오늘 사무실에서 온종일 놀다 올 생각이었는데 대법원과 헌재가 죽어라고 일감을 던져줘서 짜증나는 하루였네요. 자문사에서 문의전화는 계속 오고, 제 차례도 아닌데 쓸데없이 판결 분석 역할 맡고.... 오전에 판례 나오고 나서 이래저래 기사가 뜨는데, 노동법 쪽 기사들은 각 언론의 정파성에 따라서 내용이 왜곡되는 경우가 많습니다. 별다른 의미 없는 판결인데 과대포장되는 경우도 있고, 꽤 중요한 판결이 조용히 묻고 지나가는 경우도 있고 그렇죠. 뭐 이번 판결은 중요하다면 중요하고, 아니라면 아니긴 한데, 왜 그런지 간략히 설명해보겠습니다. 1. 이번 판결이 의미를 가지는 지점 -. 오늘 대법원 판결이 의미있는 지점은, 특정한 기업에서 운영하는 임금피크제가 무효인지, 효력이 인정될 수 있는지 여부를 구분할 수 있는, 판단 기준을 처음 제시했다는 겁니다. -. 원래 고령자고용촉진법은 연령을 이유로 한 차별을 금지하고 있고, 이 조문은 기간제 및 단시간근로자에 대한 차별을 금지하는 기간제법, 파견근로자에 대한 차별을 금지하는 파견법과 유사한 형태를 가지고 있습니다. 원칙적으로 나이를 이유로 차등대우하는 '차별'은 금지되지만, 그 차등대우에 합리적인 이유가 있다면 법 위반이 아니라는 거죠. 예를 들어서 정규직 신입직원에게는 연봉 5천을 주고, 별다른 이유 없이 기간제 직원에게 연봉 4천을 준다면 기간제법상 차별이 될 수 있습니다. 그런데 정규직 직원은 담당업무와 관계된 산업기사자격증을 가지고 있고, 기간제 직원은 그렇지 않다면, 이건 합리적인 이유가 있는 차등대우이니 부당한 '차별'이 아니게 되는 거죠. -. 이번에 대법원은 ① 임금피크제 도입 목적이 타당한지, ② 임금피크제 적용대상자가 입는 불이익이 어느 정도인지, ③ 임금삭감에 대한 반대급부가 주어졌는지, ④ 임금피크제로 감액된 재원이 원래 목적대로 사용되었는지를 고려해서, 합리적인 이유를 인정할 수 있는지 여부를 판단해야 한다는 기준을 제시했습니다. 2. 이번 사건에서 임금피크제가 무효라고 판단된 이유 -. 이번에 문제된 사업장에서는 위 판단기준들이 거의 다 사용자에게 불리한 상황이었습니다. -. 애초에 일을 졸속으로 처리한 것인지 대리인이 일을 대충한 건지는 모르겠습니다. 여튼 간에 판결문만 본다면, 회사는 ▲ 임금피크제를 도입한 이유도 명확하게 제시하지 못했고, ▲ 개별 직원들이 감수해야 하는 임금하락폭은 최소 월 90만원에서 최대 250만원 수준까지 상당한데, ▲ 이런 임금손실을 보전해줄 수 있는 대책은 제시된 게 없고, ▲ 정작 업무내용이 바뀌거나 업무량이 줄거나 업무강도가 약해진 것도 아니라서, 대법원이 제시한 기준에 하나도 맞는 게 없습니다. -. 거기다가 임금피크제 도입 과정에서 정년이 연장된 것도 아니고, 임금피크제 대상자인 55세 이상 직원들의 실적이 딱히 떨어지는 것도 아니었기 때문에, 더더욱 합리성을 인정받기는 어려웠습니다. 3. 우리 회사의 임금피크제도 무효일까 -. 박근혜정부 당시 누가 밀었는지는 모르겠지만, 여튼 간에 임금피크제 시행을 빡세게 밀어부쳤습니다. 그 결과 2013. 5. 22. 개정된 고령자고용촉진법에는 임금피크제가 도입될 경우에는 고용노동부가 금전적인 지원을 할 수 있다는 내용이 포함되었고, 그 반대급부로 법정 정년을 60세로 못 박았죠. 개정 이전에는 정년을 60세 이상으로 할 것을 권장하고 있었지만 강제는 아니었거든요. -. 이번 판결의 대상이 된 회사가 임금피크제를 도입한 건 법 개정 한참 이전인 2009년입니다. 제도를 새로 도입하면서 정년이 60세로 변경된 상황도 아니죠. 판결문만 보았을 때엔 그냥 인건비 절감 이외에는 별다른 도입목적이 없었던 것 같습니다. -. 때문에 지금 다니는 회사가 2013년 이후로 정년을 60세로 변경하면서, 이에 대한 반대급부로 임금피크제를 도입한 상황이라면 법적 효력이 고대로 인정될 가능성이 상당히 높습니다. 다만 회사들 중에는 매년 전년도 대비 30%씩 임금을 퍽퍽 깎아버리는 임금피크제를 도입하는 경우들도 꽤 있었는데, 불이익 수준이 너무 크다면 달리 판단될 여지는 있습니다. 구체적인 판단은 유사한 판례가 더 쌓여봐야 알겠지만요. * Cascade님에 의해서 티타임 게시판으로부터 게시물 복사되었습니다 (2022-06-07 11:03) * 관리사유 : 추천게시판으로 복사합니다. 제가 다니는 회사가 정확히 언제인지 모르겠는데 55세에서 58세로 늘렸고, 그 뒤에 다시 60세로 늘렸습니다. 60세로 늘리면서 59세가 되면 전년도의 10%, 60세가 되면 전년도의 15% 감액하는데, 일이 줄지는 않는 것 같습니다.
보통 55세가 넘어가면 스스로 나가거나 협력사에 낙하산으로 꽂아서 2-3년 더 일하다가 그만두게 되는데
최근에 회장 아들이 '왜 협력사에 꽂아주느냐.. 실무자들이 협력사 OB들에게 꼼짝 못하는거 아니냐' 하는 식으로 태클을 걸어서 협력사 낙하산 제도가 없어질 것 같습니다.
현장 생산직분들은 정년을 거의 대부분 정년을 채우는데, 하는 일 똑같은데 59세가 되면 급여가 깎인다는 점이 문제가 되지 않을까 싶네요.
