대법원은 일단 한일기본조약에 따라 양국 국민(한-일, 일-한)간의 재산상의 채권청구권(계약 등등에 의한)은 구할 수 없다는 것인데, 딱 하나 예외적인 것이 '불법행위에 의한 손해배상채권'입니다. 왜냐면, 1965년 조약 체결 당시에 일본 정부는 '불법행위 그딴 거 없음' 이랬거든요. 우리 쪽에서는 무슨 개소리야.. 강제징용은? 정신대 할머니들은? 하는 취지로 반발하다가, 이 문제는 결국 유야무야 봉합되어 버렸죠.
그러다보니... 다른 채권채무관계야 조약으로 해결은 되었는데, 1965년 협정 당시에는 불법행위에 의한 손해배상채권이 1965년 협정에 포함이 되느냐 되지 않느냐.. 하는 문제가 남아버렸다는 게 대법원의 다수의견 판시입니다. 그리고 이 판결로, 일본국 내지 일본국의 사인이 자행한 불법행위 자체를 1965년 당시의 일본정부가 부인하였으니, 불법행위에 의한 손해배상 청구가 이 협정에 의하여 배제된다고 할 수 없다는 것이 다수의견의 취지입니다. 요약하면 [그 때 불법행위 인정했으면 당연히 65년 조약에 불법행위 손배채권도 포함되는 건데, 그 땐 그런 거 없었다고 했잖아? 그러니까 불법행위는 별도로 봐야지?] 인 거죠.

아베가 대한민국 법원의 판결에 반발하는 것도 일말의 타당성은 있다고 봅니다만, 국제법 위반.. 까지는 너무 나갔다고 봅니다. 굳이 세밀하게 이야기한다면, 아베의 발언은 '대한민국 대법원이 조약의 해석에 관한 비엔나협약을 위반했다' 정도가 되는데요. 비엔나 협약의 어떤 부분을 어떻게 위배되게 우리 대법원이 해석했는지를 지적해보라면 아마 못할 겁니다. 정치적인 제스쳐라고 봐야겠지요.
일본정부의 입장은 간단합니다. 1965년 한일기본조약에서 [일방 체약국 및 그 국민의 재산, 권리 및 이익으로서 본 협정의 서명일에 타방 체약국의 관할하에 있는 것에 대한 조치와 일방 체약국 및 그 국민의 타방 체약국 및 그 국민에 대한 모든 청구권으로서 동일자 이전에 발생한 사유에 기인하는 것에 관하여는 어떠한 주장도 할 수 없는 것으로 한다.]
