펌입니다 [조립물] 갑-을 찾기의 시대정신과 사회적 논의의 퇴락 시민교육센터 이한 http://www.civiledu.org/1077 ------------------------------------------------------------------------------------ 최근에 논란이 되고 있는 사건이 하나 있다. 건물주인 연예인(리쌍)과 그 세입자(우장창창) 사이의 분쟁이다. 이 분쟁과 관련한 오늘날 우리 사회의 반응은 다음과 같다. 1) 기자들은 사실관계를 제대로 정리하지 않고 중구난방으로 인상 전달만 한다. 인상을 전달할 때 프레임은 갑-을 프레임이다. 2) 대중들은 중구난방으로 전달받은 인상에 기초하여 과연 그 갑이 진정한 갑(진정한 나쁜 강자)인지, 그 을이 진정한 을(진정한 착한 약자)인지를 파악하는 것을 제1의 원칙으로 삼는다. 만일 진정한 갑으로 파악된 사람이 있다면, 그 사람은 비난받는다. 자동적으로 을은 진정한 을이 된다. 만일 어떤 이가 진정한 갑이 아니라면, 그 사건에서 을은 진정한 을이 아니다. 그러므로 을이 어떤 주장을 한다면 이번에는 을이 을의 위장을 하고 갑질을 하는 것으로 비난받는다. 그리고 이러한 식의 반응이 거의 모든 사회적 쟁점과 관련해서 일어나기 때문에, 갈등의 공론화는 제도적 개선으로 이어지는 일이 드물다. 즉, 그 구체적 사건과 관련하여 갑, 을을 분류하고 비난을 어느 한쪽으로 퍼붓고 끝이다. 치워버린다. 이런 식의 제도 개선 지체의 가장 큰 책임은 언론에 있다. 오늘날 대다수 언론이 사회적 갈등의 공론화의 목적을 '갑-을 프레임 세우기와 개인적인 비난'으로 삼고 있는 것이다. 언론은 물론 변명을 할 것이다. 그러한 틀로 보도를 하지 않으면 사람들이 보지 않는다고. 그러나 이러한 변명은 타당하지 못하다. 왜냐하면 언론은 사람들이 관심 있어 하는 주제를 다루면서도 사실관계를 정확히 짚으며 제도적 개선책을 지적할 수 있는 여지가 있기 때문이다. 사실 이번 사건과 관련해서도 언론 보도는 핵심이 되는 사실관계조차 제대로 정리하지 못한다. 만일 기자가 사실과 사회적 쟁점을 설명하는 데 관심이 있다면 다음과 같은 점들은 전달했어야 했다. 1) 연예인이 건물을 샀다. 그 건물에서는 상가 세입자가 곱창집을 하고 있었다. 세입자는 4억에 상당하는 권리금과 인테리어비용을 투자하여 곱창집을 했다. 2) 연예인은 당시 재건축을 하면서 세입자의 계약갱신요구를 거절하고, 자신이 그 세입자가 점포를 운영하던 곳에서 자신의 사업을 하려 하였다. 당시의 법은 이러한 행위를 무제한 인정하고 있었다. 그리고 당시에 이 법에 대한 비판이 사회적으로 크게 제기되고 있었다. 3) 연예인은 당시 법이 어느 정도 불합리하다는 점을 감안하여 세입자가 초기에 권리금 및 인테리어비로 투자한 금액의 반 정도에 해당하는 1억8천만원을 세입자에게 주고 세입자의 점포를 그 지하로 옮기는 합의를 하였다. 4) 세입자는 지하점포를 2년간 운영하였다. 세입자는 법률지식의 부족으로 인하여 환산보증금(실제 보증금에다가 월세*100을 한 금액[상가건물임대차보호법시행령 제2조 참조])이 기준액인 4억원을 초과하기 때문에, 임차인과 임대인이 계약기간 만료 전에 아무 행동도 하지 않았을 때 적용되는 상가건물임대차보호법 제10조 제4항이 자신에게는 적용되지 않는다는 사실을 몰랐다. 