로스쿨에 처음 입학하면 '민법'부터 배웁니다. 오늘 곰곰히 생각해보면 너무나 당연한데 지금까지 인지하지 못하고 있었던 충격적인 사실을 인지하게 되었습니다. 로스쿨에서 배우는 민법 판례에 1945년 해방 이전의 일본 최고법원 판례들이 없다는 것입니다. 그리고 그 판례들이 바로 제가 민법 공부를 하면서 내내 찝찝했던 'missing link'를 이룰 수밖에 없다는 점입니다. 요즘 사실 제 블로그 유입을 늘리고 친구의 공부를 지원함과 동시에 향후 베스트셀러 작가 되기 등의 큰 그림을 그리며 "민사법 표준판례 해설"을 연재하고 있는데, 이를 위해 민법을 처음부터 다시 공부하면서 수험생 시절 그 찝찝한 부분들을 더듬어갔습니다. 가령 민법 제390조는 "채무자가 채무의 내용에 좇은 이행을 하지 아니한 때에는 채권자는 손해배상을 청구할 수 있다"라고 규정합니다. 여기서 "채무의 내용에 좇은 이행을 하지 아니한 때"의 의미를 대법원은 "이행불능", "이행지체" 등으로 구분하여 이해하는데, (1) 대법원이 정확히 어떤 판례를 시작으로 이와 같이 이해하는지 (2) 이행불능의 정확한 개념과 요건이 무엇인지 등을 설시한 'leading case'를 아무리 서칭해도 찾을 수 없었습니다. 이외에도 비슷한 유형의 판례 공백들이 많았는데, 하나같이 제 수험생 시절에 매우 찝찝하게 느꼈던 부분들이었습니다. 강사님들이 그냥 "그렇다"라는 식으로 넘기면서 '요건 두문자' 따서 외우게 시키는데 그 기원을 이루는 정확한 판례가 인용되어 있지도 않고, 각종 학설들만 난무하는, 그런데 이상하게 모든 관련 판례는 그 '근본을 알 수 없는' 요건 등을 당연한 전제로 하여 판결하는 것 같은 부분들입니다. 이제 시간과 여유가 있으니 고민을 했습니다. 그러다가 문득 너무나 당연한 사실을 인지했습니다. 그런 leading case들이 1945년 8월 15일 이전 일본 최고법원 판례로 있을 것이라는 점입니다. 이는 너무나 당연합니다. 이유는 해방 이전에 일본 사법시험을 합격하고 법관으로 일하던 조선인들이 해방 이후 거의 그대로 대한민국 법원의 법관으로 이어졌고, 해방 이후 우리 민법은 사실상 해방 이전 일본 민법의 번역본이었는데, 그런 법관들이 같은 민법 텍스트를 기반으로 판결하면서 뜬금없이 "자~이제 해방도 되었으니 기존에 정립돼 있던 기본 개념들을 새 대한민국 법원에서 몰아서 판결하여 법적 안정성을 제고합시다!"라고 하지 않았을 것이기 때문입니다. 아마 기존에 하던 방식대로 그대로 판결했겠죠. 즉, 1945년 8월 15일 이전의 일본 최고법원 판례는 '우리나라' 판례라는 것입니다. 그렇다면 로스쿨에서도 이러한 일본 최고법원 판례들을 leading case로 가장 먼저 공부해야하는 점은 너무나 당연한데, 우리는 이를 배우지 않습니다. 그리고 우리나라 법원 판결이 판결문에 이를 직접 인용하지도 않습니다. 다만 '암묵적으로 전제'되어 있을 뿐입니다. 마치 단체로 기억상실증에 걸린 것처럼요. 이러니 민법이 어려울 수밖에 없었다는 생각이 듭니다. 법리의 전개는, (1) 법률에 "~"라는 말이 있는데 (2) 그 말의 의미에 관하여 법원은 "~"라고 해석했고 (3) 그 법원의 해석례를 그대로 적용하면 "~"하는 등의 문제가 있었으므로 "~"인 사안 등의 경우에는 "~"라는 등의 의미로 축소 내지 확대 해석한다는 등으로 점차 정교하게 발전, 분화해나가는 모습을 보입니다. 그렇다면 그 중 위 "(2) 법원의 일차적인 해석" 부분이 거진 해방 이전 일본 최고법원 판례로 있을 것인데 이 부분을 건너뛰고 그 다음 논의들을 보면 맥락이 이해가 되지 않고 무언가 자연스럽게 느껴지지 않는 것이 당연했던 것입니다. 흔히 법공부를 하다가 "주화입마에 빠진다"는 표현을 하는데, 민법과 형법 총론을 공부하는 경우 유독 심합니다. 이제 그 이유도 이해하게 되었습니다. 민법과 형법 같은 기본법은 식민지 시절부터 내려온 것이고 따라서 위의 missing link가 다른 법보다 많기 때문인 것입니다. 이렇게 missing link가 많으면 맥락이 이해가 안 되고, 맥락이 이해가 안되면 무조건 암기를 하게 되고, 여기서 암기가 잘 되는 사람은 고통스럽게 공부하면서 넘어가지만 암기를 정말 못하는 사람들은 찝찝하게 느끼는 위의 missing link 부분을 자기만의 학설로 메꾸려는 시도를 하게 됩니다. 그러다가 별별 신기한 논리를 동원하게 되고 마침내 이를 '체계론적 해석' 또는 '자신만의 체계'라고 생각하며 뿌듯해하는 경지에 이르게 됩니다. 즉 '주화입마'에 빠지는 것입니다. 사실 저도 로스쿨 재학 시절 2학년 1학기부터 3학년 1학기까지 1년간 주화입마에 심하게 빠져서 성적이 그야말로 수직 낙하했던 적이 있습니다. 이 사실을 인지하고 나니, 어딘지 모르게 찝찝함이 느껴질 때마다 일본 최고법원 관련 판례를 찾아보거나 아니면 적어도 "아~이 부분은 내가 독자적으로 체계를 만들어서 해석할게 아니라 무언가 판례가 있는데 모종의 이유로 배우지 않는 것이겠구나"는 식으로 넘어갔으면 마음의 평안을 얻고 수험 공부에 집중할 수 있었을 것 같아 아쉽습니다.
