아마 요즘처럼 이 법률에 대한 관심이 뜨거울 때가 없을 겁니다. 약칭 북한이탈주민법. 법의 풀네임을 한번 봅시다. [북한이탈주민의 보호 및 정착지원에 관한 법률]입니다. -- 모든 법은 제1조에 '목적' 조항을 넣고 있습니다. 헌법에서 제37조2항 법률유보 얘기했죠? 까먹고 얘기안했는데 해당 조항은 '비례의 원칙' '과잉금지 원칙'도 같이 규정하고 있습니다. 워낙 중요한 조항이니까 다시 한번 복습합시다. '국민의 모든 자유와 권리는 국가안전보장·질서유지·공공복리를 위해 필요한 경우에 한해 법률로 제한할 수 있으며, 그 경우에도 자유와 권리의 본질적인 내용은 침해할 수 없다' 여기서 '모든 자유와 권리는 ~ 법률로 제한할 수 있다'가 '법률'로 해야한다는 법률유보이고 '국가안전보장·질서유지·공공복리를 위해 필요한 경우에 한해~ 자유와 권리의 본질적인 내용은 침해할 수 없다'가 비례의 원칙, 과잉금지 원칙입니다. 아 이거 원칙 2개 아니고 같은거에요. 하나의 원칙인데 이름이 두개인거. 이 비례의 원칙/과잉금지 원칙을 어기지 않으려면 ①목적의 정당성 ②방법의 적절성 ③피해의 최소성 ④법익의 균형성이라는 요건을 갖춰야 합니다. 자 그럼 법의 목적이 뭔지 알아야 그 목적이 정당한지, 그 목적달성에 적합한 방법인지 알 수 있겠죠? 그래서 제1조에 법의 목적이 뭔지 밝히는 겁니다. 다시 북한이탈주민법으로 돌아가 봅시다. 제1조(목적) 이 법은 군사분계선 이북지역에서 벗어나 대한민국의 보호를 받으려는 군사분계선 이북지역의 주민이 정치, 경제, 사회, 문화 등 모든 생활 영역에서 신속히 적응ㆍ정착하는 데 필요한 보호 및 지원에 관한 사항을 규정함을 목적으로 한다. 예. 이 법은 북한이탈주민의 지위나 국적같은 걸 정하는 법이 아닙니다. 그냥 보호및 지원에 관한 사항을 규정하기 위한 법이고 보호 및 지원을 하는게 목적입니다. -- 제2조(정의) 이 법에서 사용하는 용어의 뜻은 다음과 같다. 1. "북한이탈주민"이란 군사분계선 이북지역(이하 "북한"이라 한다)에 주소, 직계가족, 배우자, 직장 등을 두고 있는 사람으로서 [북한을 벗어난 후 외국 국적을 취득하지 아니한 사람]을 말한다. 2. "보호대상자"란 [이 법에 따라 보호 및 지원을 받는 북한이탈주민]을 말한다. 제3조(적용범위) 이 법은 대한민국의 [보호를 받으려는 의사를 표시한 북한이탈주민]에 대하여 적용한다. '북한이탈주민'이 뭔지, '보호대상자'가 뭔지, 이 법의 적용대상이 누구인지 명시하고 있습니다. 자 그러면 조금 넘어가볼까요. -- 제8조(보호 결정 등) ① 통일부장관은 제7조제3항에 따른 통보를 받으면 협의회의 심의를 거쳐 보호 여부를 결정한다. 다만, 국가안전보장에 현저한 영향을 줄 우려가 있는 사람에 대하여는 국가정보원장이 그 보호 여부를 결정하고, 그 [결과를 지체 없이] 통일부장관과 [보호신청자에게 통보하거나 알려야 한다.] ② 제1항 본문에 따라 보호 여부를 결정한 통일부장관은 그 결과를 지체 없이 관련 중앙행정기관의 장을 거쳐 재외공관장등에게 통보하여야 하고, 통보를 받은 재외공관장등은 이를 [보호신청자에게 즉시 알려야 한다.] 행정청이 어떤 처분을 할 때는 당연한 일이지만, 그 결과를 신청자에게 통지해야 합니다. 