그래서 내용증명을 보내서 계약갱신 요구를 하는 등의 행동을 하지 않고 있다가 기간만료로 계약이 종료되게 되었다. 5) 연예인으로서는 기간만료를 이유로 한 퇴거청구를 하여, 승소, 이를 강제집행하고 있다. (참고: 제10조(계약갱신 요구 등) ① 임대인은 임차인이 임대차기간이 만료되기 6개월 전부터 1개월 전까지 사이에 계약갱신을 요구할 경우 정당한 사유 없이 거절하지 못한다. 다만, 다음 각 호의 어느 하나의 경우에는 그러하지 아니하다. <개정 2013.8.13.> 1. 임차인이 3기의 차임액에 해당하는 금액에 이르도록 차임을 연체한 사실이 있는 경우 2. 임차인이 거짓이나 그 밖의 부정한 방법으로 임차한 경우 3. 서로 합의하여 임대인이 임차인에게 상당한 보상을 제공한 경우 4. 임차인이 임대인의 동의 없이 목적 건물의 전부 또는 일부를 전대(轉貸)한 경우 5. 임차인이 임차한 건물의 전부 또는 일부를 고의나 중대한 과실로 파손한 경우 6. 임차한 건물의 전부 또는 일부가 멸실되어 임대차의 목적을 달성하지 못할 경우 7. 임대인이 다음 각 목의 어느 하나에 해당하는 사유로 목적 건물의 전부 또는 대부분을 철거하거나 재건축하기 위하여 목적 건물의 점유를 회복할 필요가 있는 경우 가. 임대차계약 체결 당시 공사시기 및 소요기간 등을 포함한 철거 또는 재건축 계획을 임차인에게 구체적으로 고지하고 그 계획에 따르는 경우 나. 건물이 노후·훼손 또는 일부 멸실되는 등 안전사고의 우려가 있는 경우 다. 다른 법령에 따라 철거 또는 재건축이 이루어지는 경우 8. 그 밖에 임차인이 임차인으로서의 의무를 현저히 위반하거나 임대차를 계속하기 어려운 중대한 사유가 있는 경우 ② 임차인의 계약갱신요구권은 최초의 임대차기간을 포함한 전체 임대차기간이 5년을 초과하지 아니하는 범위에서만 행사할 수 있다. ③ 갱신되는 임대차는 전 임대차와 동일한 조건으로 다시 계약된 것으로 본다. 다만, 차임과 보증금은 제11조에 따른 범위에서 증감할 수 있다. ④ 임대인이 제1항의 기간 이내에 임차인에게 갱신 거절의 통지 또는 조건 변경의 통지를 하지 아니한 경우에는 그 기간이 만료된 때에 전 임대차와 동일한 조건으로 다시 임대차한 것으로 본다. 이 경우에 임대차의 존속기간은 1년으로 본다. <개정 2009.5.8.>) 그런데 법 제2조 제3항에 의하면 제10조 제1항만 서울에서는 환산보증금 4억 이상 세입자에게 적용되고 제10조 제4항은 적용이 안 된다. 제2조(적용범위) ① 이 법은 상가건물(제3조제1항에 따른 사업자등록의 대상이 되는 건물을 말한다)의 임대차(임대차 목적물의 주된 부분을 영업용으로 사용하는 경우를 포함한다)에 대하여 적용한다. 다만, 대통령령으로 정하는 보증금액을 초과하는 임대차에 대하여는 그러하지 아니하다. ② 제1항 단서에 따른 보증금액을 정할 때에는 해당 지역의 경제 여건 및 임대차 목적물의 규모 등을 고려하여 지역별로 구분하여 규정하되, 보증금 외에 차임이 있는 경우에는 그 차임액에 「은행법」에 따른 은행의 대출금리 등을 고려하여 대통령령으로 정하는 비율을 곱하여 환산한 금액을 포함하여야 한다. <개정 2010.5.17.