제가 다니는 회사는 A라는 회사에 인력을 제공하는 B회사입니다. 소속은 B, 업무는 A. 그리고 같이 근무하시는 분들 중 몇분은 8시간 풀근무가 아닌 파트타임이라고 하루 4시간에서 6시간 정도만 근무하십니다. 애초에 그렇게 일 하기로 하고 입사 하신거고요. 그런데 이번에 회사 방침이 변경되면서 (A의 방침변경인지, B의 방침변경인지는 모르겠습니다) 풀타임 전환이 불가능한 파트 근무자는 퇴사를 해야 한다는 통보를 받았다고 합니다. 저는 애초부터 풀타임 근무로 시작한지라 자세한 내용까지는 모르지만, 기존 파트타임 근무자님들은 대부분 아이 육아나 가사등의 문제로 풀타임 근무를 선택하지 않았는데, 더군다나 그 결정 기간도 이번주 금요일까지라고 통보 받았다고 하네요. 풀타임 전환이 가능하더라도 3일 사이에 7시 이상까지 애들 맡길 수 있는 어린이집으로 변경이 가능할 것 같지는 않은데요. 궁금한 부분, 제가 직접 듣지는 않은 부분이라 확실하진 않지만, 업무 관련 부분 회사 사정에 따라 변경 가능하다는 근로계약서 조항이 사측의 주장근거라고 합니다. 업무시간도 해당내용 포함이라고요. 합당한가요? 업무 시간이 짧을 뿐이지 알바가 아닌 정직원 계약으로 알고 있는데 이런 사유로 사측의 일방 해고가 가능한가요? 실업급여는 모두 보장해주겠다고 했다는데, 입사 6개월 이전 사람도 모두 받을 수 있을까요? 한두달만 더 있으면 입사 1년 넘어가는 분들도 계신다고 합니다. 이 경우 청구 불가능해지는 퇴직금은 어떻게 되는 걸까요? 9-6, 평일만 근무 가능한 회사가 근처에 많질 않으니 별꼴 다 본다 싶습니다. 오만정이 떨어지네요.. 1. 업무관련내용변경은 당사자 사이의 근로계약 내용이 가장 중요합니다. 물론 다툼이 있을순 있지만 우선 당사자 간의 근로계약에 따라 일방이 바꾸는 것이 타당한지가 결정되기 때문에 확실하지 않은 내용으로 이야기하는건 의미가 없습니다. 어쨌든 근로계약서를 직접 보고 이야기해야합니다.

여기에다 처음을 보니 파견근로까지 얽혀서 상당히 복잡한 사안입니다. 권리를 꼭 찾고싶으시다면 노무사나 변호사와 상담하시는걸 권해드립니다.
