4~5년 전, 예전 근무하던 회사에서 공공기관에 IT 장비를 납품하고, 그 장비를 이용해서 별도의 분석을 수행하는 프로그램을 개발해서 공급한 적이 있습니다. 그런데 그 프로젝트를 수행하던 공공기관의 공무원이 공무상 배임죄로 재판을 받고 있다고 합니다. 초기에는 해당 공무원과 함께 예전 근무하던 회사, 그리고 IT 장비를 개발한 회사가 모두 용의선상에 올랐으나, 예전 근무하던 회사와 IT 장비를 개발한 회사 모두 증거 불충분으로 무혐의 처리되었고, 현재는 해당 공무원만 재판을 진행하고 있습니다. 그리고 해당 공무원이 저를 증인으로 신청해서 제가 법원에 증인으로 출석하게 되었습니다. 해당 프로젝트에서 제 역할은 시스템 엔지니어로, 장비 및 개발 프로그램의 설치 및 운영을 수행했고, 분석 프로그램의 개발에는 참여하지 않았습니다. 에어컨으로 따지면 에어컨 설치기사와 비슷한 역할입니다. 공무상 배임과는 전혀 상관없는(최소한 제 생각에는 그렇습니다) 위치였는데, 저 공무원이 왜 저를 증인으로 신청했는지 감이 안 잡힙니다. 상식선에서 생각해보면, 제가 뭔가 자신에게 유리한 증언을 해 줄 수 있다고 기대해서 증인을 신청했다는 생각은 듭니다만, 솔직히 얼굴조차 기억나지 않는데 뭘 기대하는 건지 모르겠네요. 예전 근무하던 회사에 물어보니, 근무하던 회사 이야기로는 장비의 성능이나 기능에 관련한 질문(예: 이게 초당 00개의 대상을 처리할 수 있는게 맞는가)이 주를 이루었다고 하고, 웬지 저도 엔지니어 역할이었던 터라 그런 류의 질문이 주를 이룰 것 같긴 합니다만, 이건 어디까지나 추측이고, 실제로 무슨 질문이 올지 감조차 안 잡힙니다. 예전 회사에서는 자기들은 공급사와 함께 이미 무혐의 처리되었으니 부담가지지 말고 편하게 증언하고 오라고 하긴 했습니다만, 혹여 제가 뭔가 말을 잘못해서 저 자신이나, 또는 예전 회사와 장비 공급사를 괜히 번거롭게 할 것 같아 걱정이 되네요. 특히나 예전 회사의 경우 좋은 기억들이 많았던 곳이라서 더 걱정됩니다. 상황이 이렇다보니 제가 뭘 어떻게 준비해야 할지, 내지는 무엇을 조심해야 할지조차 감이 안 잡힙니다. 법원에서는 아무것도 준비할 필요 없이 그냥 오면 된다고 했습니다만, 제가 사전에 알아보거나 준비해야 할 것, 내지는 조심해야 할 것이 있을까요? 홍차넷의 법률 전문가 및 변호사 여러분의 말씀 및 조언 부탁드리겠습니다.
