STX가 법정관리 신청을 내기로 결정한 것이지요. 법정관리 신청을 하면, 이런 큰 기업의 경우 서울중앙지법 파산부(미국으로 치면 여기가 chapter 11-파산법원)로 '회생절차 신청'이 들어갑니다. 그리고 파산수석부장(고등법원 부장판사)은 온갖 경영관련 실사 자료를 들고 '구조조정과 회생'을 할 것인지 아니면 그냥 파산시킬 것인지를 결정하게 됩니다. 저는 쌍용차 법정관리 당시에 당시 수석부장판사와 자주 만날일이 있었는데 그 고뇌도 웬만한 사람이 감당할만한 것은 아닌 듯 했습니다. (그때가 2008년 금융위기 직후라서, 당시 대한민국에서 가장 많은 기업을 거느린 사람은 우스개 소리로 서울중앙지법 파산부장이라는 얘기가 돌기도 했지요. 지금의 산업은행장 처럼) 뭐 어쨌든 이제 공은 법원으로 넘어가겠네요. 쌍용차는 살릴 수밖에 없는 내외적 압박이 있었지만 STX조선은 솔직히 장담하기 어렵습니다. [문제의 제기] 위 링크 기사에 잔뜩 써있는 비판과 대안은 굳이 재론하지 않겠습니다. 다소 뻔할 수밖에 없는 얘기들이기도 하고, 4년 가까이 4조원을 '꼴아 박으면서' 당최 뭘 한 것이냐는 어쩔 수 없는 분노도 함께 생기니까요. 다만 위 기사 중 첫번째 링크 기사의 고려대 경영학과 이만우 교수의 일갈, 즉 "STX조선해양의 제품군은 중국 조선소와 경쟁에서 가격을 맞출수 없는 분야였다. 채권은행들이 진작에 과감한 결정을 내렸어야 하지만 그 시기를 늦추는 바람에 비용만 더 낭비하게 됐다"는 말을 보며 여러 생각이 들었습니다. 4조원은 사실 엄청난 돈이잖아요. 근데 결국 기업도 살아나지 못했고, 결국 구조조정을 통한 회생이든 파산이든 일은 크게 벌어지게 됐고, 이미 많이 해고됐겠지만, 그나마 남은 많은 이들도 직장을 떠나야겠지요. 이 불경기에, 그리고 더 많은 해고자가 쏟아져 나올 진정한 헬조선의 한복판으로 말입니다. [반복되는 준엄한(?) 꾸짖음과 그 허무함] 이쯤 되면 모든 경제/경영학자, 언론인 그리고 여러 전문가들이 성토를 하기 시작합니다. "왜 제때 구조조정을 하지 못해서 비용만 날리느냐?", "이래서는 아무것도 못한다. 골든타임을 놓치면 안된다. 앞으로는 절대 그래선 안된다. 지금 문제되는 기업들 구조조정 빨리 하고 야당은 발목잡지 마라" 등 등. 그런데 늘 반복됩니다. 한국의 관료들은 비겁하고, 정치인들은 표를 의식해서 부담을 지기 싫어하고, 노조는 어떻게든 밥그릇을 지키기 위해서 떼를 쓰기 때문일까요? 근데 세상 어느 국가의 관료들이 그리 용감할까요? 관료에 대한 풍자는 거의 전 세계가 동일한 패턴을 보일텐데요...또한 정치인들이 표를 의식하는 것은 우리가 만든 시스템의 기본전제이고, 노조는 밥그릇 지키는 싸움을 하지 않으면 혁명을 하라는 말인가요? 이 나라에서 김재익씨가 잠시 이끌던 1980년대 초반의 시기, 그리고 'Our hands are tied'라는 명목하에 어쨌든 강한 구조조정을 추진할 수 있었던 IMF 외환위기 직후를 제외하고 시장에 의한 구조조정이 제대로 이뤄진 적이 있었는지 솔직히 저는 잘 기억이 나지 않습니다. IMF 직전 대마불사 신화를 깨며 먼저 무너진 기업들이 몇 있긴 했죠. 그건 구조조정 실패의 결과였고, 그 시절에 애초에 그런말 자체가 잘 통용되는 것도 아니었습니다. 