 얼마전 장거리 고속도로 주행을 하다보니 1차로 주행 시간이 생각보다 많았습니다. 끼어드느라 쓰기도 하고, 화물차 피한다고 쓰기도 하고... 그러다보니 "1차로 주행하면 단속한다던데", "정속충이 문제라던데", "정속충이라고 하는 사람들은 거의다 과속 난폭운전이라던데" 하던 인터넷 얘기들도 떠오르고 했습니다. 그래서 집에 와서 대체 그럼 1차로는 언제 쓰라는걸까. 궁금해서 법규를 좀 찾아보고 싶어졌습니다. 고속도로 1차로 통행과 관련한 법은 도로교통법 제14조 1항입니다. "제14조(차로의 설치 등) ① 시ㆍ도경찰청장은 차마의 교통을 원활하게 하기 위하여 필요한 경우에는 도로에 행정안전부령으로 정하는 차로를 설치할 수 있다. 이 경우 시ㆍ도경찰청장은 시간대에 따라 양방향의 통행량이 뚜렷하게 다른 도로에는 교통량이 많은 쪽으로 차로의 수가 확대될 수 있도록 신호기에 의하여 차로의 진행방향을 지시하는 가변차로를 설치할 수 있다." 여기에 나오는 "행정안전부령"은 도로교통법 시행규칙 제16조 1항입니다. "제16조(차로에 따른 통행구분) ①법 제14조제1항에 따라 차로를 설치한 경우 그 도로의 중앙에서 오른쪽으로 2 이상의 차로(전용차로가 설치되어 운용되고 있는 도로에서는 전용차로를 제외한다)가 설치된 도로 및 일방통행도로에 있어서 그 차로에 따른 통행차의 기준은 별표 9와 같다." 왕복 4차로..그니까 편도 2차로 부터는 일단 첫 차선을 비워야 하는게 확정됐습니다. 별표 9를 보겠습니다. (이미지 올렸습니다...) 1차로는 추월차로로 써야 하고, 다만 전체적으로 길이 막혀서 80km/h 밑으로 떨어지면 주행차로로 써도 된다고 적시하고 있습니다. 그니까 길이 막히면 1차선으로 쭉 가도 되는데.. 이럴땐 어차피 정속주행이라고 하기 어렵지 않나? 하는 생각이 들기도 하네요. 그런데 1차로에서 추월을 하고 싶다고 해서, 차량 운행 제한 속도의 상향이나 완충이 허용되지는 않습니다. 도로교통법 시행규칙 제19조 1항 3조는 고속도로의 통행최고속도에 대해서 경찰청장이 인정하는 "구간" 에서는 120km/h, 그 외에는 100km/h로 명시하고 있습니다. 아마도 110km/h 제한 고속도로는 이 규정을 따라서 경찰청장이 110km/h 까지만 허용하는 방법으로 최고속도를 정한 것 같습니다. 최고속도에 대한 완화 조건은 특정한 "구간"에 대해서만 가능하고, "상황"에 대해서는 예외가 없습니다. 그러니 추월한다 해도 규정속도 내에서 추월이 가능해야 합니다. 그리고 이 모든 얘기는 "고속도로" 기준입니다. 올림픽대로나 강변북로, 또는 김포한강로 같은 지방의 자동차 전용도로는 해당되지 않았습니다. 이제 제 머리속에서 정리가 되었습니다. 일반 세단을 운행하는 저는 고속도로에 진입한 이후 80km/h 이하로 내려가기 전까지는 1차로는 비워두면 됩니다. 다같이 100km/h 또는 110km/h로 가고 있으면 무빙워크에 올라탄 것 처럼 변함없는 앞차를 쳐다보며 2차로로 가면 됩니다. 앞이 텅텅 빈거 같은데 내 앞차가 90km/h로 가고 있으면 "앞차 아부지요 저는 좀 바쁜데요." 하면서 1차로를 이용해서 100km/h(혹은 110km/h)로 추월 하면 됩니다. 근데 다같이 90km/h로 가면서 추월할 공간이 안나오는 정도의 통행량이다.. 하면 "아예 좀 더 막히든가.. 차로가 아깝네" 하면서 2차로로 가면 됩니다. 추월차로로 나갔는데 한번에 5대 쯤 제껴야 한다 하면 주행으로 취급될 수도 있으니까요. 경찰청에서도 추월차로에서 주행하는 것에 대한 기준을 상식적으로 보겠다고 한 적이 있으니 애매하다 싶은걸 굳이 제가 어디까지가 선인지 확인할 이유는 없는거 같습니다. 다 정리하고나니 고속도로를 탈거면 그냥 80km/h 이상 어드메 쯤의 속도로 간다고 생각하고 조금 일찍 나가는게 낫겠다 싶습니다. 덜밟으면 연비도 잘나오고 지구에게도 덜 미안하겠지 하는 마음으로 말이죠.