> ③ 제1항 단서에도 불구하고 제3조, 제10조제1항, 제2항, 제3항 본문, 제10조의2부터 제10조의8까지의 규정 및 제19조는 제1항 단서에 따른 보증금액을 초과하는 임대차에 대하여도 적용한다. <신설 2013.8.13., 2015.5.13.> [전문개정 2009.1.30.]) 이 사안에서는 진정한 나쁜 강자와 진정한 착한 약자가 드러나지 않는다. 그래서 대부분의 사람들은 세입자가 을을 위장한 갑질(요새는 이를 '을질'이라 부른다)을 하고 있다고 대부분 비난한다. 그리고 이 사안에 대한 고민은 끝이다. 나쁜 강자-무고한 약자의 구도를 드러내는 것은, 제도가 미비할 때 일부 사건이라도 공정성의 원칙에 맞게 사안을 해결하고, 또 제도 자체를 개선하는 것에 도움이 되기도 한다. 즉, 지금의 제도가 무고한 약자가 강자의 자의에 의해 휘둘리는 것의 문제를 드러내게 되는 것이다. 그러나 이제 우리 사회의 시대정신은 그러한 '계기'가 되는 구도를, 그 자체가 목적이 되도록 만들어버렸다. 사람들은 사건마다 갑과 을을 찾아내어 갑을 맹비난하는 것 자체를 목적으로 삼게 되었다. 그러므로 사안에서 맹비난할 갑이 보이지 않으면 그 사안을 공론화한 을을 비난하게 된다. 그러나 언론이라면, 이 사안의 조각그림을 보여주면서 누가 과연 진정한 갑이고 을일까를 발견하는 놀이에 한 소리를 보탤 것이 아니라, 제도의 불비에 관하여 지적하는 계기로 삼았어야 했을 것이다. 사실, 이 사안은 상가임대차보호법의 변화와 역사를 같이 하는 것이다. 이 사안이 문제되는 기간 동안 시간이 흐르면서 두 가지 변화가 있었는데, 1) 예전에는 재건축을 하기로 결심만 하면, 임차인은 갱신 없이 건물에서 나가야 했다. 오늘날에는 재건축의 이유 자체가 안전이어야 한다. (참고: 2012년 당시 상가건물 임대차보호법[법률 제9649호, 2009.5.8, 일부개정] 제10조 제1항 (임대인은 임차인이 임대차기간이 만료되기 6개월 전부터 1개월 전까지 사이에 계약갱신을 요구할 경우 정당한 사유 없이 거절하지 못한다. 다만, 다음 각 호의 어느 하나의 경우에는 그러하지 아니하다.)의 제7호는 건물을 재건축한다고 건물주가 결심하기만 하면 계약갱신을 언제라도 거절할 수 있었다. 7. 임대인이 목적 건물의 전부 또는 대부분을 철거하거나 재건축하기 위하여 목적 건물의 점유를 회복할 필요가 있는 경우 이후에 이 부분은 안전을 이유로만 가능하도록 개정되었다. (참고: 상가건물 임대차보호법[법률 제12042호, 2013.8.13, 일부개정] 제10조 제7호 7. 임대인이 다음 각 목의 어느 하나에 해당하는 사유로 목적 건물의 전부 또는 대부분을 철거하거나 재건축하기 위하여 목적 건물의 점유를 회복할 필요가 있는 경우 가. 임대차계약 체결 당시 공사시기 및 소요기간 등을 포함한 철거 또는 재건축 계획을 임차인에게 구체적으로 고지하고 그 계획에 따르는 경우 나. 건물이 노후·훼손 또는 일부 멸실되는 등 안전사고의 우려가 있는 경우 다. 다른 법령에 따라 철거 또는 재건축이 이루어지는 경우) 2) 예전에는 건물주가 권리금을 전혀 주지 않고 세입자가 권리금을 낼 다음 신규세입자를 구해와도 그 신규세입자와의 계약 체결을 거절하고는 세입자를 내보낸 뒤, 자신이 직접 영업을 하여 세입자가 구축한 영업이익의 기초를 활용하여도 아무런 법적 제재가 없었다. 