Ⅰ. 서론 2022. 12. 26. 윤석열 대통령은 기업의 회계정보를 금융감독원 전자공시시스템에서 확인할 수 있는 것처럼, 노동조합의 회계 공시 시스템을 구축하라는 내용의 지시를 내렸다. 이는 작년 하반기부터 정부가 노동조합의 회계 불투명성을 문제 삼고 있는 것과 맥락을 같이 한다. 한편 21대 국회에서는 여당을 중심으로 정부가 정책방향을 공표하기 이전부터 노동조합의 회계감사를 강화하는 내용의 법안이 발의되어 왔다. 이들 법안은 주로 회계감사원을 외부인으로 구성할 것을 강제하거나, 대기업·공공기관의 노동조합이 매년 결산 결과를 공개하도록 의무화하는 등의 내용을 담고 있다. 그러나 이러한 내용들은 2021. 2. 26. 국회가 비준·동의한 「ILO협약 제87호」(결사의 자유 및 단결권 보호에 관한 협약)에 배치된다는 비판이 제기된다. 위 협약 제3조 1.에서는 노동자단체(노동조합)이 완전히 자유롭게 대표자를 선출하고 관리 및 활동을 조직할 권리를 가진다고 명시하고 있으며, 동조 2.에서는 “공공기간은 이 권리를 제한하거나 이 권리의 합법적인 행사를 방해하는 어떠한 간섭도 삼간다”고 정하고 있다. Ⅱ. 노동조합 회계 정보 관련 법률규정 1. 개요 노동조합법은 노동조합이 정해진 서류를 비치하고(제14조), 자체적인 회계감사를 실시하며(제25조), 조합원이 요구하는 경우 그 결과를 열람하도록 하는 한편(제26조), 행정관청이 자료 제출을 요구하는 경우 이에 응해야 한다고 정하고 있다(제27조). 2. 관련 법률의 내용 및 연혁 노동조합 및 노동관계조정법 노동조합 및 노동관계조정법(이하 "노동조합법"이라 한다) 제25조와 제26조는 노동조합 내에 회계감사원을 두어 반기에 1회 이상 회계감사를 실시하도록 하며, 회계연도마다 그 결산결과 및 운영상황을 공표하고 조합원의 열람요청에 응하도록 규정하고 있다. 이는 민법 제66조 및 제67조에서 법인에 감사를 두어 재산상황을 감사할 수 있도록 정한 것과 마찬가지로, 조직의 회계투명성을 확보하기 위한 수단 중 하나로 해석할 수 있다. 노동조합법 제25조 및 제26조는 1953. 3. 8. 노동조합법 제정 당시부터 큰 변화 없이 내용이 유지되고 있다. 한편 노동조합법 제14조 제1항 제5호는 노동조합이 조합설립일로부터 30일 이내에 ‘재정에 관한 장부와 서류’를 작성하여 사무소에 비치하여야 하고, 작성된 서류는 3년간 보존하도록 정하고 있다(동조 제2항). 이와 같은 규정 역시 노동조합 제정 시부터 구체적인 표현에 다소 차이가 있을 뿐, 본질적인 내용에서는 별다른 변화 없이 그대로 유지되고 있다. 또한 노동조합은 노동조합법 제27조에 의해 행정관청이 요구하는 경우, 결산 결과와 운영상황을 보고해야 하는 자료제출 의무를 부담한다. 관련하여 노동조합법 시행령 제12조는 행정관청이 결산결과 또는 운영상황의 보고를 받고자 한다면, 10일 이전에 그 사유 등을 기재한 서면으로 노동조합에 요구해야 한다는 절차적 제한을 명시하고 있다. 제30조는 "행정관청이 필요하다고 인정한 때에는 노동조합의 경리상황 기타 관계서류를 제출하게 하여 조사할 수 있다"고 하여 행정관청에 이른바 '업무조사권'을 부여하고 있었다. 그러나 이러한 규정에 관하여 1994. 6월 ILO 결사의 자유 위원회는 노동조합의 자율적 운영을 침해할 수 있다는 비판과 함께 노동조합법 제30조 개정을 요청하였다. 