이러한 종류의 '아래쪽' 권력을 상수로 인정하고 통치과정의 상궤로 받아들인 경우가 (다시 역사적인 예를 들자면) 황제 서거후 차기 황제를 제후들의 투표로 선출한 ㅅㅅ로마제국, 근세기 이후 잉글랜드의 의회, 요즘 대학들의 평교수회의, 한국 검찰의 평검사회의 따위를 들 수 있습니다.
그러므로 평검사회의는 해도 되고 총경회의는 하면 안 된다고 주장할 적에 그게 여태까지 그래왔다는, 그러니까 '관습' 이상의 근거를 제시하려면 평검사가 검찰 조직 안에서 일종의 하원의원의 역할을 하는 것이 타당한 반면 경찰 조직 안에서 총경이 그 역할을 해서는 안 되는 이유를 두 조직의 본질에서 찾아야 할 겁니다. 경찰이 맡은 업무 특성과 검찰이 맡은 업무 특성의 차이라든지 등등. 만약 그러한 본질적 차이를 지적하지 못하는 이가 계속해서 검사는 되고 경찰은 안된다고 주장한다면 그건 그냥 관습에 의거한 논증이다 뭐 이렇게 말할 수 있겠네요.
역사적으로보면 통치자의 교체시기 (사망 등으로)에 이 '아래쪽' 권력에서 발산하는 중력이 잘 관찰됩니다. 교황 서거후 콘클라베, (영국 등에서) 수상 사임후 집권당 의원들의 차기수상 투표, 당말 하북지방 세 절도사직의 승계에 개입한 번진의 병사들 등이 그렇습니다. 바꾸어말하면 통치자의 교체시기가 아닌데도 콘클라베가 열리고 (수상을 제외한) 집권당 의원들의 총회가 열린다면 교황이나 수상 입장에선 매우 즉각적이고 직접적인 위협을 느끼는 것이지요.
이러한 종류의 '아래쪽' 권력을 상수로 인정하고 통치과정의 상궤로 받아들인 경우가 (다시 역사적인 예를 들자면) 황제 서거후 차기 황제를 제후들의 투표로 선출한 ㅅㅅ로마제국, 근세기 이후 잉글랜드의 의회, 요즘 대학들의 평교수회의, 한국 검찰의 평검사회의 따위를 들 수 있습니다.
그러므로 평검사회의는 해도 되고 총경회의는 하면 안 된다고 주장할 적에 그게 여태까지 그래왔다는, 그러니까 '관습' 이상의 근거를 제시하려면 평검사가 검찰 조직 안에서 일종의 하원의원의 역할을 하는 것이 타당한 반면 경찰 조직 안에서 총경이 그 역할을 해서는 안 되는 이유를 두 조직의 본질에서 찾아야 할 겁니다. 경찰이 맡은 업무 특성과 검찰이 맡은 업무 특성의 차이라든지 등등. 만약 그러한 본질적 차이를 지적하지 못하는 이가 계속해서 검사는 되고 경찰은 안된다고 주장한다면 그건 그냥 관습에 의거한 논증이다 뭐 이렇게 말할 수 있겠네요.
