실거주 목적 소형 아파트를 한 채 계약을 진행중인데, 경험과 제반지식이 없다보니 고민이 깊어집니다. ㅠㅠ 홍차넷 여러분의 의견을 여쭤보고 싶어요. 전반적 상황은, 우선 잔금일은 확정하고로 하고 임차인 명도완료를 잔금일 전에 하는 것을 합의하고서 계약금의 일부를 송금하였습니다. 그런데, 임차인 명도가 불확실한 점이 있어 임차인 명도가 해결될 때까지 매도자가 계약서 작성을 미루고 있는 상황입니다. 정리하자면, 매도인은 명도조건을 늦추고, 명도 불이행시에 대비해 위약금을 걸고 싶어한다. 매수인 입장에서는 명도를 늦춰줄 수는 있지만, 명도가 불이행될 때에 대비해 얼마의 위약금을 걸고서 위 요구를 받는 것이 적정할까, 입니다. 민감한 부분이 있어서, 구체적인 내용은 수정하였습니다. 용어사용이 부적합한 부분이 있어도 양해를 구합니다.