왜 그럴까요? 구조조정은 한 기업의 문제가 아니라, 사회전체의 문제일 수밖에 없기 때문입니다. [구조조정이 잘 안되는 이유: 갈등 해결 기제의 부재] 1.다른 나라 사례들 1)미국 다른나라 사례를 볼까요? 미국은 가장 '시장논리'가 강한 국가입니다. 그래서 미국을 보면서 늘상 '자유경제 지상주의자'들이 '노동시장 유연화', '상시적 구조조정과 해고의 자유'를 부르짖습니다. 그런데, 미국의 노동시장 '유연화'라는 단어에는 그만큼 엄청난 직업선택의 자유와 사회안전망이 깔려있다는 얘기는 하지 않습니다. 미국에서 해고된 노동자, 혹은 퇴사한 노동자는 그물망처럼 연결된 구직센터에 찾아가 새로운 직업을 한국보다 훨씬 쉽게 찾을 수 있고 주정부, 카운티마다 설치된 각종 교육시설을 통해 새로운 취업을 위한 교육서비스도 제공받기가 쉬운걸로 알고 있습니다. 노동과 자본 모두에게 '노동시장이 유연'한 셈입니다. 물론 이 경우 기업이 기본적으로 유리한 게임이긴 하지만요. 따라서 미국에서의 구조조정을 둘러싼 '갈등'은 각자 해결하도록 돼 있고 각자 해결할 수 있는 길이 보장돼 있습니다. (유일하게 기업별 노조 혹은 산별노조 차원에서 해결이 가능했던게 예전 디트로이트 자동차 산업을 중심으로한 노조들이었을 것입니다.) 2)서유럽 한편, 유럽은 '사회주의 이념'을 중심으로 한 '강한 정당'이 존재했고 번갈아 혹은 장기집권을 해왔기에 다른 갈등해결 방식을 갖고 있습니다. (지금은 많이 유명무실해졌고 70~80년대까지 작동하던 메커니즘이지만, 그럼에도 불구하고 그 유산은 강하게 남아 있습니다.) 유럽의 '갈등해결 시스템'과 경제성장의 관계를 거시역사적으로 살펴본 필립 슈미터는 다음과 같은 설명을 제시합니다. *용어설명: *코포라티즘-단일정상조직을 가진 조직률 높은 노조 혹은 산별노조 이상의 존재+기업인 모임(자본가조직)+국가의 타협보장자 역할 **다원주의-개별 분절적 사업장 단위/기업단위의 전투적 노조+개별 기업(자본)과의 협상(국가는 불법행위시 개입-주로 파업해산 등) a.코포라티즘+친노동 집권당 =경제성장 b.코포라티즘+친자본 집권당=경제후퇴 c.다원주의+친노동 집권당=경제후퇴 d.다원주의+친자본 집권당=경제성장 뭐 반박할 수 있는 사례도 많지만 거시역사적 패턴은 그랬다는 것이지요. 이 과정에서 어떤 산업의 구조조정과 해고가 필요하고 자본이든 노동이든 희생이 필요한 부분이 있다면 코포라티즘의 경우에는 a.에서는 서로 타협하고 국가가 보통 노동의 희생을 수반할 수밖에 없는 구조조정에서 최대한 희생을 줄이면서 방법을 찾습니다. 격한 갈등으로 치닫지 않게 만들고, '생존'과 '안전'을 보장해줍니다. 그런데 b.의 경우처럼 노조가 전투적일 필요가 없을 정도로 힘이 강한 곳에서 국가+자본의 연합이 압박을 가하게 되면 구조조정에 대한 저항이 역설적으로 거세지고 경제는 후퇴하기가 쉬워집니다. c.와 d.에서는 정 반대의 현상이 일어나게 될 것입니다. 그런데 일본과 한국은 매우 다른 패턴이 존재했습니다. 경제성장의 방식도 다르고 산업과 노동의 조직화 방식도 달랐기 때문입니다. STX의 법정관리와 공적자금 투입에 관한 이야기는 4년간 4조원을 투입하면서 STX를 살리지는 못했지만 그 만큼의 손실을 막았다는 평도 있더군요.
