처음에는 우리나라 검찰이 수사권도 있는데 기소권도 독점하고 있어서 너무 강력한 권한이 있어서 문제다라고 해서 검찰의 막강한 권한을 나눠가져서 서로 견제하는 기관을 만드는지 알았습니다. 그런데 요즘 들리는 이야기 들어보면 공수처가 고위공직자를 제압할 수 있는 강력한 힘을 가진 검찰의 상위기관으로 작용할 수 있다는 이야기도 들리네요. 일단 말은 부패한 고위공무원을 수사할 수 있는 기관이라는데, 취지가 그래도 힘이 있으면 언제든지 나쁜놈이라고 죄를 뒤집어 씌워서 마음에 안 드는 정적 제거 할 수 있는 기관이 탄생하는거 아닌가 하는 염려도 들구요. 거기에 공수처장도 여야가 추천한 후보중에서 대통령이 임명한다던데, 그럼 대통령 권한이 너무 강해지는거 아닌가 싶기도 하구요. 개인적으로는 경찰총장 임명하는걸로 충분하고 다른 기관은 행정부 입김이 안 들어가도 되지않나 하는 생각이 듭니다. 제가 잘못이해한게 아니라면 지금 부패한 고위공무원들, 개혁해야 하는 검찰, 정경유착이 된 재벌, 언론들을 공수처라는 더 큰 힘으로 제압하겠다는 이야기 같은데 이게 민주주의의 방향이 맞는지 모르겠어요. 조금 오래걸리더라도 검찰의 힘을 쪼개서 천천히 풀어나가야지 상위기관을 만들고 거기에 행정부 입김까지 들어가는 기관이 굳이 필요한지 모르겠습니다. 악용될 소지가 너무 큰 것 같은데요. 대충 인터넷 여기저기서 들은 정보들이라서 잘못된 내용이 있으면 알려주세요. "수사, 기소하지 않을 수 있는 권력"를 검찰이 독점하고 있는 상황이 문제라는 인식에서 출발한 것 같습니다.
초월적인 상위 기관을 만들겠다는 게 아니라, 검찰이 눈 감아주더라도 수사/기소를 할 수 있는 보조장치를 마련하려는 목적이라고 봅니다.
부작용이나 우려되는 점이 있으나, 현재 제도보다는 좋아보입니다.
