원칙대로만 하려니 어려움이 있어서 위험이 있지만, 갭투자자가 주인이 될 집(아직 주인 아님) 대상으로 갭투자자를 임대인으로 해서 임대차계약을 내일 맺으려고 합니다. 임대차계약서 상에 특약을 넣는 것이 그나마 최선일 것 같은데, 이렇게 진행해도 되려나요? 같은 공인중개사가 당연히 해당 집의 매도와 임대차계약을 동시에 진행하고 있습니다. 현 집주인은 이사 나가기 일주일 전쯤 매매 중도금을 좀 받고(여기도 다른 데 집 사서 나가는 듯), 다음 달에 이사를 나가려고 합니다. 그 중도금을 제가 그때쯤 주는 전세 중도금으로 내려는 것 같습니다. 그리고 매도 잔금일에 저도 잔금 및 입주가 되죠. 매매계약이 아파트 가격이 갑자기 출렁거려서 도루묵이 되거나 할 것 같은 상황은 아닙니다. 원칙적으로는 소유권이전등기 완료 후 새 주인과 임대차 계약을 하는 것이 맞는데, 요즘 워낙 갭투자가 횡행하는 데 저도 거기 일조(?)를 하는 셈이 되는 것 같습니다. 이 상황에서 최선의 방법은 무엇일까요? 사실 오늘 다른 전세 계약도 특약건으로 파토를 내버려서, 내일도 파투를 내버리면 파투맨(?)으로 집에서 찍힐 것 같습니다. 그래도 현 집주인과 임대차계약을 작성하고, 소유권이전등기가 완료되면 임대인 지위를 양도하는 방식으로 진행해달라고 요청을 해야만 할까요? (현집주인은 당연히(?) 거기 끼여서 책임을 지고 싶어하지는 않는 것 같습니다.) 아니면 특약에 어떤 문구를 삽입하는 정도로라도 나는 최선을 다했다. 고 하는 것이 나을까요. 새 집주인이 될 사람이 현 집주인으로부터 임대에 관한 권한을 받았다는 내용이라도 특약에 넣는 것이 좋겠죠? 의미가 있을지는 모르겠습니다만, "임대인이 위 부동산 소유권을 이전 등기 후 임차인에게 즉시 알리고, 해당 물건에 대한 임차인의 전세권 등기가 최우선으로 이루어지도록 도와야하며, 임차인의 전세권 등기에 앞서 근저당 등 임차인에게 불리한 권리를 설정할 시 임대차 계약은 무효로 하며, 임대인은 임차인에게 부동산중개수수료, 이사비용 등 모든 손해를 배상해야 한다." 같은 문구도 넣을까 생각 중입니다. (문구가 좀 이상한 것 같기도 합니다.) 갭투자가 그렇게 많다는데 다들 어떻게 위험부담을 안고 전세를 들어가시는지 급 궁금해지고 있고, 원칙대로 하려는 제가 이상한 사람이 되어가는 것도 같습니다. 역시나 이사는 스트레스입니다.
