수도권 작은 아파트에 신혼부부에게 전세를 주고 있습니다. 전세금 중 일부는 전세자금 대출을 받은 세입자이구요. 올해 3월에 2년 만기가 되어서 세입자가 계약갱신 청구권을 쓴다고 했습니다. 거기까지야 뭐 그러려니 하고, 내일 5%만 올리는 계약서를 쓰기로 했는데... 전세는 남편 명의로 되어 있는데, 갑자기 부인 명의로 바꿔달라고 하길래, 그건 계약갱신이 아니고 새로운 계약이기 때문에 불가능하다고 했어요. (그럴거면 전세금을 시세대로 올려 받았겠죠...) 알고 보니 세입자 부부 둘이 이혼 소송 중이래요. 부인이 그럼 갱신청구권은 남편이 쓰고 자기는 전세금을 이혼에 대한 위자금?으로 받기를 원하므로 몇개월 후에 남편 명의 전세에 대해서 가압류를 걸거래요. 그리고 최종적으로는 전세를 자기 이름으로 할거라고 하는데... (위자금으로) 제가 명의 변경은 못해준다, 그건 새로운 계약이다 하고 전화를 끊었어요. 1. 이혼에 대한 위자금으로 전세를 받기로 했다면 부인이 자기 이름으로 전세 명의자를 바꿀 수 있나요? 집주인이 모르게? 혹은 집주인이 반대를 해도? (자기가 아는 부동산은 그렇게 말을 했다고 하네요) 2. 저렇게 부인이 가압류를 걸면 나중에 아파트 매도할 때에 뭔가 제한이 걸리나요? 3. 제가 뭔가 미리 해놔야 할게 있을까요? 아니면 다른 방법이 있을까요? 계약갱신 청구권을 쓰겠다고 하면 집주인이 무조건 들어줘야 돼서 현재로서는 할 수 있는게 딱히 없긴 합니다만... ㅠㅠㅠ 내용이 좀 민감해서 익명으로 질문 올리는 점 양해 부탁드립니다...
