지상1층, 반지하로 구성된 연립주택 중 지상1층이 전세로 나와 지난 6월에 계약하고 9월에 이사들어왔습니다. 딱 원하던 조건이었고 이 동네에 흔치않은 매물이라 얼른 계약했었죠. (그 계약서로 확정일자도 받았습니다.) 집주인은 노부부이고 임대사업자로 집을 여러 채 가지고 있습니다. 원래 두 분 사는 곳은 다른 동네에 있는 집인데, 할아버지 할머니가 사이가 좋지 않으신지 원래 집엔 할머니가 사시고, 할아버지는 그 집을 나와 지금 제가 이사들어온 집의 반지하에서 지내고 계신 상황입니다. (이 것 때문에 상황이 복잡해짐) 저희 가족과 집주인 할아버지가 위 아래에 살고 있는 이 집은 임대업을 하는 건물로 등록이 되어있기 때문에, 여기에 집주인이 살면 안된다고 합니다. (?) 그런데 할아버지는 아래층은 세를 놓기 싫고 그냥 본인이 계속 지내고싶은 상황이라, 지상1층과 반지하를 통채로 묶어 저와 전세계약을 하셨습니다. 즉 현재 제가 지상1층, 반지하 전체를 그냥 지상1층 가격에 전세를 내고 사는대신 반지하에 집주인 할아버지가 지내시는 걸 익스큐즈하는 상태로 계약이 되어 있는거죠. 문제는, 할아버지가 임대사업자라 구청에 전세 거래 내역을 신고했더니, (여기서부터는 집주인 할아버지의 주장) 구청에서 '이 건물은 지상과 지하 2개로 나뉘어 등록된 건물이라, 계약서도 2개여야 법적으로 등록 처리가 된다.'(?)며 계약서를 2개로 나누어 다시 등록하라고 했답니다. 할아버지가 지하 층은 세를 안 주고 그냥 창고처럼 쓰겠다고 했더니 그럼 지금 세입자 명의로 아래 위를 나누어 (예를 들어 전세 1억이면, 지상1층을 8천, 반지하를 2천 이렇게 나누어 제 명의의 전세계약 2건으로) 등록하면 된다고 팁까지 알려줬다고. * 부동산에 물어봤더니, 자기도 이런 경우가 처음이라 판단을 못하겠고, 세입자인 제가 동의를 하면 계약서를 분할해주겠다는 입장입니다. 딱히 저에게 문제될 건 없을 것 같다곤 합니다. 여튼 제 입장에서는 - 전세 여러 번 살아봤는데 이런 적은 처음이라 - 자꾸 의문이 듭니다. 1) 그냥 아래 층은 세를 놓았는데 나가지 않아서 쭉 공실이라고 계속 비워두면 안되는 건가? 그럼 임대사업자에게 불이익이 있나? 2) 계약서를 둘로 나누면 내 이름으로 전세를 2군데 계약하게 되는 건데 (합한 비용은 그대로지만) 뭔가 나에게 불이익이 생기는 건 아닌가? 3) 집주인이 뭔가 나에게 큰 사기를 치고 있는 건가??
