제가 알기로 본인이 본인 죄에 대한 증거 인멸을 하는 것은 증거인멸죄가 성립이 안되고... 남을 시켜서 증거인멸을 하는 경우에는 증거인멸죄가 되고, 본인은 증거인멸 교사죄가 되는 것으로 알고 있습니다. 지금 이준석 대표가 윤리위에서 징계를 받은 이유가 김철근 정무실장을 시켜서 증거인멸을 했다는 건데... 애초에 2012년에 접대 받은건 공소시효가 지났잖아요? (이걸 지금 2016년 추석까지 끌어와서 포괄로 뮦어서 공소시효가 아직 한발 남았... 아니 한달 남았다고 하고는 있는데) 누구들 말대로 이준석이 증거인멸을 하려고 김철근을 시켜서 각서 써줬다고 쳐봐도... 애초에 공소시효가 지나 증거인멸죄가 성립이 안될것 같고, 그럼 교사죄도 성립이 안될것 같은데... 증거인멸 시도 자체는 올해 1월(?) 이었으니까... 김철근 전 정무실장의 증거인멸죄는 시효가 남아 있는건가? 지난 7월초 윤리위 이후 김철근 이라는 이름이 사라졌는데, 핵관씨들은 이분 포섭 안하고 뭐하나 싶네요. 제1항은 물적 증거에 대한 멸실ㆍ위조행위를,
제2항은 인적 증거인 증인을 은닉 또는 도피하게 하는 행위를 처벌하는 죄입니다.
그런데 형법상 '위조'는 작성명의의 위조입니다. 따라서 '사실확인서'라는 서류- 물적증거를 위조한다는 것은
작성명의자가 아닌데 서류를 작성했다는 의미입니다. (내용이 허위인것은 허위문서작성죄임. 공문서, 진단서등은 허위작성죄가 있지만 사문서는 애초에 허위작성죄가 없음)
소위 이준석 증거인멸을 주장하는 자들의 주장자체가 뭘 주기로 하고 사실확인서를
본인에게 받았다는 것이지 그 사람이 안 썼는데 그사람 이름의 사실확인서를 이준석쪽에서
가짜로 만들었다는게 아니잖아요? 그래서 애초에 위조가 아니고 1항의 증거인멸죄가 아닙니다.
2항의 인적 증거인멸은 증인을 수사기관/법정에 나오지 못하도록 '은닉/도피'시키는 것을 의미합니다.
허위사실을 말하라 종용하는 것은 증거인멸죄에 해당하지 않습니다. 법정증언이 아니면 위증교사도 되지 않고요.
우리 법제는 사법방해죄를 별도로 두지 않기 때문에 허위사실의 내용에 따라 '위계에 따른 공무집행 방해'
혹은 '범인도피 교사'가 성립할 수는 있으나 이 또한 진범을 두고 다른 사람을 범인으로 허위진술한다던가

즉 이준석을 공격하는 쪽의 주장은 애초에 그 사실도 아무런 증명이 없음은 물론
그 사실을 그냥 사실로 인정하더라도 아무런 처벌가능성이 없습니다.
공소시효가 지나고 안지나고를 떠나 구성요건에서부터 해당이 없어요. 그래서 그냥 억지라는 것이고.
제155조(증거인멸등과 친족간의 특례)
① 타인의 형사사건 또는 징계사건에 관한 증거를 인멸, 은닉, 위조 또는 변조하거나 위조 또는 변조한 증거를 사용한 자는 5년 이하의 징역 또는 700만 원 이하의 벌금에 처한다. <개정 1995. 12. 29.>
② 타인의 형사사건 또는 징계사건에 관한 증인을 은닉 또는 도피하게 한 자도 제1항의 형과 같다. <개정 1995. 12. 29.>
제1항은 물적 증거에 대한 멸실ㆍ위조행위를,
제2항은 인적 증거인 증인을 은닉 또는 도피하게 하는 행위를 처벌하는 죄입니다.
그런데 형법상 '위조'는 작성명의의 위조입니다. 따라서 '사실확인서'라는 서류- 물적증거를 위조한다는 것은
작성명의자가 아닌데 서류를 작성했다는 의미입니다. (내용이 허위인것은 허위문서작성죄임. 공문서, 진단서등은 허위작성죄가 있지만 사문서는 애초에 허위작성죄가 없음)
소위 이준석 증거인멸을 주장하는 자들의 주장자체가 뭘 주기로 하고 사실확인서를
본인에게 받았다는 것이지 그 사람이 안 썼는데 그사람 이름의 사실확인서를 이준석쪽에서
가짜로 만들었다는게 아니잖아요? 그래서 애초에 위조가 아니고 1항의 증거인멸죄가 아닙니다.
2항의 인적 증거인멸은 증인을 수사기관/법정에 나오지 못하도록 '은닉/도피'시키는 것을 의미합니다.
허위사실을 말하라 종용하는 것은 증거인멸죄에 해당하지 않습니다. 법정증언이 아니면 위증교사도 되지 않고요.
우리 법제는 사법방해죄를 별도로 두지 않기 때문에 허위사실의 내용에 따라 '위계에 따른 공무집행 방해'
혹은 '범인도피 교사'가 성립할 수는 있으나 이 또한 진범을 두고 다른 사람을 범인으로 허위진술한다던가
