지나친 근로 시간으로 고통받는 노동자들의 현실이 있었기에, 주 52시간 근무제가 공감대를 얻어 시행이 되려고 합니다. 그런데 이 법을 실행하는 데에는 여러 현실적인 문제가 따릅니다. 오늘은 그것에 대한 논문을 가져와서 살펴보겠습니다. https://www.google.com/url?sa=t&source=web&rct=j&url=https://www.kli.re.kr/kli/downloadPodFile.do%3FpdicalOrginlDwldNo%3D4026&ved=2ahUKEwi8ruG8kYbjAhWCy7wKHUFFACAQFjAAegQIAxAB&usg=AOvVaw30ifG2wM_hp1Yh2_WIaOtd 이 글은 기본적으로 노동시간을 줄인다는 의도에는 동의를 합니다. 그런데 여기서는 법 준수를 위해 발생하는 실질적 문제들이 있습니다. 1. 근로시간 유연화 제도가 이 제도와 같이 시행되는데 이에 따라 근로 조건 합의에 여러 문제가 야기됩니다. 특히 근로시간 합의, 휴식시간 합의 등의 조건이 발생하는데, 이에대한 합의는 글로 써서 합의를 요청합니다. 그런데 서면으로 합의를 하면 실질적으로 근로자가 자신의 입장을 반영할 수 있을까 문제가 생깁니다. 2. 근로시간 단축 제도는 기업마다 다르게 시행합니다. 문제는 기업마다 다르게 적용하는데는 합의와 공감대가 부족하다고 합니다. 3. 연장근로가 휴일인 경우에는 임금 가산을 제대로 하지 않아 실제 근무시간을 단축할 수 있을지 의문입니다. 4. 최저임금 미만선에 있는 근로자는 이 법의 보장을 제대로 받지 못하는 현실입니다. 5. 운송업계 등 이 법의 적용이 힘든 데는, 노동 조건에 대한 합의가 더욱 난해하게 되어서 새로운 노사분규의 단초가 될 수 있다는 의견이 있습니다. 1(김근주,근로시간 법제의 현황과 과제,17페이지) 2~5(김근주,근로시간 법제의 현황과 과제,13~14페이지) 만약 근로시간 단축이 사회적으로 합의된 과제라면, 실질적인 제도적 구멍을 메우기 위한 입법 조치 등이 행해져야 한다고 생각합니다. 그래야 위와 같은 문제를 억제할 수 있다고 생각합니다.
