저는 여자 연예인 중에서 송혜교를 가장 좋아합니다. 팬은 아니지만 외모가 제 취향이라서요;; 그런데 탈세 의혹이 일어서 고생 좀 하겠고, 인기가 훅 떨어지겠구나 싶었었죠. 문득 송혜교 나무위키를 보는데, 송혜교의 탈세에 대한 반박내용이 있더군요. 제가 요약하자면 아래와 같습니다. 그러니까 안 내야 할 세금이 부과된 것이 아니라 감면 사유가 처리가 안된거라 국가의 세금 부담 결정 자체는 법률적 근거에 의한 것으로 타당해 보입니다.( 별도로 국세청에 대하여 다툴 방법이 있었는지, 다퉜으면 받아들여질 사안인지는 구체적으로 검토하지는 못했습니다.)
이때, 세무사가 기장을 잘못 기재하여 의뢰인이 세금을 절세할 수 있었는데 그대로 납부하게 되었다면 세무사는 의뢰인에 대하여 채무불이행에 기한 손해배상책임을 부담합니다.
우리 대법원은 세무사의 이러한 서류 누락에 대한 손해배상책임을 상당히 폭넓게 인정하고 있고 판례에 따르면 송혜교씨는 국가에 세금은 내지만 세무사에게 금액 상당의 손해배상을 구할 수 있을 것 같습니다.
