 요즘 ILO 협약과 사회복무요원(공익) 제도에 대한 떡밥이 인터넷 커뮤니티에서 흥하네요. 그래서 홍차넷에도 떡밥 가져왔습니다. https://news.naver.com/main/read.nhn?mode=LSD&mid=sec&sid1=101&oid=079&aid=0003209054 https://www.mk.co.kr/news/economy/view/2018/11/737229/?fbclid=IwAR3-klvZaZzsnbCYeM8dxuGmLZ1cjZ73pF9fWrIj4H-H2i2b_-fL44cDoaQ 배경설명을 하자면, 사회복무요원 제도는 입영대상자 중 병무청 신체검사 결과 4급 보충역 판정을 받은 이들을 공공기관, 복지시설 등에서 근무시키는 제도입니다. 국제노동기구(International Labour Organization, 줄여서 ILO)는 UN 산하 기구로, 전세계 노동자들의 노동권 보호를 목표로 하고 있는 기구입니다. ILO에는 노동권에 관한 여러가지 협약이 있는데, 한국은 제87호, 제98호, 제29호, 제105호에 가입하지 않았습니다. 지금 한국의 사회복무요원 제도가 문제시 되는 이유는 이 제도가 ILO 제29호(강제노동에 관한 조약), 제105호(강제노동 폐지에 관한 조약) 협약에서 정의하는 '강제노동'에 해당합니다. ILO는 징병제 자체는 강제노동이 아니지만, 징병한 인력을 비군사적 작업에 동원하는걸 강제노동으로 간주합니다. 양심적 병역거부자의 대체복무는 당사자들이 원한 거니까 예외로하고 있고요. 한국은 이 제도를 유지하기 위해 해당 협약들을 가입하지 않았고요. 유럽연합은 한국이 한-EU FTA에 국제노동협약을 이행하겠다는 조문을 지키지 않고 있다는 점을 지적해서, 분쟁결과에 따라 무역제재 또는 직, 간접적 제재가 있을 수도 있다고 하네요. 하지만 기사에 따르면 아직 FTA의 노동관련 조항 때문에 무역제재까지 간 사례는 없다고 합니다. 그런데 분쟁의 원인이 된 협약들 중 제29호, 105호 협약에 가입하려면 사회복무요원 제도는 폐지가 불가피하기에 주목을 받은 것 같습니다. 언론이나 정재계는 제87호(결사의 자유 및 단결권), 제98호(단결권 및 단체교섭권)에만 관심있고, 제29호와 제105호에는 무관심한 것으로 보입니다. 반면에 인터넷 커뮤니티들은 제29호와 제105호에 더 관심이 많아보이고요. 저 역시 사회복무요원으로 복무 중 이기에 이 제도가 어떻게 될지 궁금하네요. 다른 커뮤니티들을 보면 1. 사회복무요원 폐지하고 4급도 싹다 현역으로 돌릴거다. 2. 4급 중에서도 정말 상태안좋은 인원만 면제시키고 나머지는 현역으로 돌릴거다. 3. 제도명과 소속만 바꿔 ILO 협약을 우회하는 방식으로 유지시킬거다. 로 의견이 갈리는 것 같습니다. 제 생각에, 어차피 한국의 대부분의 유권자들은 이 제도 자체에 무관심하거나, 폐지에 반대하고 있기에 한국이 스스로 이 제도를 폐지하는건 불가능하고, 결국 유럽연합이 어디까지 가느냐가 결정적일 것 같습니다. 정부 입장에서 사회복무요원 제도는 아픈 사람을 싼값에 부려먹을 수 있는 꿀같은 제도지만, 굳이 제재를 당해가면서 지키려고 할 것 같지는 않습니다. 전부 다 허용시키는 게 맞습니다. 사회복무제도 없애고, 징병제에서 월급 올려주는 꼼수 쓸게 아니라 아예 모병제로 가야하고, 공무원도 정당가입 허용하고 그래야죠. 그게 진짜 민주주의 사회인 겁니다. 사람 값도 비싼 줄 알아야 하구요.
사실 저 ILO 관련이나 '교원의 지위에 관한 협약(87조나 95조에 해당한다고 보시면 됩니다)'같은거 비준 안했을떄 이미 90년대에 헌소를 간 적이 있었습니다. 그걸 헌법 제6조에서 '일반적으로 승인된 국제법규'가 아니다고 정치적으로 해석해서 합한낸걸 지금까지 질질 끌어온 건데 솔직히 말하면 직무유기죠.
전부 다 허용시키는 게 맞습니다. 사회복무제도 없애고, 징병제에서 월급 올려주는 꼼수 쓸게 아니라 아예 모병제로 가야하고, 공무원도 정당가입 허용하고 그래야죠. 그게 진짜 민주주의 사회인 겁니다. 사람 값도 비싼 줄 알아야 하구요.