이에 1997. 3. 13. 노동조합법 제정 당시 종전의 업무조사권을 자료 제출 요구권 수준으로 축소하여 현행 규정에 이르게 되었다. 3. 노동조합법 제26조 및 제27조 상의 ‘결산결과와 운영상황’의 범위 노동조합법 제26조 및 제27조는 조합원이 열람을 요구하거나, 행정관청이 자료제출을 요구할 수 있는 범위로서 ‘결산결과와 운영상황’이라는 개념을 제시하고 있다. 그런데 이러한 자료가 무엇인지 정확히 한정되어 있지 않기 때문에, 조합원의 열람권과 행정관청의 보고요구권의 범위 역시 모호해지는 문제가 발생한다. 노동조합법 제정·개정 시 제출된 발의안 또는 국회회의록 등의 문서에서 이러한 규정의 입법취지가 드러난 바 없고, 이에 관한 고용노동부 유권해석이나 법원 판결례도 제시되지 않았다. 한편 노동조합법 제14조 제1항 제5호에서는 ‘재정에 관한 장부와 서류’를 노동조합의 주된 사무소에 비치해야 한다는 의무를 부과하고 있는데, 이 개념이 노동조합법 제26조 및 제27조에서 명시한 ‘결산결과와 운영상황’과 동일한 것인지도 명확하지 않다. 나아가 노동조합법 제26조 및 제27조가 비록 같은 문구를 사용하고는 있으나, 양 조항에서 명시하는 대상이 동일하다고 볼 수 있는지에 관해서도 이견이 발생할 수 있다. 다만 조합원의 열람권 및 등사청구권에 관하여 판단한 대법원의 판결례가 간접적인 해석에 도움이 될 수 있을 것이다. 법원은 노동조합의 조합원이 노동조합법 제25조에 근거하여 회계관련 서류의 열람 및 등사를 요구한 사례에서 ▲ 조합원들이 납부한 조합비에 주로 의존하는 노동조합의 운영형태를 고려하였을 때 조합비의 운영내역을 조합원에게 공개하라는 조합민주주의의 원칙에 부합한다는 점 등을 들어 조합원의 열람권을 인정한 반면, ▲ 노동조합법에서 조합원에게 재정 관련 서류를 외부에 반출할 권리까지 보장하지 않았고 비조합원에게까지 장부와 서류가 유출될 위험이 있다는 점 등을 들어 등사청구권은 인정되지 않는다고 판단하였다. 이와 같은 판결은 이후 대법원에서 상고 기각되어 확정되었다. 즉, 한국 법원은 열람권을 인정하여 노동조합의 민주적이고 투명한 운영을 재고할 수 있는 반면, 노동조합 재정에 관한 서류가 외부로 반출되어 제3자에게 유출될 경우에는 노동조합의 자주적 운영이나 전체 이익이 저해될 우려가 있다고 판단한 것으로 보인다. 즉, 노동조합법 제27조에 의하여 보고요구권을 부여받은 행정관청 역시 조합원 아닌 자로서 위 판결례에서 명시한 ‘제3자’로 볼 수 있는 바, “노동조합의 재정에 관한 장부와 서류가 외부로 반출될 경우, 조합원이 아닌 자에게 노동조합의 재정에 관한 장부와 서류가 유출될 우려가 있고, 그에 따라 노동조합의 자주적인 운영이나 전체이익이 저해될 우려가 있다”는 판례 법리를 차용하여, 행정관청의 자료제출 요구 또한 노동조합의 자주적 운영에 영향을 미치지 않는 수준에서 제한된다고 해석할 수 있다. 4. 노동조합법 제27조의 해석 앞서 언급한 것처럼 노동조합법 제27조는 행정관청이 요구하는 경우 노동조합이 결산 결과를 보고해야 한다는 내용을 담고 있다. 그러나 현행 규정 역시 행정관청이 자료 제출을 요구할 수 있는 범위를 객관적 기준에 따라 제한하는 내용을 전혀 두고 있지 않아, 행정관청이 노동조합 운영에 과도하게 개입할 가능성이 발생한다는 비판이 있다. 