안녕하세요. 오늘 월세로 들어가는 원룸 때문에 임대차 계약서를 작성했습니다. 특약사항으로 1. 현 시설물 상태에서 임대차한다 2. 기타사항은 민법 임대차보호법 및 부동산임대차 계약 일반 관례에 따르기로 한다. 3. 에어컨, 냉장고, 인터넷, ~~ 를 옵션으로 제공한다. 4. 세대별 공과금은 개별납부이며 관리비 5만원은 별도이다. 5. 퇴실시 청소비 5만원을 부담한다. 라고 기재되어 있더라구요. 공과금은 전기세, 수도세, 가스비 이렇게 3종이며, 퇴실시 청소비 부담은 나갈때 청소만 해두고 나가면 부담하지 않아도 된다고 '구두'로 들었습니다. 4,5번 조항은 좀 더 자세한 기재가 필요할 것 같아 각각 '세대별 공과금은 전기요금 수도요금, 가스요금을 포함한다','청소하지 않고 퇴실시 청소비 5만원을 세입자가 부담한다'로 추가 및 수정했습니다. 계약서 상의 입주일은 5월 25일이나 입주 예정인 원룸이 현재 공실이라 언제든 이사해도 입주일만 변경하면 되니, 이사하면 중개사 본인에게 연락달라고 '구두'로 들었습니다. 계약금, 보증금, 월세, 관리비 모두 맞게 기재되어 있었고, 건물주 명의의 계좌 및 중개수수료 등을 확인했습니다. 이전 임대차 계약들과 별다른 차이가 없었기에 계약서에 최종적으로 서명했습니다. 그런데 집에 들어오니 부모님이 왜 계약서를 작성하기 전에 본인들에게 물어보지 않았냐며 노발대발이신겁니다;;; 보증금 100만원을 부모님이 도와주시긴 하셨습니다. 부모님이 지적하는 부분들은.... 1. 각종 공과금을 입주일 기준으로 깨끗하게(?) 정산하는 시점을 명시하지 않았다. 2. 입주일 이전에 언제든 이사와도 좋다는 사실을 중개사의 '구두'로만 확인받았다. 오늘부터 계약서상의 입주일 사이에 2~3주동안 다른 세입자한테 단기로 임대해주면 이사준비 다 해놓은 너는 이러지도 저러지도 못하고 엿먹는거다. 3. 공과금이 ~~~를 포함한다고 써놨지 뭘 제외한다고 나열, 명시하질 않았다. (인터넷비용을 옵션이 아닌 공과금 명목으로 너한테 부담시키면 어쩔려고 그랬냐. 기타 등등 제 설명은 이랬습니다. 1. 일반적인 계약 관례상 입주시기 기준으로 공과금 정산해주는건 기본이다. 이전 원룸 임대차때도 마찬가지였다. 2. 중개인이 언제든지 이사해서 입주해도 좋다고 한 말을 뒤엎고, 현재부터 입주일 사이에 원룸을 제3자에게 단기계약해주는 극단적인 상황이 설사 발생하겠는가. 3. 공과금의 의미는 수도, 전기, 가스요금 등이다. 관리비에서 수도세를 포함하여 개별 공과금에서 제외시켜주는 일이 있어도 인터넷 요금을 공과금에 포함시키는 경우는 없다. 게다가 특약사항으로 인터넷이 옵션인데 요금을 따로 물리진 않을게 아닌가. 였습니다. 부모님은 다시 '네가 말한 그런 자잘한 부분들을 전부 계약서에 다 넣어야지 분쟁이 발생하지 않는다'라고 하시더군요. 저는 공과금의 의미를 부모님이 마음대로 생각한 것처럼 분쟁이 발생하더라도 계약 관례상 해석으로 해결이 가능하다. 정도로 반박했습니다. 뭐 예상한대로 부모님 돈이 들어간 계약을 계약서 검토도 시켜주지 않고 마음대로 안일하게 서명해버린 제 행동을 미친듯이 비난하시더라구요. 두분의 핏대오른 이마와 목을 보아하니 그대로 터져버려 상을 더블로 치루는 생경한 경험을 하게 될까 두려워 결국 제가 실수했다고, 죄송하다고 사과했습니다. 제가 정말로 계약서 작성상의 심각하고 중대한 사항들을 안일하게 차리한걸까요? 저한테는 이전 3번의 임대차계약의 경험과 있으나마나한 민법지식 뿐이라..... 제 실수가 무엇인지 파악해보고자 합니다. 감사합니다.