오늘날에는 그러한 행위를 하면 권리금 상당액을 손해배상금으로 내야 한다. (참고: 제10조의4(권리금 회수기회 보호 등) ① 임대인은 임대차기간이 끝나기 3개월 전부터 임대차 종료 시까지 다음 각 호의 어느 하나에 해당하는 행위를 함으로써 권리금 계약에 따라 임차인이 주선한 신규임차인이 되려는 자로부터 권리금을 지급받는 것을 방해하여서는 아니 된다. 다만, 제10조제1항 각 호의 어느 하나에 해당하는 사유가 있는 경우에는 그러하지 아니하다. 1. 임차인이 주선한 신규임차인이 되려는 자에게 권리금을 요구하거나 임차인이 주선한 신규임차인이 되려는 자로부터 권리금을 수수하는 행위 2. 임차인이 주선한 신규임차인이 되려는 자로 하여금 임차인에게 권리금을 지급하지 못하게 하는 행위 3. 임차인이 주선한 신규임차인이 되려는 자에게 상가건물에 관한 조세, 공과금, 주변 상가건물의 차임 및 보증금, 그 밖의 부담에 따른 금액에 비추어 현저히 고액의 차임과 보증금을 요구하는 행위 4. 그 밖에 정당한 사유 없이 임대인이 임차인이 주선한 신규임차인이 되려는 자와 임대차계약의 체결을 거절하는 행위 ② 다음 각 호의 어느 하나에 해당하는 경우에는 제1항제4호의 정당한 사유가 있는 것으로 본다. 1. 임차인이 주선한 신규임차인이 되려는 자가 보증금 또는 차임을 지급할 자력이 없는 경우 2. 임차인이 주선한 신규임차인이 되려는 자가 임차인으로서의 의무를 위반할 우려가 있거나 그 밖에 임대차를 유지하기 어려운 상당한 사유가 있는 경우 3. 임대차 목적물인 상가건물을 1년 6개월 이상 영리목적으로 사용하지 아니한 경우 4. 임대인이 선택한 신규임차인이 임차인과 권리금 계약을 체결하고 그 권리금을 지급한 경우 ③ 임대인이 제1항을 위반하여 임차인에게 손해를 발생하게 한 때에는 그 손해를 배상할 책임이 있다. 이 경우 그 손해배상액은 신규임차인이 임차인에게 지급하기로 한 권리금과 임대차 종료 당시의 권리금 중 낮은 금액을 넘지 못한다. ④ 제3항에 따라 임대인에게 손해배상을 청구할 권리는 임대차가 종료한 날부터 3년 이내에 행사하지 아니하면 시효의 완성으로 소멸한다. ⑤ 임차인은 임대인에게 임차인이 주선한 신규임차인이 되려는 자의 보증금 및 차임을 지급할 자력 또는 그 밖에 임차인으로서의 의무를 이행할 의사 및 능력에 관하여 자신이 알고 있는 정보를 제공하여야 한다.) 이런 타당한 변화들은, 모두 상가건물임대차와 관련된 법적 분쟁이 공론화되었기 때문에 일어난 것이었다. 그리고 이 사안에서 문제가 되는 것 중에는 아직도 개선이 필요한 것이 있다. 그 중 두드러지는 것 중 하나가, 상가건물임대차보호법의 중요한 조항들을 적용받는 기준을 환산보증금 액수로 정하는 부분이다. 현재 서울에서 환산보증금이 4억원이 넘는 경우도 상당하다. 보증금 자체가 아니라 환산 보증금을 기준으로 4억이기 때문에 영업이익이 크지만 지대도 비싼 곳에서는 4억을 쉽게 넘길 수 있는 것이다. 그럼에도 불구하고 4억이냐 아니냐의 획일적인 기준으로 어리석은 갑-을 찾기 사고가 법에 반영된 것이다. 환산보증금이 좀 되면, 보호받아야 할 을이라고 볼 수 없으므로 보호를 안해주겠다는 식이다. 