[공무원 또는 공기업 임직원이 퇴직 후 3년간 업무 과정에서 알게 된 미공개 정보를 외부에 공개하면 형사처벌을 받게 된다. 공직자나 공기업 직원들이 유튜브나 외부 강연 등으로 돈을 버는 행위도 사실상 금지된다.] 직무 관련 외부활동 제한 대상에 '직무 관련 지식이나 정보를 유료로 제공하는 행위'가 포함되었습니다. 언뜻보면 직무상 비밀 이용해서 돈벌면 안되겠지 하고 무슨 투기가능 정보를 팔아넘기는 행위를 막기 위한 것으로 보이죠. 그런 내용은 금지내용을 적시해서 막을 수 있습니다. 이건 딱 유튜브를 못하게 하기 위한 거죠. 이득을 보지 못하도록 제한한다는 의미보다 정보의 전파/공개를 제한하는 의미가 큽니다. 아예 정무위 관계자가 그렇게 이야기했죠. “LH 사태에서 볼 수 있듯이 유튜브 방송이나 외부 강연 등을 통해 사적인 이득을 보지 못하도록 제한하기 위한 목적”이라고. 저는 이걸 [신재민금지법]이라고 부르고 싶군요. 아니 직무관련 [지식]을 왜 유료로 제공하면 안됩니까? 하다 못해 직무관련 [정보]는 비밀유지 필요가 있을지도 모릅니다만 지식을 왜 막아요. 지식은 공개될수록 좋은거죠. 게다가 이걸 음성적으로 일부에게만 공개하는 건 또 문제가 있을지 모르겠습니다만 외부강연이나 유튜브처럼 대중에게 공개하는게 공익이지 해악이 될게 있습니까? 당초 정부안은 [‘사적으로 노무 또는 조언·자문 등을 제공하고 대가를 받는 행위’]를 제한하는 것이었습니다. 이거면 걱정되는 음성적인 전관거래 막을 수 있잖아요. 왜 이 멀쩡한 정부안을 저렇게 고칩니까? 이런 식으로 진짜 막아야 하는 건 딱히 막을 방법도 애매한데 (그런 음성적 조언자문은 공개되지 않으니 잡기가 어렵죠) 대중에게 지식과 정보가 공개되는 것만 막는 악법입니다. 그러면서 이해관계자 신고대상은 어떻게 제한했나 볼까요? ‘본인, 배우자 또는 생계를 같이하는 직계 존·비속’ 등 정부 원안을 그대로 받아들이기로 여야가 합의했습니다. 소위 논의 과정에 장인, 시아버지 등 배우자의 직계 존·비속을 포함해야 한다는 의견이 있었지만 받아들여지지 않았고, 생계를 같이 하지 않는 직계 존·비속도 신고 대상 범위에서 빠졌다. 아니 생계 같이 하지 않는 존비속..사실상 성인 존비속이면 거의 대부분 신고대상이 아니란 말 아닙니까. 배우자의 존비속은 생계를 같이 하는 경우까지 가능하고. 넓게 막아야 할건 좁게 막고 좁게 막아야 할건 넓게 막고 있습니다.
