저는 아니고 제가 아는 동생(편의상 a라고 하겠습니다) 이야기입니다. a는 임관한 지 2년정도 된 초급장교입니다. 1년 후배인 b가 새로 전입을 왔는데 a의 보직 상 초임장교들을 관리할 일이 많다 보니 자주 마주치게 됐는데 b가 a와 다른 장교 c를 폭언/폭행으로 찌르게 됩니다. b는 c에게는 폭행을 당했으며 a에게는 세 차례 정도 폭언을 들었다라고 진술합니다. a, c는 부대에서 전출당하고 이후 헌병대 조사를 받게 됩니다. a는 b의 진술을 부인하고 평소에 가벼운 욕설을 한 건 사실이다 하지만 b가 주장하는 것처럼 나가 죽어라 쓸모없는 새끼야 등의 말은 안 했다 라고 주장합니다 헌병수사관은 조사 결과 c는 형사처벌 대상이며 a는 b가 합의해 준다면 형사로 넘어가진 않을 거라고 귀띔합니다. 형사로 넘어갈 경우 기소유예나 벌금이 나올 거라고 합니다 수사관의 연락 결과 b는 처음에는 합의해줄 생각이 없다 처벌을 원한다라고 합니다. 그래서 a(의무복무가 좀 깁니다)는 직접 연락을 하게 됩니다 b는 합의금으로 200만원을 주면 합의해 주겠다고 합니다. 제가 궁금한 것은 -합의를 안 해 주겠다고 하다가 200을 요구하는 것이 정당한가? -폭언에 대한 200의 금액은 적절한가? -a는 공탁을 하겠다고 하는데 여기서 a에게 최선의 방법은 무엇인가? 정도입니다. 법알못이라 뭐라고 말을 못해주겠네요.