그러나, 갑이냐 을이냐가 중요한 것이 아니라, 공평의 견지에서 문제를 해결하는 것이 중요하다. 환산보증금이 대통령이 임의로 정한 금액을 초과한다고 해서, 이미 투자한 금액을 회수할 기간을 어리버리하다가 박탈당해도 좋다는 결론은 나오지 않기 때문이다. 즉, 상가건물임대차보호법의 모든 조항을 모든 상가임대차에 적용해야 한다. 그러나 입법자는 이 문제에 관심이 별로 없고 굼뜨다. 그러므로 언론이 이런 문제들을 공론화해야 한다. 상가건물임대차보호법은 제10조 제4항을 보증금이 기준환산보증금액을 넘는 경우에는 적용하지 않는다. 그러면서 제1항은 적용한다. 그러니까 임차인과 임대인이 둘 다 아무 행동하지 않을 때는 자동 갱신은 안하고, 꼭 요구할 때는 갱신시켜주겠다는 것이다. 왜 그래야 하나? 그런 점들에 대해 고민을 해봐야 한다. 둘째로, 권리금을 회수할 수 있는 기회가 건물주가 재건축을 할 경우에는 여전히 원천봉쇄되고 있다. 그러나 건물 재건축은 건물주의 소관사항이므로, 이 재건축 때문에 책임 없는 임차인이 손해를 보는 것은 공평의 관념에 타당하지 않다. 안전이 우려될 정도로 노후화된 건물이라면 임차를 해서는 안된다. 그리고 안전검사를 매년 하는 것은 건물주의 책임 사항이다. 안전검사를 제대로 안하고 임대를 한 뒤, 임차인이 거액을 투자하게 한 뒤에야 안전을 문제삼으면서 재건축을 하여 내보내는 것은 타당하지 않다. 즉, 안전검사를 매년 하게 되면, 재건축 시기를 미리 알 수 있고, 이것을 임차계약에 반영할 수 있다. 따라서 그러지 못한 것은 일정 부분 건물주의 책임으로 비용을 돌려야(즉 5년이 채 되지 않았는데-자연재해로 인한 안전 문제의 급작스러운 변동이 아니라-건물주의 안전검사의 소홀함으로 인해 5년 도중에 재건축으로 세입자를 내보내게 하면 권리금과 인테리어 비용을 일할 계산하여 일정 부분 보상을 하도록 규정해야), 재건축을 명목으로 함부로 계약갱신을 거절하지 못하게 된다. 이와 연관된 것은, 안전을 이유로 한 재건축 필요성의 판정을 공신력 있는 제3자인 공공기관이 하여야 한다는 것이다. 지금은 그 요건의 충족이 건물주에 의해 일차적으로 판단되도록 하고 있다. 그러나 이렇게 되면 임차인은 법률분쟁화 되고 나서야 법원에 기댈 수밖에 없다. 그러므로 안전을 담당하는 행정관청이 재건축 필요성을 판정하게 하고, 이러한 행정관청이 인정하지 않은 안전 사유로 인한 재건축은 건물주가 계약서를 통해서 세입자와 합의하도록 해야 한다. 이렇게 되면 세입자는 처음 들어올 때부터 사정을 알고 약간의 투자만을 하게 될 여지를 가진다. 그리고 이미 들어와 있는 세입자는 그런 합의 없이 계약 갱신을 요구할 수 있게 되므로 또한 보호받는다. 셋째로, 개정 상가건물임대차보호법은 권리금의 문제를 법 안으로 인정해 들어오기는 했지만, 이 문제를 해소하는 방향으로 유도하고 있지 않다. 권리금이라는 제도는 합리적이며, 계속 유지되어야 할 제도인가? 이 질문에 대해서 '아니오'라는 답변을 수십년 동안 해오면서 한국 사회는 건물주의 횡포를 극단적으로 인정하는 법질서를 유지하였다. 즉 건물주는 바닥 권리금을 받거나, 권리금을 회수하기에 턱없이 부족한 기간을 임대하다가 자신이 스스로 그 업종을 운영하기 위해서 재건축을 명목으로 임대차를 중단하거나 했다. 