인용이든, 기각이든 말이죠. -- 제9조(보호 결정의 기준) ① 제8조제1항 본문에 따라 보호 여부를 결정할 때 다음 각 호의 어느 하나에 해당하는 사람은 보호대상자로 결정하지 아니할 수 있다. <개정 2019. 1. 15.> 1. 항공기 납치, 마약거래, 테러, 집단살해 등 국제형사범죄자 2. 살인 등 중대한 비정치적 범죄자 3. 위장탈출 혐의자 4. 체류국(滯留國)에 10년 이상 생활 근거지를 두고 있는 사람 5. 국내 입국 후 3년이 지나서 보호신청한 사람 6. 그 밖에 보호대상자로 정하는 것이 부적당하다고 대통령령으로 정하는 사람 문제의 북한이탈주민법 제9조입니다. 제1항 2호에 따라 살인등 중대한 비정치적 범죄자는 보호대상자로 결정하지 않을 수 있죠. 보호대상자가 되지 않으면 어떻게 되죠? 이 법 1조로 돌아가 봅시다. '정치, 경제, 사회, 문화 등 모든 생활 영역에서 신속히 적응ㆍ정착하는 데 필요한 보호 및 지원'을 못받게 됩니다. 북한이탈주민이 아니게 되는 것도 아니고, 국내체류자격을 상실하는 것도 아닙니다. 애초에 이 법은 그런걸 규율하는 법률이 아니에요. 자, 이제 문제의 9조 제3항을 봅시다. ③ 통일부장관은 북한이탈주민으로서 [제1항 각 호의 어느 하나에 해당하여 보호대상자로 결정되지 아니한 사람]에게는 필요한 경우 [다음 각 호의 어느 하나에 해당하는 보호 및 지원을 할 수 있다.] <개정 2014. 5. 28., 2017. 3. 21., 2019. 1. 15.> 1. 제11조ㆍ제13조ㆍ제14조ㆍ제16조ㆍ제17조의3ㆍ제19조ㆍ제19조의2ㆍ제20조(이 조 제1항제4호 및 제5호에 해당하여 보호대상자로 결정되지 아니한 경우만 해당한다)ㆍ제22조 및 제26조의2에 따른 보호 및 특례 2. 그 밖에 사회정착에 필요하다고 대통령령으로 정하는 보호 및 지원 통일부장관이 뭐라고 했었지요? human, 미쳤습니까? 같은법 같은조 제1항을 가지고 보호대상자가 아니니까 내보낼 수 있다는 말이 장관입에서 나온게 True? 바로 밑에 밑에 줄에 있는 제3항에 명시적으로 나오죠. [1항 각호에 해당하여 보호대상자로 결정되지 않은 사람]에 대해서도 보호 및 지원을 할 수 있습니다. 1호는 짜잘한 열거규정이니까 생략하고 2호를 보죠. [그 밖에 사회정착에 필요하다고 정하는 보호 및 지원] 제9조 제1항에 의해 보호대상자가 아닌 북한이탈주민이라 해도, 이 사회에 정착하게 되는 겁니다. 그런 북한이탈주민에 대해서도, [통일부장관]은 사회정착에 필요한 보호 및 지원을 할 수 있단 말입니다. 보호대상 아니라서 내쫓을 거면 이런 조항이 왜 있습니까? 강제북송과 관련해서 북한이탈주민법 제9조 입에 올리지 마세요. 입에 올리려면 법의 풀네임이 뭔지, 제3항이 뭔지 정도는 알고 얘기합시다. -- 이하 여러가지 지원방안이 있죠. 조문 제목만 휙휙 볼까요. 학력 인정, 자격 인정, 사회적응교육, 직업훈련, 취업보호 등등 조금 재미있는 19조, 19조의2 19조의 3을 봅시다. 