안녕하세요 횐님들 제가 법률적 지식은 물론이거니와 세상물정에 어두운 편이라 조언을 좀 얻고자 합니다. 오늘 제 업장 천장에서 누수가 발생했는데요. 발견 당시 천장 일부분에서 물이 뚝뚝 떨어지고 있었어요. 건물 관리소장님과 설비 담당자 분이 확인한 바로는, 천장의 소방배관이 터져서 배관 속 물이 샜다고 합니다. 왜 터진거냐는 질문에는 모르겠다고 하구요. 건물이 좀 오래된 편이라 노후화가 원인이 아닐까 싶긴 합니다. 일단 배관 속에 있는 물은 다 빼서 추가적인 누수는 없을 거라고 하고, 배관 터진 부분을 용접하는 공사를 해야 한다 합니다. 공사는 관리소에서 책임을 맡아 진행해준다 하구요. 여기서 저의 가장 궁금한 점은 누수 때문에 천장 벽지가 물에 젖었고 방치하면 곰팡이 등의 문제가 생길 것 같은데요. 이 부분도 건물 관리소에서 책임지는 게 맞나요? 제 생각엔 손상된 부위에 한해서 도배를 새로 해주는 게 맞다고 보는데 관리소장님은 “그건 어쩔 수 없다”고 하시더라구요. 근거를 뭐라 내세워야 할 지 자신이 없어서 (따지는 거 잘 못 함ㅠ) 일단 넘어갔는데 아무래도 내일 다시 말씀을 드려보고 싶어서 이 글을 올립니다. 궁금한 점은 1. 도배를 건물 관리소에서 해주는 게 맞는지 2. 아니라면 임대인에게 요청을 해야 하는지 3. 그것도 아니라면 제가 스스로 처리해야 하는지 입니다. 참고로 임대차계약서에는 별다른 특약사항은 없고, 임대인은 전체 건물 중 제 업장(고층 건물 중 한 호실)만 소유하고 있어서 건물주와 임대인은 각각 다릅니다. (다만 임대인 분이 다소 말이 안 통하는 스타일이라 가급적이면 관리소 선에서 일이 해결되기를 바라고는 있습니다ㅜ) 답변 기다렸다가 참고하겠습니다 부탁드려요! 건물주와 임대인이 왜 다른가요? 구분소유건물이면 하나의 건물을 통으로 소유하는 건물주는 없고 구분상가소유자가 임대인이니 주인과 임대인이 동일인이라고 보는게 맞는 것 같습니다.
파손된 배관이 전용부분이면 해당 전용부분의 소유자,
공용부분이면 관리단(구분소유자들 모임, 이 경우 관리사무소가 관리단 위임 받아 업무 처리합니다) 입니다
