(건너건너 들으니 양재역 모 여성변호사님 추천을 받았네요.) 잡설이 길었습니다. -------------------------------------------------------------------------------------------------------------------------------------------- 요지는 이러합니다. * 원하는 결과 : 부모님의 이혼(좀 더 자세히는, 아버지로부터 어머니를 이혼시켜 드리고 싶음) → 아버지 명의 재산 상속 필요 없음. 어머니 명의의 재산들을 지키며 위자료 또한 지급하고 싶지 않음. (법률적으로 알 수 없으나, 일구어 온 재산형성과정에 아버지가 기여한 바가 전혀 없으므로 위자료 또는 재산분할사유가 제 기준 전혀 없음) * 그 결과로 이르게 한 경과 1. 아버지는 결혼 초반 5년 이내를 제외하고는 결혼 생활 내 경제활동을 하지 않음(가계 도움 無, 책임감 無) → 이는 어머님을 가장으로 만들어 밤낮이 바뀌는 자영업을 혼자서 약 25년 넘게 해오심. 2. 아버지는 가정의 화목이나 안녕 등 심리적인 지지대 역할도 하지 않음(가장, 아버지, 가족 구성원으로서의 역할 無) → 가장인 어머니가 명절때마다 시부모가 돌아가시기전까지 시댁을 찾아뵙고 잠을 자지 못하는채로 음식 하고, 인사 드리고 하는 등의 며느리의 역할, 자녀를 부양하고 교육하며 키우는 역할, 성인이 되어서도 자녀를 위해 헌신하는 역할을 하며 생계를 꾸렸으나 아버지는 약 30년간 어머니가 벌어온 돈으로 자기 방에서 책이나 읽고, 돈을 받아 취미 생활을 즐기고, 식사 한번 차리지 않았으며 자녀들은 이를 지켜보며 어릴때부터 아버지에게 아버지의 역할을 기대하지 않음. 전화번호도 모르며, 1년에 얼굴을 보는 시간은 채 5분이 되지 않음. (자녀의 인생에 도움이 된 적이 없으며, 자녀들은 어디나가 아버지가 있다, 무엇을 한다 등의 관련 얘기조차 묻기전엔 꺼내지 않음) 3. 아버지 본인 명의의 재산을 가족의 의견도 없이 형제들에게 양도 → 자식인 저희들은 애초에 그것을 상속받고자 하는 생각조차 해본적 없음. 관심 無 다만, 일생을 본인을 봉양하고 그 재산에 대한 재산세를 수십년간 납부해 준 어머니와는 상의도 없이 본인 형제들에게 땅, 집 등의 명의를 이전함. (가족에 대한 미래 걱정은 없으나, 형제들의 미래는 노심초사 걱정함) * 아버지 측 대응 : 어머니는 자녀들 입장에서 이해하기 힘들지만 그동안 아버지가 불쌍하다는 이유로 보살펴주고 봉양해주었으나, 3번에 대한 일을 최근에야 아시게 된 후(국민연금 수령후부터는 그걸로 납부하라고 하여 재산세 납부를 아버지에게 넘겼었음), 소위 '현타'가 오셨으며 더 이상 이혼을 미루고 싶지 않아 도리가 있다면 '이혼해 달라' 라고 하였으나, 아버지는 이혼위해서는 돈과 본인이 살 전셋집을 요구한 상황 (이 부분에서, 안면몰수한 악마보다 더 한 인간이라는 자녀들의 판단) * 문의사항 : 이 경우, 어머님이 아버님과 이혼할 수 있을지? 소송을 통하여 가능한 것인지? 입니다. 어머니와 자녀들은 아버님 재산에 관심없으며, 다만 어머니 명의의 재산에서 단 1원도 아버지에게 어떤 명목으로든 지급되는 것을 원치 않음. -------------------------------------------------------------------------------------------------------------------------------- 내용이 길었네요. 자녀인 저희들은 어머니가 이러한 삶을 살아온 것이 너무 안타깝습니다. 힘들게 벌어 왜 도대체 밥해주고, 병원보내주고, 세금도 내주고, 한집에서 재워줬는지 이해를 못하죠. 다만, 자녀 결혼에 누가 될까봐 걱정했던 점들이 있었지만 이제 자녀들 모두 결혼하여 가정을 꾸렸으니 그 점마저 걱정할 필요가 없습니다. 주기적으로 자녀들이 얘기했지만 그냥 죽을떄까지 어머니 본인이 돌보시겠다고 하시다가, 위의 3번 일로 드디어 생각을 바꾸시게 되었습니다. 물론, 재산이 탐나서라기 보다는 정말 아버지가 가족이 아니라는 걸 드디어 깨달으셨기 때문이겠죠. 혹시나, 주변 경험 또는 기타 사례들로 문의사항에 대한 답을 주실 수 있다면 감사히 참고하겠습니다.
