작년 16년 05월에 회사의 거래업체 사장님과 금전 거래를 하였습니다. (편의상 제가 다니던 회사를 H사, 거래처 사장님 회사를 C사로 하겠습니다.) 이유는 H사에서 회사 사정이 어렵다고 대금을 어음으로 발행해버렸다. C사 직원들 급여주기가 벅차서 그러니 여유 자금 있으면 빌려달라. 이런 연유로 총액 2천만원을 별려 주었고 (상세 내역은 PDF로 올렸습니다.) 현재까지 1,950만원 받았습니다. 50만원이 빕니다. C사 사장님 입장에서는 급해서 막 지른 말이겠지만, "다달이 이자 주겠다." "H사 사정 나아질 거라니 그 때 되서 어음말고 돈 받으면 바로 다 갚을게" "어음할인 받을 곳 구했으니 갚아줄게" 였는데, 기간이 생각보다 너무 길어져서 결국 제가 먼저 폭발하고 언쟁이 오갔습니다. 고소를 생각하여 경찰서에 들려보았는데, 증거도 부족하고, 제가 C사 사정을 인지하고 수취를 미뤘기에 사기 등의 혐의는 안되고, 법원에 소액심판청구를 권하더군요. 실질적으로 의미없는 금액이긴 하지만 괘씸해서.... 별도의 합의 없이 C사가 영업에관해서 돈을 빌린거라면 상법상 이자는 돈 갚기로 한 다음날부터 연6%입니다
처음부터 돈 빌려주며 언제갚기로했는지가 중요하네요 그날 기준으로 법정이자가 기산되니까요
그리고 중간에 돈을 갚으면 그때까지 이자에 먼저 충당되고 원금에 충당됩니다 큰돈이아니면 귀찮아서 그냥 남은 원금에 갚기로 한 다음날부터 법정이자를 계산하기도 해요
지급명령신청하시고 상대방이 이의하지않으면 집행하시고 소액소송절차로 넘어가시면 이제 법원출석하시면서 종결되고 확정되면 그 판결문으로 집행하세요