제19조(가족관계 등록 창설의 특례) ① 통일부장관은 보호대상자로서 군사분계선 이남지역(이하 "남한"이라 한다)에 가족관계 등록이 되어 있지 아니한 사람에 대하여는 본인의 의사에 따라 등록기준지를 정하여 서울가정법원에 가족관계 등록 창설허가 신청서를 제출하여야 한다. -가족관계등록부가 없는 국민은 가족관계등록창설허가 신청을 할 수 있죠. 그런데 여기서는 그런 신청을 보호대상자의 경우 통일부장관이 하도록 해놨습니다. 보호대상자가 아닌 북한이탈주민은? 직접 해야해요. 어? 근데 앞에 9조 3항 1호에 뭐라고 되어있죠? 네 19조에 따른 보호 및 특례를 지원할 수 있다고 되어있네요. 북한이탈주민이 직접해야하지만, 3항 1호에 따라 통일부장관도 할 수 있습니다. [하여야 한다]가 아닌 것이 보호대상자와의 차이입니다. 제19조의2(이혼의 특례) ① 제19조에 따라 가족관계 등록을 창설한 사람 중 북한에 배우자를 둔 사람은 그 배우자가 남한에 거주하는지 불명확한 경우 이혼을 청구할 수 있다. ② 제19조에 따라 가족관계 등록을 창설한 사람의 가족관계등록부에 배우자로 기록된 사람은 재판상 이혼의 당사자가 될 수 있다. ③ 제1항에 따라 이혼을 청구하려는 사람은 배우자가 보호대상자에 해당하지 아니함을 증명하는 통일부장관의 서면을 첨부하여 서울가정법원에 재판상 이혼청구를 하여야 한다. 재미있죠. 제19조의 2는 북한이탈주민의 이혼청구를 규정하고 있습니다. 우리 민법상 이혼을 하려면 재판상 이혼사유가 필요하죠. 배우자의 부정행위, 악의의 유기, 배우자/배우자의 부모로부터 부당한 대우 등등. 그런데 북한에 배우자를 두고 온 북한이탈주민은 그런 걸 입증할 수 없잖아요. 입증을 떠나서 사유가 없을 수도 있고. 이혼하고 싶어져서 탈북한 건 아닐테니까.. 사실 북한에 배우자 두고 왔으니 '악의의 유기'는 오히려 이쪽이 유책배우자일 겁니다. 그런데 그렇다고 북한에 배우자 있으니 남한에서 수절하라고 할 수도 없죠? 그래서 특이하게 북한이탈주민법 제19조의 2가 [이혼청구권]을 규정하고 있는 겁니다. 민법상 재판상 이혼사유 없이, [북한이탈주민법상 이혼사유]를 가지고 재판상 이혼을 하는 거에요. 나는 남한에 있는데 배우자는 북한에 있습니다. 배우자도 탈북했는데 사바사바 이혼하려는거 아니에요? 아닙니다. [배우자가 보호대상자에 해당하지 아니함을 증명하는 통일부장관의 서면]을 증거로 제출합니다. 라는 독립적인 이혼사유가 됩니다. 제19조의3(주민등록번호 정정의 특례) ① 북한이탈주민 중 정착지원시설의 소재지를 기준으로 하여 주민등록번호를 부여받은 사람은 거주지의 시장ㆍ군수ㆍ구청장 또는 특별자치도지사에게 자신의 주민등록번호 정정을 한 번만 신청할 수 있다. 이것도 재미있지요. 일단 주민등록번호를 부여받은 이후에도, 등록번호 정정의 기회를 한번 주는 겁니다. 왜 그럴까요? 아시는 분들 많겠지만, 우리 주민번호에는 우리의 출신지역이 담겨져 있습니다. 가족들 주민번호 뒷자리는 비슷하죠? 그게 지역번호가 있어서 그래요. 그럼..필연적으로 탈북자들의 주민번호는 전부 비슷해집니다. 그럼 주민번호를 보고 이사람이 탈북자구나 하고 눈치챌 수 있어지잖아요. 그런 차별을 피하기 위해서, 주민번호를 바꿀 기회를 주는겁니다. 그리고 눈치빠른 분들은 아셨을텐데, 이 주민등록번호 정정의 특례의 적용대상은? [북한이탈주민]입니다.
