익명 체크 했다가 어차피 문체 때문에 다 들통날거 같아서 걍 익명 풀고 씁니다. 사실관계는 이렇습니다. - SCV는 분양실장 B를 통해 건축주 A와 아파트 매매 계약 체결 (건축주는 업체가 아니고 개인 명의 입니다.) - 계약 당시 불법 증축된 부분에 대해서 듣고, 아직은 걸리진 않았으나 혹 걸려서 이행강제금이 발생하게 되면 건축주가 대납하기로 하고, 이를 계약서에 명시 - 당시 해당 내용에 대해 설명한 분양실장과의 대화 녹음 파일이 있음. - 2년 후 이행강제금이 부과되어 1회차는 건축주가 대납 - 같은 층의 다른 세대들도 모두 불법증축 부분이 있었고, 어떤 세대는 설명을 듣고 대납을 약속받고 1회차 대납하였으나 또 다른 세대는 설명도 듣지 못함 - 현재 하자보수에 대한 건축주와 SCV를 비롯한 입주민들간의 소송 때문에 감정이 상한 건축주 A는 자신과 상관 없다며 대납 거부 - 구청에 문의하자 일단은 소유자가 납부하고 당사자들간에 알아서 해결하시라고 함 - 하자소송 담당하고 있는 변호사에게 (소송과는 별개로 이에 대해) 묻자 섣불리 납부하면 불리할 수 있으므로 내지 말고 국민 신문고 등을 통해 이야기 하라고 함 - 그러나 구청에서 몇 번 이행강제금 통지서가 오다 못해 시에서도 날라오고 계속 안내자 압류 예고통지가 나온 시점 이에 대해서 앞으로 저는 어떻게 해야 할까요? 1. 50만원도 안되는 돈으로 압류가 안나오니 (맞나요..?) 민원 넣고 개긴다 2. 일단 내고 다른 세대랑 힘을 합쳐 민사소송을 건다 혹 다른 해결책이 있다거나 하면 조언 주시면 감사하겠습니다. 아직은 양성화 계획이 없는 것 같은데 구청에서 양성화 계획 발표하면 층 사람들 모아서 양성화 해서 해결하려고요 ㅠ 하자 소송에 이런 일까지 겹치니 머리가 아픕니다 ㅠㅠ 개인적인 내용이 좀 있기는 하나 후에 이런 일을 혹 겪으실 분이 있을까 하여 자삭은 걸지 않겠습니다. 다만 후에 민감한 부분은 다르게 변경하거나 지울 수 있음을 알려드립니다.
