은 바로 집주인이 신규 세입자의 보증금을 받아야지만 기존 세입자의 보증금을 반환할 수 있다는 논리로, 신규 세입자 유치를 위한 "집을 보여주는 협조를 당연한 것처럼 요구"하는 것입니다. 즉 임대인(집주인)이 보증금 반환을 위한 자금조달(신규 세입자가 내는 보증금)의 '부담'을 임차인(기존 세입자)에게 일부 넘긴다는 것이죠. 월세의 경우 공실기간을 최소화 하려는 (금전적 이익 최대화) 목적을 위해 기존 세입자에게 비용을 지불하라는 것이기도 하고요. 저는 미국생활 10년이 넘어가면서 제1준거집단, 제1소속집단 둘 다 한국이 아니라고 생각하기 때문에 좋다나쁘다 가치평가할 의도는 없습니다만, 신선한 문화충격이었습니다. 집 비밀번호를 미리 받아서 부재중에도 방문하겠다고 요구하는 것은 특히 큰 충격이었네요. 일단 뉴욕 기준으로 절대 있을 수 없는 일이라 신기하게 느껴집니다. 저도 월세 계약 경험 4~5회 이상이고 미국인 친구들, 직장동료들에게 물어보니 말도 안되는 소리라고...ㅎㅎ 미국 월세살이 기준에선 (전세 제도가 없긴 하지만) 집 보여줄 의무가 없는건 당연한 거고, 집을 보여주는 이벤트 자체가 논센스입니다. 아무튼 인터넷 조금 찾아보니 한국에선 이 "요구"를 당연한 권리라고 여기는 사람도 많은 것 같고 나름 찬반이 갈리는 듯 합니다. 일단 제가 호기심에 파악한 바로는, 한국 법/판례 상 집을 보여줘야하는 법적인 의무는 명백하게 없는 것으로 보입니다. 계약 만료 시 보증금 반환이 제때 이루어지지 않으면 소송걸고 연20% 이자 붙여서 받을 수 있다고 하더라고요. 즉 보증금 반환 파이낸싱은 전적으로 임대인 책임인 것이죠. 물론 추가적인 시비가 걸리고 귀찮음이 야기될 수 있는 위험 vs 집 보여주기 싫음의 정도를 저울질 해야하는 문제가 있지만요. 부동산 재테크 시장이 새로운 세입자 없이는 기존 세입자 보증금을 못 주는 임대인이 굉장히 많은 형태로 굉장히 특이하게 발달하고 (사실 이것도 충격) 이에 따른 "관행"에 대한 인식도 갈리게 된 것 같습니다. 여러분들은 전, 월세 계약에서 "집을 보여주는 것"에 대해 어떻게 생각하시나요? 법적인 의무는 없지만 관행상 해줘야 하는 것, 비밀번호 알려주지 않아도 시간 조율해서 가능한한 협조해야하는 것, 싫으면 안해도 되는 것, 싫으면 안해도 되지만 더 개싸움날 확률을 고려해서 협조하는 편이 이득 -- 등등 어떤 의견들 가지고 계신지 궁금합니다!
