무플이다 보니 개인적인 관점이라도 적어두도록 하겠습니다;
이 재판은 유죄결론 전망이 우세했고 그에 대한 가장 결정적 근거가 김진성이 위증을 했다고 자백을 했다는 것이었습니다.
이에 대해 이재명 측에서는 김진성이 자백을 한 것은 검찰의 플리바게닝에 의한 것이며 김진성의 위증은 없었고, 따라서 위증교사도 없었다는 입장이었습니다. 그 근거로 이 사건의 증거인 녹음파일이 김진성이 백현동 사건을 수사받는 도중에 나왔는데, 김진성은 백현동 관련 알선수재 혐의를 받음에도 기소가 되지 않았다는 것을 들었습니다.

공범인 김인섭이 74억 알선수재 혐의로 이미 항소심에서 징역 5년을 받았고, 김진성이 범행에 협력했고 지분을 나누기로 약정한 것이 판결문에 적시되었음에도 검찰은 김진성을 기소하지 않았고, 다른 알선수재 사건에서도 기소를 하지 않았으며, 경찰에서 기소의견으로 송치한 사기사건도 무혐의처리하였다는 정황이 있었습니다. 김진성이 검찰조사에서 처음에는 위증이 없었다고 했다가 나중에 위증을 했다고 번복한 것은 자신의 선처를 대가로 이재명의 범죄입증에 협조하는 플리바게닝의 결과라는 것입니다.
그러나 재판부는 그런 주장을 인정하지는 않았습니다. 다만 김진성이 위증했다는 자백도 그대로 인정하지 않아, 자백이 객관적 증거에 반하는 부분은 위증을 인정하지 않았고, 반하는 객관적 증거가 없는 부분에 대해서는 자백을 받아들여 그대로 위증한 것으로 인정하였습니다. 위증이 인정되지 않은 부분은, 녹음파일 자체에 김진성이 스스로 자신의 기억으로 말한 부분이 나오기 때문에 그 부분은 기억에 반하지 않는 증언이라 위증이 아니라는 것입니다.
위증교사는 없었다고 판단하는 이유에 대해서는 여러 이유를 들었는데 제가 주목했던 부분은
[(피고인 이재명은 피고인 김진성에게, 김병량과 KBS 사이의 피고인 이재명을 검사사칭 사건의 주범으로 모는 고소취소 약속을 아는지에 관하여 물었는데, 피고인 김진성이 이를 모르겠다고 답변하자, 김병량 측과 KBS 측 사이의 협의 · 상의 · 접촉 등이 있었는지에 관한 이야기를 하면서, 더 이상 피고인 이재명을 주범으로 모는 합의에 관한 증언을 요청하지 않았음).
- 피고인 이재명은, 피고인 김진성이 알지 못한다고 한 '고소취소 약속' 과 피고인 김진성이 모를 수 있는 내용인 '김병량 측과 KBS 측 사이의 협의의 구체적인 내용' 에 관하여는 증언을 요청하지 않았음. 피고인 이재명은 대화과정에서 피고인 김진성이 모른다고 하거나 부인하는 내용은 배제한 채 피고인 김진성이 기억하거나 동조하는 사항 또는 적어도 피고인 김진성이 명백히 부정하지 아니하는 사항에 관하여만 명시적으로 증언을 요청하였을 뿐임.]
입니다. 이재명이 기억이 안난다며 난처해 하는 김진성에게 기억이 안난다는 부분에 대해서는 기억에 반해 증언할 것을 계속 요청하지 않았고, 혹시 다른 부분은 아는지 확인하고, 안다면 그 부분을 증언해달라고 요청한 것으로 본겁니다. 김진성이 그럼에도 불구하고 위증을 한 것으로 인정된 부분에 대해서도, 재판부는 김진성이 위증하게 된 것이 이재명의 개입으로 인한 것으로 볼 직접적인 근거가 없다는 점, 이재명이 김진성의 증언이 거짓이라는 사실을 알 수 없었던 점 등을 들어 위증교사의 고의를 인정하지 않은 것 같습니다.

그러나 재판부는 그런 주장을 인정하지는 않았습니다. 다만 김진성이 위증했다는 자백도 그대로 인정하지 않아, 자백이 객관적 증거에 반하는 부분은 위증을 인정하지 않았고, 반하는 객관적 증거가 없는 부분에 대해서는 자백을 받아들여 그대로 위증한 것으로 인정하였습니다. 위증이 인정되지 않은 부분은, 녹음파일 자체에 김진성이 스스로 자신의 기억으로 말한 부분이 나오기 때문에 그 부분은 기억에 반하지 않는 증언이라 위증이 아니라는 것입니다.
위증교사는 없었다고 판단하는 이유에 대해서는 여러 이유를 들었는데 제가 주목했던 부분은

- 피고인 이재명은, 피고인 김진성이 알지 못한다고 한 '고소취소 약속' 과 피고인 김진성이 모를 수 있는 내용인 '김병량 측과 KBS 측 사이의 협의의 구체적인 내용' 에 관하여는 증언을 요청하지 않았음. 피고인 이재명은 대화과정에서 피고인 김진성이 모른다고 하거나 부인하는 내용은 배제한 채 피고인 김진성이 기억하거나 동조하는 사항 또는 적어도 피고인 김진성이 명백히 부정하지 아니하는 사항에 관하여만 명시적으로 증언을 요청하였을 뿐임.]
입니다. 이재명이 기억이 안난다며 난처해 하는 김진성에게 기억이 안난다는 부분에 대해서는 기억에 반해 증언할 것을 계속 요청하지 않았고, 혹시 다른 부분은 아는지 확인하고, 안다면 그 부분을 증언해달라고 요청한 것으로 본겁니다. 김진성이 그럼에도 불구하고 위증을 한 것으로 인정된 부분에 대해서도, 재판부는 김진성이 위증하게 된 것이 이재명의 개입으로 인한 것으로 볼 직접적인 근거가 없다는 점, 이재명이 김진성의 증언이 거짓이라는 사실을 알 수 없었던 점 등을 들어 위증교사의 고의를 인정하지 않은 것 같습니다.
