https://www.lawtimes.co.kr/Legal-News/Legal-News-View/Content/Article?serial=156740 정보비대칭은 불공정하고 비효율적인 권력을 만듭니다. 피의자에 대해서 이미 필요 이상으로 알려지고 있는 상황을 고려하면, 개인정보 보호를 판결문 비공개의 명분으로 내세우는 것도 타당하지 않다고 생각합니다. 오히려 왜곡 보도를 막는데 도움을 줄 수는 있겠네요. 정보 공개의 대상은 언론이나 특정한 지위에 있는 사람/집단이 아니라 국민을 대상으로 해야죠. 여담으로, 검찰 출신 금태섭 의원이 이 사안에 쏟는 열의와 시각의 날카로움은 꽤나 인상적입니다. 견제할 수 있는 권력을 나눠서 상호 견제할 수 있는 구조를 만들어야 부조리가 해소될 수 있다는 점과 국회에 다양한 출신과 이력을 가진 분들이 진출하면 국익에 도움이 되겠다(그런데 지금 국회에는 특정한 직업군 출신이 너무 많아서 그 분야의 개혁을 가로막고 있겠다)는 점을 새삼 생각하게 됐네요. 그리고 피해자가 어떤 행위를 당했고, 어떤 진술을 했고, 피고인과 어떤 관계인지, 폭행, 협박의 내용, 흉기가 무엇인지, 어떻게 사망에 이르렀는지....등등이 기재될 수 밖에 없는 형사판결문에 개인정보보호가 단지 명분이라 생각하진 않습니다(민사보다 형사에 민감정보가 훨씬 많은 것 같습니다).
피고인이 특정되고, 피해자가 특정될 수 있는 민감정보가 분명 담겨있거든요.

'피의자'에 대한 정보가 알려지고 있다고 하여(이것도 소위 '중요사건'에 한정되지 않는지요)과 판결문 '전면' 공개가 어려운 핵심 사유인 개인정보보호가 평가절하되어야 하는지 잘 모르겠어요(판결문은 재판 과정을 통해 작성되는데, 그것을 전면 공개하기 어려운 사유-개인정보보호-와 피의자 단계에서 언론, 일부 집단 등에서 개인적인 신상을 털어 공개되고 있는 것이 어떤 연관성이 있는지 잘 이해가 되지 않습니다).
이 문제 핵심은 비실명화 과정에 수반되는 예산이 충분치 않다는 것이고, 비실명화, 민감정보 제거가 만만치 않다는 점입니다.
또 이 부분은 판결문 작성을 어떻게 하는 것이 바람직한가와도 연관이 있지 않나 생각되고요.
공개화는 바람직한 방향이라고 모두 생각할 것 같습니다만(저 역시 그러하고요), 충분히 발생될 수 있는 문제를 다방면으로 생각하고, 어떻게 하면 최소화할 수 있는지, 현재 즉각 개선할 수 있는 조치(최소한 현재보다 컴퓨터 수는 늘리면 좋겠죠)를 따져봐야하고, 되도록 '바른 방향'으로 진행되면 좋겠네요. 관련된 예산 편성이 수반되어야 하고요
비실명화의 정도나 판결문에 담겨야 할 사실관계와 민감정보의 정도에 대한 연구도 선행되어야 할 것 같고.. 결국 돈문제라 생각합니다.
그리고 피해자가 어떤 행위를 당했고, 어떤 진술을 했고, 피고인과 어떤 관계인지, 폭행, 협박의 내용, 흉기가 무엇인지, 어떻게 사망에 이르렀는지....등등이 기재될 수 밖에 없는 형사판결문에 개인정보보호가 단지 명분이라 생각하진 않습니다(민사보다 형사에 민감정보가 훨씬 많은 것 같습니다).
피고인이 특정되고, 피해자가 특정될 수 있는 민감정보가 분명 담겨있거든요.
당연히 타당하고 비실명화 과정이 매우 중요합니다. 개인정보라는 것이 피고인에게만 해당되는 것이 아니라 생각해요.
'피의자'에 대한 정보가 알려지고 있다고 하여(이것도 소위 '중요사건'에 한정되지 않는지요)과 판결문 '전면' 공개가 어려운 핵심 사유인 개인정보보호가 평가절하되어야 하는지 잘 모르겠어요(판결문은 재판 과정을 통해 작성되는데, 그것을 전면 공개하기 어려운 사유-개인정보보호-와 피의자 단계에서 언론, 일부 집단 등에서 개인적인 신상을 털어 공개되고 있는 것이 어떤 연관성이 있는지 잘 이해가 되지 않습니다).
이 문제 핵심은 비실명화 과정에 수반되는 예산이 충분치 않다는 것이고, 비실명화, 민감정보 제거가 만만치 않다는 점입니다.
또 이 부분은 판결문 작성을 어떻게 하는 것이 바람직한가와도 연관이 있지 않나 생각되고요.
공개화는 바람직한 방향이라고 모두 생각할 것 같습니다만(저 역시 그러하고요), 충분히 발생될 수 있는 문제를 다방면으로 생각하고, 어떻게 하면 최소화할 수 있는지, 현재 즉각 개선할 수 있는 조치(최소한 현재보다 컴퓨터 수는 늘리면 좋겠죠)를 따져봐야하고, 되도록 '바른 방향'으로 진행되면 좋겠네요. 관련된 예산 편성이 수반되어야 하고요
비실명화의 정도나 판결문에 담겨야 할 사실관계와 민감정보의 정도에 대한 연구도 선행되어야 할 것 같고.. 결국 돈문제라 생각합니다.
