'청구를 기각한다'라는 문장 끝에 '원고가 졌다'라는 해설을 덧붙였다. 이어 판결문 2쪽부터 5쪽까지 '쉬운 말로 요약한 판결문의 내용'이라는 짧은 요약문을 실었다. 이 요약문은 '재판부는 이런 점을 유심히 살폈다'거나 '고민했다'는 표현을 넣어 재판 쟁점을 짚어주는 등 일상적인 대화법으로 작성됐다. 문장 구조와 단어도 다른 판결문보다 쉬웠다. 참고 그림도 첨부됐다. 키 작은 사람과 키 큰 사람이 똑같은 높이의 발판 위에서 축구를 관람하는 그림(기회의 평등)과 키가 작을수록 더 높은 발판 위에 서서 관람하는 그림(결과의 평등)을 나란히 배치한 그림으로, 재판의 쟁점인 평등 원칙을 설명하는 자료였다. 재판부는 '모두가 똑같은 높이 발판에 서있다면 평등원칙에 위배되기에 이 부분을 유심히 살폈다'고 설명했다. 이른바 '이지리드(Easy-Read)'를 시도한 '쉬운 판결문'이다. 이지리드는 '쉬운 언어'(Plain language)라고도 통용된다. 청각·발달·정신장애인 등 비장애인에 비해 문해력이 약한 이들을 위해 일상적인 단어, 직관적인 표현, 짧고 간단한 문장으로 정보를 알리는 방법이다. 필수적이지 않은 수식어나 부정문 사용을 지양하고 동사 위주로 문장을 쓰기에 일반적인 공공 문서와 표현 방식이 크게 다르다. ... '쉬운 언어' 관련 논의가 먼저 이뤄진 북미·유럽 법조계에서는 초등학생이 이해할 수 있는 수준의 쉬운 판결문을 어렵지 않게 찾아볼 수 있다. 영국 대법원은 2021년 11월 발달장애인이 당사자인 사건에서 1심부터 3심까지의 재판 쟁점과 과정을 쉬운 언어로 정리해 공개했다. 7쪽 요약문엔 15개 이상 영단어로 구성된 문장이 드물었고, 초등학생도 이해할 수 있는 단어와 표현으로 구성됐다. 각 심급 판결의 내용은 7개 문장을 넘기지 않았다. 영국고등법원은 또 지난해 2월 2세 및 4세 아동에 대한 보호 및 입양 허가 명령을 내리는 판결에서도 "(양육권이 박탈된) 두 자녀 어머니의 이해를 돕기 위해서"라며 쉬운 언어로 판결문을 적었다. 2015년 2월 캐나다에선 온타리오주 법원 나카츠루(S.Nakatsuru) 판사의 쉬운 판결문이 캐나다 법조계를 떠들썩하게 했다. 판사는 8학년까지만 마친 29세 원주민 청년의 절도 사건 판결에서 다음과 같이 서술했다. "판사들이 판결을 함에 있어 쉬운 언어로 말을 하는 건 중요한데 판사들은 이걸 잘 하지 못하고 있다. 나는 나 자신을 최악의 죄인 중 한 명으로 묘사하고 싶다. (중략)이 나라에 처음 살았던 이들의 자랑스러운 역사를 공유하는 (원주민) 피고인들에겐 재판을 받을 권리 뿐 아니라 (재판 과정을) 완벽하게 이해할 권리도 있다."/// https://n.news.naver.com/article/020/0003471778 ///“판결문은 마지막 물기 한 방울까지 짜낸 메마른 문장”이라고 판사들은 말한다. 부사나 형용사의 사용을 최대한 제한하고 주어, 목적어, 서술어 위주로 명확하게 써야 하기 때문이다. 여기에 ‘기망하다(속이다)’, ‘불상(알 수 없는)’ 등 법률용어까지 곳곳에 들어간다. 그래서 잘 읽히지 않고 이해하기도 어렵다. 의사소통에 어려움이 있는 장애인들에겐 판결문의 벽이 더욱 높다. ... ▷난해한 판결문은 장애인들에게만 문제가 되는 것이 아니다. 대법원 예규는 “판결문은 되도록 쉬운 단어를 사용하고 문장은 짧게 작성하라”고 권고하지만 현실은 다르다. ‘가사(가령)’, ‘불비(못 갖춤)’, ‘경료됐다(마쳤다)’ 같은 낯선 표현이 판결문에서 툭툭 튀어 나온다. A4 용지 한 장이 넘는 긴 문장이 등장하기도 해 ‘판결문 읽다 숨넘어간다’는 말이 있을 정도다. 이렇다 보니 법조인이 아닌 사람들은 판결문을 읽다가 누가 뭘 했다는 것인지, 왜 이런 결론이 나온 것인지 헷갈리는 경우가 다반사다. ▷판결문에는 단 한 글자의 실수도, 오독(誤讀)도 용납되지 않는다. 그렇다고 해서 ‘외계어 판결문’을 계속 써도 된다는 것은 아니다. “판결문은 독백이 아니라 대화”(박형남 ‘법정에서 못다 한 이야기’)라고 했다. 재판의 당사자가 이해할 수 있도록 작성돼야 한다는 취지다. 엄밀하면서도 쉬운 판결문을 쓰는 것은 정성과 노력이 필요한 어려운 일이다. 그렇더라도 ‘국민에게 다가가는 사법부’가 되기 위해선 반드시 가야 할 길이다./// 몇 년 전에 존대말로 작성된 판결문이 나온 적도 있었죠. 법조인 분들은 어떻게 생각하실지 모르겠지만, 저는 이렇게 대중들과의 소통을 고민하는 판사님들이 고맙습니다. 판사님들이 정확함을 구사하는데만 힘을 기울인 나머지 그 정확함이 당사자들에게 전달되지 않는다면 다 무엇이겠습니까. 어떤 이들은 그 정확함에 도달할 수조차 없을 텐데요. 장애인에게 친절한 언어는 비장애인에게도 친절하게 느껴질 거고요.
