아침에 소비자원에 전화할 예정인데 그 전에 조금이라도 최대한 알아두어야 제대로 된 응답 받을 수 있을 것 같아서요. 어제 13시에 24시 헬스장으로 간판이 되어있는 헬스장에 들어가서 한달 계약을 했습니다. 환불 규정은 안내받지 못하였고 회원 등록칸에 신상정보를 적고 나왔으며 언제부터 이용하실 생각이시냐는 질문에 내일(오늘) 새벽이라고 답변했습니다. 오늘 새벽 4시경 헬스장을 갔더니 24시간인줄 알았던 헬스장 문이 닫혀있어 당황해서 문을보니 오픈시간이 6시라고 되있길래 6시에 헬스장을 다시 찾아갔습니다. 그랬더니 계약했던 사람과 다시 이야기를 하라고 하며 그사람 출근시간인 오전 11시에 오라고 합니다. 환불에 대해 잠시 물어봤는데 위약금 10%와 부과세 10%를 공제한 후 환불해준다고 합니다. 검색으로 부과세 10%는 개소리라는것을 알아냈고 따지면 될 듯합니다. 다만 위약금 10%가 문제인데 이용개시전에 환불을 하는데도 위약금 10%을 공제하고 받는건가요? 결재는 체크카드로 하였습니다. 소비자분쟁해결기준 별표 2에 따르면 체육시설업 소비자의 귀책사유로 인한 계약해제의 경우 개시일(계약내용이 이용횟수로 정하여진 경우에는 최초이용일, 기간으로 정하여진 경우에는 기간이 시작되는 초일을 말함) 이전에는 [총이용금액의 10% 공제 후 환급], 이후에는 [취소일까지의 이용일수에 해당 하는 금액과 총이용금액의 10% 공제 후 환급]으로 되어있습니다. 그러니까 소비자의 변심으로 인한 계약해제시는 10% 공제가 맞습니다.
다만 \'제공된 물품 또는 용역이 계약내용과 다른 경우\' 같은 경우에 속할 수도 있지 않을까 싶기도 하네요. (이 경우에는 계약해제라고 되어있습니다.) 소비자원에 문의하시는게 맞는 것 같습니다.
