전세 계약을 오랜만에 갑자기 (내일 아침) 하게 되었습니다. 전세금이 몇 달 사이 많이 오른 것 같습니다. 해당 집에 거주 중인 집주인이 현 시세의 50% 정도 은행 대출이 있다고 합니다. (전세보증보험의 기준이 되는 KB시세 기준) 이 대출을 제 돈을 받아서 해소하고, 저보고 확정 일자를 받으라는 얘기인 것 같은데 (아직 직접 들은 이야기가 아닙니다.) 이런 경우, 임대차 계약서에 특약으로 "임대인은 잔금/입주일 몇 월 며칠까지 근저당 전부를 말소하기로 한다. 불이행시 지급된 전세계약금 전액을 반환하고 계약은 무효로 한다" 정도만 넣어도 문제없을까요? 계약금을 내일 오전에 요구할 것 같은데, 계약금 입금 이전에 상대방의 '대출 잔액 확인서'를 요구해도 괜찮을까요? 감액이 아니라 말소라 필요가 없을까요? 10년, 20년 전에 전세 계약을 할 때는 워낙 보수적으로 해서인지 대출이 있는 집은 아예 고려를 안 했었기에 대출 있는 집을 전세 계약하는 것은 처음인 데다, 요즘 교묘한 전세 사기도 종종 있다고 하니 내일 전문가에게 물어봐야겠지만, 궁금합니다. 고맙습니다.