그렇다고 이 질문에 대해서 '예'라는 답변을 할 수도 없다. 왜냐하면 권리금은 일종의 폭탄돌리기이기 때문이다. 권리금은 결국에는 누군가의 차례에서 터진다. 즉, 그들은 재건축을 한다고 해서 쫓겨나거나, 5년이 끝난 뒤의 임대료 상승을 못이겨 쫓겨나거나, 아니면 장사가 잘 되지 않아 임차료 지급이 3기 이상 밀려서 쫓겨나거나 하는 등 수많은 이유로 권리금을 받지 못하게 된다. 그런데 장사가 잘 된 임차인은 장사로 돈도 많이 벌고 권리금까지 받고 나가고, 장사가 안 된 임차인은 장사까지 안 된데다가 권리금까지 회수못하는 그런 극심한 불평등이 나타나는 것이다. 많은 이들은 권리금 제도가 건물주와 상인이 그 상가의 가치 상승을 나누어 갖는 방식이라고 말한다. 그러나 상가의 가치 상승은 상인으로서는 장사가 잘 되는 상태에서 계속 장사를 하여 돈을 버는 것으로, 건물주는 적당한 임대료 상승을 통해 그 과실을 나누어 가는 것으로 해야지, 권리금이라는 제도를 도입하여 폭탄을 만들어낼 필요가 없는 것이다. 그렇다면 권리금을 소멸시키기 위한 유도책이 있어야 한다. 그 유도책은 바로, 임대차 갱신을 10년까지 한 경우에는 권리금을 소멸시킬 수 있도록 하는 조항을 도입하는 것이다. 상가건물임대차보호법 시행령 제4조는 (차임 등 증액청구의 기준) "법 제11조제1항의 규정에 의한 차임 또는 보증금의 증액청구는 청구당시의 차임 또는 보증금의 100분의 9의 금액을 초과하지 못한다"고 하고 있다. 즉 10년 동안 최대 매 갱신마다 100분의 9 이하의 금액으로 인상만 했던 임대차관계에서는, 나가는 사람은 새로 들어오는 사람에게 권리금을 받지 못하도록 하는 것이다. 건물주로서는 권리금을 소멸시키기 위해 안정적인 장기간의 임대를 보장할 유인이 생기고, 임차인으로서는 장사를 잘 해서 권리금보다 훨씬 많은 수익을 올릴 유인이 생기는 것이다. 권리금이 없는 상태에서 5년을 임차하는 것은 해볼만한 투자다. 그러나 수억대의 권리금을 주고 나면 5년 임차로는 그 회수는 사실상 어렵다고 보아야 한다. 그렇다면 이러한 권리금을 장기적으로 소멸시키기 위해 장기임대차 제도를 존속시키는 것이 중요하다. 사실 많은 건물주와 임차인의 관계는 공생관계라 할 수 있다. 건물주들이 가장 우려하는 것은 공실이 발생하는 것이며, 제때 임차료를 받지 못하는 것이다. 대부분의 건물주들은 장사를 잘 하고 임대료를 제때 내는 임차인을 쫓아내는 데 관심이 없다. 그렇기 때문에 일반적으로 둘의 관계를 적대적 관계로 틀지워서 누가 진정한 갑이며 과연 저 사람은 진정한 을인가를 따지는 것은 사태를 해결하기 위한 생산적인 방향을 잡지 못하게 된다. 이러한 문제들이 중요한 문제들이며, 언론이 다루어야 하는 문제다. 이러한 문제는 어느 쪽을 갑-을로 잡고 사회윤리적 비난을 가하느냐의 관점에서 풀 수 있는 것이 아니라, 사회적 협동과 조정의 관점에서 합리적인 갈등 해결을 모색해야 풀 수 있는 것이다. 사실, 상가건물임대차보호법 뿐만 아니라, 많은 사회정책적 문제들을 어느 일부 구성원을 비난하는 문제로 다 환원해서 거기서 자족하는 분위기가 오늘날 일반적이다. 즉, 오늘날 갑-을 찾기 놀이가 사회 체계의 개선을 대신하고 있는 것이다. 이러한 시대 정신은 크나큰 문제이다. 