다고 봅니다. 참고인 신분으로 두루뭉실하게 넘어가거나, 피의자 신분으로 강수를 두거나. 전자의 경우에는 검찰이 상당한 타격을 입게됩니다. 안그래도 검찰이 멀쩡히 수사하고 있는 사안에 대해서 여야 국민여론 할 것 없이 대놓고 특검을 요구하는 상황이 누구의 눈에도 전혀 이상하지 않을 정도로 검찰에 대한 신뢰가 땅에 떨어져 있는 상황인데, 지금 박근혜 대통령의 혐의에 대해 아무런 액션도 취하지 않는다면 현 정국에서 국민들의 비판도 피할 수 없고 앞으로 들어설 정권에서도 대대적인 인사교체를 포함하여 심하면 경찰과의 수사권 분할까지 생각해볼 수 있을 정도로 검찰에 상당부분 칼질이 가해질 것을 삼척동자도 알 수 있는 상황입니다. 이른바 검찰무용론이 본격적으로 대두되겠죠. 검찰로서는 본인들의 임명권자인 대통령에 대해서 서면/방문 조사의향을 내비추면서 나름 공조(?)의사를 밝혔습니다만 박 대통령 측의 '정무적 판단'으로 인해 이것이 틀어진 것도 박 대통령을 참고인 신분으로 유지하기 힘들었던 요인이라고 봅니다. 그리고 제가 검찰이 강수를 둔 무엇보다 중요한 이유로 생각하는 것은 박 대통령을 피의자로 입건하였을 때 오히려 검찰의 리스크가 적다는 점입니다. 위에도 언급했습니다만 사실 검찰이 대통령을 피의자로 입건했다 한들 지금부터 특검이 발동되는 시점까지 검찰이 실제로 박금혜 대통령에 대하여 할 수 있는 일은 사실상 아무것도 없습니다. 불소추특권 때문이죠. 그리고 특검법이 통과되면서 특검절차가 시작된 이상 특검에서 어떤 모양새로든 무언가 결론이 날 것이기 때문에, 혹시나 특검에서 박근혜 대통령의 혐의점에 대해 별로 큰 건수를 밝혀내지 못한다고 하면 그냥 그대로 사건은 종료되는 것이고 건수가 제대로 잡혀서 사방군데 칼날이 날라다니는 상황이 되면, 훗날 검찰이 '피의자 박근혜'에 대해 조사를 한다고 해도 특검이 해놓은 일을 추가로 보충하는 것 정도에서 끝날 가능성이 높습니다. 쉽게 말해서 지금 검찰의 박 대통령 피의자 입건은 생색은 검찰이 내고 실제 수사에 대한 부담은 (어차피 할 일이었기 때문에 부담이라고 하는 것이 이상하긴 합니다만) 특검이 모두 끌어안는 모양새라고 봅니다. 결국 검찰로서는 박 대통령을 피의자 신분으로 입건하는 것이 일을 순리대로 따름과 동시에 실익을 얻을 수 있는 방법이었다는거죠. 결국 박 대통령 측도 반대측도 이제와서는 특검에 모든 것을 올인할 수 밖에 없음 형국으로 접어들었는데 과연 이 특검을 누가 어떻게 맡아야되냐 하는 것이 차기 대통령으로 누가 적절한지보다 더 첨예한 의견대립이 있을 것이라고 생각합니다. 채동욱은 여권에서 반대하는 인물이라 어렵지 싶고 임수빈은 검찰출신인데다가 광우병 당시의 논란에서 자유롭지 않은 몸, 대법관 출신인 김지형, 박시환, 이홍훈 등은 자격은 충분합니다만 과연 사상 초유의 특검팀을 리드할 수 있는 실무적 능력이 되겠느냐는 의문이 제기되고 있는 모양새고.... 개인적으로는 출신성분과 실무적 능력까지 감안하자면 이광범이 가장 적절하다고 봅니다만(판사출신+내곡동 특검 경력) 변호사로서 가장 최근에 맡은 일이 바로 그 홍준표를 변호하는 일이라 여기서 태클이 걸릴 가능성도 있다고 생각합니다. 이처럼 복잡한 상황이라 여/야/국민 모두가 납득할 수 있는 특검 임명은 사실상 불가능하다고 생각하는데... 특검 임명과정에서 정치권이 얼마나 소모적인 싸움을 피할 수 있을지가 향후 탄핵 정국에서 중요한 분수령이 될 듯 합니다.
