 일전에 홍차넷에도 몇 번 기사가 올라왔던 건이죠. https://new.redtea.kr/?b=34&n=15949 https://new.redtea.kr/?b=34&n=15991 1심 선고가 며칠 전에 나서 기사 올려봅니다. 일단 아래는 연합 신문의 근일 보도. https://www.yna.co.kr/view/AKR20190814147000004 - 서울북부지법 형사6단독 최상수 판사는 [폭행 혐의]로 기소된 서울 노원구의 한 사찰 주지 스님 최모(68) 씨에게 벌금 500만원을 선고했다고 14일 밝혔다. 최씨는 약 30년 전 절에 들어와 행자 신분으로 지내던 정신지체장애 3급인 A(49)씨가 '작업을 빨리 하지 않는다'며 소리를 지르고 발로 엉덩이를 걷어차는 등 2015년 3월께부터 2017년 12월까지 12회에 걸쳐 A씨를 폭행한 혐의로 재판에 넘겨졌다. - 이와 별개로 최씨는 [30여년간 A씨의 노동력을 착취하고, A씨 명의를 도용해 각종 금융거래를 했다는 의혹]으로 경찰 수사를 받고 있다. 시민단체 장애우권익연구소는 지난달 최씨를 서울지방경찰청에 장애인복지법·장애인차별금지법 위반 등 혐의로 고발했다. 이 단체에 따르면 최씨는 A씨에게 하루 13시간의 허드렛일과 공사 일을 시키는 한편 A씨 명의 계좌 49개를 만들어 1992년부터 2018년까지 차명으로 펀드 등 금융상품에 투자하거나 부동산을 거래했다. 이 단체는 "A씨가 2017년 사찰을 탈출해 A씨의 동생이 경찰에 최씨를 고발했지만, 검·경은 노동력 착취 부분은 전혀 수사하지 않았고, 명의도용도 불기소 처분을 받았다"며 "사찰에 아직도 노동력 착취를 당하는 지적장애인이 2명 더 있다"고 당시 주장했다. 다음은 KBS의 이달 초 보도입니다. 주지가 장애인의 신용과 명의를 이용해서 이익을 착복했다는 의혹. https://news.kbs.co.kr/news/view.do?ncd=4255574 - A씨는 2017년 말 절을 뛰쳐 나왔습니다. 노동 착취에 폭행을 견딜 수 없다는 이유였습니다. 자연히 생계가 어려웠죠. 가족과 함께 장애수당을 신청하러 주민센터를 찾았습니다. 그런데 담당 공무원으로부터 '소득이 확인되니 수당을 받을 수 없다'는 말을 들었습니다. 불과 수개월 전, [자기 이름으로 된 계좌에서 2억 원가량의 돈이 출금]됐다는 겁니다. A씨 명의의 계좌 49개 가운데는 2017년 9월과 2017년 12월 개설된 채권 계좌 2개가 있었습니다. 개설 즉시 각각 1억 5천만원과 5천만원의 목돈이 입금됐습니다. 물론 이 계좌도 A씨 이름으로 개설됐지만, A씨는 전혀 모르는 계좌였고, 서류 작성도 안했습니다. 이 [두 계좌에 들어있던 총 2억원은 불과 몇 달 뒤인 2018년 1월 2일에 동시에 해지된 뒤 주지 스님 명의의 계좌로 이체]된 사실을 확인했습니다. - 지난달 9일, KBS가 A씨 사연을 처음 보도한 뒤, 그동안 만남을 거부해 온 사찰 주지가 갑자기 해명하고 싶다며 연락해 왔습니다. 그러더니 뜻밖에도 아파트 이야기를 꺼냈습니다. 자신은 노동착취를 한 적이 없고, 오히려 A씨 노후를 위해 아파트까지 사줬다는 겁니다. 확인해보니, 실제로 A씨 명의의 아파트 2채가 서울 상계동에 있었습니다. 이 중 한 채는 2006년 매입해 8년 동안 A씨 명의로 돼 있었습니다. 그런데, 취재 과정에서 만난 공인중개사가 뜻밖에 이야기를 전해줬습니다. 그 아파트가 A씨 명의이긴 했지만, 실제로는 절의 살림을 맡고 있는 일명 '보살'이 관리하고 있었고, 심지어 그 [아파트에 4~5년간 세를 놓으며 꼬박꼬박 월세를 챙겼다]는 겁니다. 2014년에는 아예 이 여성이 이 집을 [매입]하기도 했습니다. 당시 시세는 1억 8천만원. 그러나 '집주인'인 A씨는 그 돈을 받은 적도, 자기 집이 있었는지도, 월세를 줬는지도, 다시 팔렸는지도 몰랐습니다. 또 한 채는 바로 옆 동에 있었는데, [이 아파트도 2016년 4월 A씨 명의로 매입했습니다. 그런데 단 6개월 만에 되팔았습니다. 반 년만에 6천만 원의 시세차익을 챙겼습니다.] 중개업자는 이 부동산 거래를 사실상 '주지 스님'이 했다고 말합니다. - 사실, [해당 사찰의 토지와 건물은 모두 주지스님 개인 명의]로 돼 있습니다. 조계종측은 종단법상 사찰의 토지와 건물은 종단 명의로 하도록 하고 있습니다. 이 주지스님은 이를 지키지 않고, 개인 명의로 소유하고 있습니다. 이 때문에 조계종은 그를 정식 주지로 인정하지 않고 있습니다. 주지 스님은 시줏돈으로 아파트를 샀고, 금융상품에 투자한 셈입니다. 지적장애인의 인감 도장과 신분증을 오랫동안 관리하면서 그 명의를 이용했습니다. 서울 노원경찰서는 장애인 단체가 이 사찰의 주지 스님을 상대로 낸 사문서 위조 및 금융실명거래법 위반 혐의의 고발장을 접수하고, 수사에 착수했다고 밝혔습니다. 지난 달 기사지만 학림사 신도회에서는 주지를 옹호하는 반박문을 발표한 바 있습니다. http://www.beopbo.com/news/articleView.html?idxno=206289 한편으로 이 기사가 좀 재미있네요. 학림사의 소유 구조와 관련해서 속사정을 짐작케 해줍니다. http://www.beopbo.com/news/articleView.html?idxno=206205 - 그럼에도 이번 사건이 불거진 데는 사찰 측 책임이 무엇보다 크다. 해당사찰 안팎에서 나온 이야기를 종합하면 이번 사건은 사찰종무를 책임지는 [스님과 그 속가 가족들의 이해관계에 따른 갈등]에서 빚어졌다. 이 절을 중창한 스님은 자신의 동생을 주지로 삼았고, 주지스님은 또 다른 동생들을 차례로 불러들여 절의 사무를 보도록 했다. 그러다 수년 전부터 사찰운영권을 두고 다툼이 발생했고, 형제들간의 반목이 깊어졌다. 절에서 지내던 [A씨를 데리고 나가 장애인단체 등에 고발을 부추겼다고 알려진 전 사무장 B씨도 주지스님의 매제]였다.
