B씨가 그 집에 7개월 정도 산 뒤 제3자에게 집을 판 사실을 A씨가 알게 되면서다. A씨는 곧바로 B씨가 법을 어겼다며 900만 원의 손해배상금을 요구하는 소송을 걸었다. '임대인이 임차인의 계약갱신요구에 대해 정당한 사유 없이 거절할 수 없게 돼 있다'는 주택임대차법(6조3)을 근거로 내밀었다. 이 법 5항을 보면 '집주인이 갱신 거절 뒤 정당한 사유 없이 제3자에게 임대한 경우 집주인은 갱신 거절로 세입자가 입은 피해를 보상해야 한다'고 나와 있다. B씨가 설령 임대한 게 아니라 매매했다고 해도 정당한 사유 없이 허위로 실거주한다고 속여 계약갱신을 거절했으므로 법 위반이란 게 A씨 주장이었다. B씨는 실제 들어가 살았지만, 갑자기 경제 사정이 안 좋아져 집을 팔 수밖에 없었다고 반박했다. 법원은 B씨 손을 들어줬다. 6조3의 5항은 임대한 경우를 명시한 것이지 매매한 경우는 해당이 되지 않는다는 것이다. 무엇보다 집주인의 갱신 거절이 인정되는 예외 사유 9가지 중엔 '실거주 목적'이 포함돼 있는데, 이는 집주인의 주관적·개인적 사정에 관한 것이라 입증이 쉽지 않다고 법원은 판단했다. 집주인의 명백한 거짓이 드러나지 않는 이상 실거주를 이유로 한 집주인의 갱신 거절권을 폭넓게 인정해야 한다는 취지다. 시장은 뜻밖의 평가라는 분위기다. 법원은 6조3의 5항이 '임대한 경우'만 명시한 거라고 판단했지만, 정작 정부가 발간한 해설집엔 '실거주를 이유로 갱신 거절하고 3자에게 매매한 경우 실거주할 목적이 없었다고 판단되면 불법성이 인정된다'라고 적혀 있기 때문이다. 더구나 법원은 집주인의 '실거주 목적'에 대해 개인적 사정에 관한 것인 만큼 폭넓게 인정해야 한다고 했지만, 임대차 2법 시행 이후 비슷한 소송이 제기됐을 때 법원 판단은 또 달랐다. 정말로 집주인이 실거주할 사정이 있었는지를 따져 판결을 내렸다. 집주인이 실거주 요건을 남용해 계약갱신을 거절하면 세입자 권리가 위축될 수 있다는 게 이유(서울남부지방법원)였다. 근본적으로는 법 조항 자체가 애매해 갈등을 유발할 수밖에 없다는 지적이 지배적이다. 법 시행 이후 집주인의 실거주 목적의 해지 통보가 유효한지, 정당한지를 놓고 소송이 급증하는 것 자체가 법에 결함이 많다는 방증이라는 것이다. 실제 A씨 사례처럼 손해배상을 둘러싼 분쟁은 지난해 주택임대차분쟁조정위원회(정부 산하)에 579건 접수됐다. 관련 통계 집계 이후 최대치로 1년 전(278건)보다 2배 이상 늘었다. 정부는 임대차 3법, 특히 계약갱신청구권 개선을 예고한 상태다...