수많은 공론화와 비난이 이루어져도, 남는 것은 누가 비난받을 사람이었느냐의 목록의 축적 뿐이며, 제도는 개선되지 않는다. 이것은 우리 사회의 사회적 논의가 퇴락했다는 것을 보여준다. 2000년대 초반까지만 하여도 사회적 논의는 항상 일반적인 질서의 개선을 겨냥하고 있었다. 그러나 정치적 무력감의 시절을 겪은 대중은, 자신이 손쉽게 권력을 발휘할 수 있는 분야, 즉 누군가를 낙인찍고 매장하고 배척하는 말을 집중적으로 할 수 있는 그러한 행위 분야에만 정신을 집중시키게 되었다. 그리고 다수의 언론은 거기에 편승하여 진중한 모든 논의를 도외시하고 있다. 이것이 바로 갑-을 찾기의 시대정신(Zeitgeist)으로 인해 사회적 논의가 퇴락한 결과다. <끝> ----------------------------------------------------------------------------------------------------------------------------------- 개인적으로 말로 제대로 정리하지 못한 부분을 명쾌하게 정리해 준 글이라 퍼왔습니다. 언제나 믿고 읽는 이한선생님.. 예전의 반지성주의 관련 이야기와 더불어 맥락이 이어진다는 느낌도 들고 그랬습니다. 진보정당에 있는 후배, 진보적인후배, 보수적인 후배 둘과 만나서 이와 관련된 이야기를 했었는데, 법적안정성vs약자의 실질적 권리보장이 주된 논거로 흐르더라고요. 재밌는 이야기였지만, 결국 법을 바꾼다는건 법적안정성을 부정할만큼 사람들의 인식이 나아간 지점이 있어야 할텐데 본문이 그 한계를 잘 지적한거같아요. 최악은 아닌 건물주와 인간적으로 좀 까탈스럽게 느껴지는 세입자에게 몰입하는건 개인의 삶에 있어서 겪어온 어떤 부조리나 갈등들이 백프로 완전하게 해결되는 경우가 거의 없어서 그런거같기도하고요. 다들 똥물을 씹어먹고 사는데(정도는 다르지만) 너만 왜 그렇게 진상이야. 라는게 여론에게 느껴지는 저의 인상평.. 입니다. 여튼 이 문제에 대해 이야기가 전혀 없어서 가져와보고 싶었어요. 자영업하시는 분들도 더러 계시고. 사실 경제층위로보면 여기서 주로 활동하시는 분들은 꽤 괜찮은 분들이기도 한 느낌이라 비슷한 이슈를 겪으실 분들도 있으실거같아서요. 의견들 읽고싶으니 많이 달아주세요. 거기에 건물주가 충분한 기간을 주었음에도 퇴거하지 않고 있다는 점에서 마치 조폭에게 건물을 불법 점유당해서 골머리를 앓는 건물주가 되어버린 리쌍이 되어버렸습니다.
상가임대차에서 임대인과 임차인의 관계는 생각보다 일방적인 관계가 아닙니다.

물론 임차인들의 노력에 의한 성과라고 볼 수도 있지만, 실 소유주의 동의 없이 그리고 실소유주가 알지 못하는 금전거래가 과연 정당한가 하는 문제도 있구요.
과거 고성장시대에는 남의 건물을 빌려서 예식장을 한다고 열심히 인테리어 한 후 장사가 되지 않으면 건물주에게 시설권리금을 달라고 소송을 하기도 했는데,
이것을 악용해서 인테리어 비용을 뻥튀기해서 건물주에게 자신의 손해를 모두 전가하기도 했지요.
무언가 다른 곳으로 이야기가 간 것 같은데....
이 사건은 단순히 강자와 약자의 문제가 아니라 법에 명시된 사안에 대해서 충분히 인지할 수 있는 시간과 여건이 되었음에도 불구하고 나몰라라 하는 사람이 문제이지요.
