범죄를 저지른 사람에게 합의금 요구는 당연하다 는 것은 우리에게는 너무나 자명하여, 그야말로 사법불신의 사회에서 유일한 절대진리라 할 만합니다. 합의금이 우리를 구원한다. 너의 사과는 돈이 증명한다. 그것이 금융치료. 아예 우리 검찰에는 형사조정위원회라는 것이 있어서, 기소는 되었으나 합의로 해결 볼 수 있을 것 같은 사건을 삼자대면 하에 화해절차를 밟아주기까지 합니다. 피고인은 빨간 줄 안그어져 좋아, 고소인은 합의금 받아 좋아, 검찰은 일 줄어서 좋아. 모두가 좋아 아이 좋아. 하지만 그런 모습은 실상 유니콘에 가깝습니다. 일단 형사합의금은 싯가입니다. 터무니없는 금액을 제시해도 그 자체로는 문제가 없습니다. 피해액을 회복하는 것이 아니라 처벌을 받지 않음 혹은 감면을 목적으로 피해자에게 딜을 치는 것이 형사합의의 목적이므로 정해진 값이 없는 겁니다.(물론 요구하는 정황이 어떤가에 따라 공갈이나 협박이 성립할 여지는 있음) 예를 들어 작은 범죄여도 사회 저명인사거나 고위 공직자여서 기소로 훼손될 사회경제적 지위가 크면 높게 제시할만 하고, 큰 범죄여도 가해측의 재산이나 명예가 별 것 없으면 없는 것보단 나은 합의금을 겨우 받고 주변에서 아니 겨우 그걸로 합의를 해줘? 라는 소리를 듣게 되기도 하지요. 그래서 실은 소위 깽값이란 것을 받기는 쉽지 않습니다. 형사소추의 리스크를 아는 사람에게 범죄를 당해야 돈 나올 구석이 있는데, 그걸 알면 애초에 범죄를 안 저지르겠죠. 형사합의의 두번째 문제는, 기소 이전 '고소하지 않는 것을 댓가로 한 합의'입니다. 어떤 범죄는 입증이 난해해서, 고소를 받아주는 것만으로는 기소가 된다는 보장이 없습니다. 모욕죄나 성추행 등등이 그렇죠. 또는 앞서 말한 기소 자체가 불이익으로 이어지는 상황이거나요. 따라서 이런 건은 뭔가 건수만 잡으면, 무차별 고소 내지 고소 위협으로 겁먹은 일부에게서 합의금을 받아내는 것이 너무나 합리적입니다. 판결 이전에 기소 또는 경찰 출석단계부터 불이익이 생기는 상황도 많으니까요. 저는 엄벌주의, 형량 강화의 목소리가 높아지고 있는 이 시점에 사건 당사자 간의 형사합의를 부정하는 것이 사법불신의 한 타개책이 될 수 있다고 봅니다. 예상보다 형량이 적게 나온 어떤 판결 기사에 '당사자 간 합의를 한 상황을 고려했다' '반성문을 제출했고 범죄 전력이 없음을 고려했다' 이 두 문장이 같이 있으면 '반성했다고 감형 ㅋㅋㅋ' 소리가 튀어나옵니다. 그런 건 따위로 치부해버리더라도 가해자의, 또는 피해자의 요령이 금액 제시에 있어 너무 절대적입니다. 형사합의로 이득보는 것은 고지위/고소득자이거나 아예 하류인생이고 피해보는 것은 피해자 입장에선 합의금을 받기도 마땅치 않고 일상범죄로 가해자가 되면 싯가로 제시된 합의금과 범죄 이력 없는 평탄한 미래를 저울질 해야하는 서민들입니다. 전에도 겪은 바를 얘기했었죠. 잘못을 사과하고 치료비 등 민사적 배상을 하겠다는 데도 '아 그거 말고오'를 외치는 새끼를 보며 이게 나라냐 라는 생각이 안 들 수 있을까요? 또 더 전에는 자전거를 타고 가다 주차된 차에서 개문사고를 당한 적이 있었습니다. 상대는 책임보험밖에 없었다는데 저는 당시엔 책임보험이 뭔지 자동차 관련 법이 뭔지 지식이 하나도 없어서 오히려 제가 문짝 일부를 배상해 줬었습니다. 나중에 지식이 쌓이고 당시 제가 경찰에 피해 신고를 했으면 치료비에 형사합의금까지 뜯어낼 수 있었다는 생각에 닿자 머리를 쥐어 뜯었습니다. 그 사건 자체는 그럴수도 있지로 넘어가더라도 그 뒤에 내가 처한 상황이 억하심정이 아니 들 수 없으니까요. 폭행 두번 당했지만 합의고 뭐고 쥐뿔이고 없었습니다. 그래서 결론은, 사적 제재가 사법체계에 대한 도전이라면서 형사합의를 폭넓게 인정하는 것은 검찰 내지 법원의 직무유기라고 생각합니다. 형사합의는 성인의 30%가 전과자이며 동시에 형사소추의 리스크가 지대한 문화가 만들어낸 괴물 같은 제도라고 생각합니다. 현재 형사사건 체계에서 피해자는 중범죄가 아닌 한 배제되기 일쑤입니다. 가해자가 기소가 되었는지, 처분이나 재판 과정은 어떻게 되는지 피해자 자격으로 검찰이나 법원에 '직접' 출두하여 서류를 뗄 수는 있지만 수사 및 사법기관이 나서서 알려주지는 않습니다. 법이 정의를 말하려면 형사합의를 유도하고 인정함으로써 개인간의 문제로 짬처리하지 말고 피해자와 우리 사회에 법 체계가 엄정히 작동하고 있음을 확신케 해야 하지 않을까요.