이 경우 노동조합 재정 운영의 민주적 통제를 위한다는 입법취지가 오히려 퇴색되는 결과를 발생시키게 된다. 그러나 헌법재판소는 노동조합법 제27조 및 이에 대한 처벌규정인 제96조 제1항 제2호에 대해 제기된 위헌소원에 관하여, “노동조합의 재정 집행과 운영에 있어서의 적법성, 민주성 등을 확보하기 위해서는 조합자치 또는 규약자치에만 의존할 수는 없고 행정관청의 감독이 보충적으로 요구되는바, 이 사건 법률조항은 노동조합의 재정 집행과 운영의 적법성, 투명성, 공정성, 민주성 등을 보장하기 위한 것으로서 정당한 입법목적을 달성하기 위한 적절한 수단이다.”라고 판단하여 노동조합에 대한 단결권 침해가 발생하지 않았다고 보았다. 위헌소원 당시 청구인 노동조합은 노동조합 및 제27조 및 제96조 제1항 제2호를 함께 문제 삼았으나, 이 결정례에서 헌법재판소는 노동조합법 제27조는 과태료 부과조항인 제96조 제1항 제2호의 구성요건에 지나지 않는다고 하여, 제27조에 관해서는 구체적인 판단을 하지 않았다. Ⅲ. ILO 협약 제87호의 해석 및 해외사례 1. 개요 노동조합법 제27조에 근거한 정부여당의 노동조합 회계자료 제출 요구 및 국회에 제출된 노동조합법 개정안들은 지난 2021. 2. 26. 국회 비준·동의하여 2022. 4. 20. 부로 효력이 발생한 ILO 협약 제87호에 위배된다는 지적을 받아왔다. 헌법 제60조에 의하여 “국회는 상호원조 또는 안전보장에 관한 조약, 중요한 국제조직에 관한 조약, 우호통상항해조약, 주권의 제약에 관한 조약, 강화조약, 국가나 국민에게 중대한 재정적 부담을 지우는 조약 또는 입법사항에 관한 조약의 체결ㆍ비준에 대한 동의권”을 가지며, 국회에서 비준·동의한 국제법규는 헌법 제6조에 의하여 국내법과 같은 효력을 가진다. 또한 비엔나협약 제27조는 조약과 국내법이 충돌하였을 때, 국내법을 조약 불이행의 정당화를 위해 활용할 수 없다고 정하고 있다. 관련하여 대법원은 “국제법을 우리나라 국내법의 일부로 수용한다는 의사를 명백히 표명하고 있으므로 우리 국민에 대하여 국내 법률인 민법과 국제법(조약)인 협약은 동등한 효력을 가지면서 함께 적용되는 것이다. 다만 국내법과 국제법이 서로 충돌하는 경우에는 신법우선의 원칙 또는 특별법 우선의 원칙에 따라 그 우열 여부를 가려내야 할 것인데 협약이 민법보다 신법임은 역수상 분명할 뿐만 아니라 협약은 그 규율 대상을 국제항공운송 및 그 관련자에 한정하고 있어 민법에 대한 관계에 있어서 특별법이 되므로 민법에 우선하여 적용된다”고 판시하여, 특별법 우선의 원칙 및 신법우선의 원칙이 적용된다는 기준을 제시하였다. 2. ILO 협약 제87호 제3조는 노동조합을 비롯한 노동자·사용자단체가 ① 자율적으로 내부규정을 정하는 등 자유롭게 사업을 수립할 권리와 함께, ② 정부를 비롯한 공공기관이 이러한 권리를 제한하거나 방해·간섭할 수 없다는 점을 명시하고 있다. 구체적인 결정례에서 확인해 보건대, ▲ 노동조합은 정당한 노동조합 활동을 위해 자금을 자신들이 원하는대로 관리하고 사용할 수 있는 권한이 있으므로 이를 제한하는 규정을 둘 수는 없고(§683), ▲ 노동조합이 매년 정부당국에 재무제표 및 기타 보조자료를 제출하라는 규정 자체는 노동조합의 자율성을 침해하는 것으로 판단하지 않으나(§710), ▲ 이러한 제출요구는 노동조합의 행정에 대한 공공기관이 노동조합 운영에 간섭하여 노동조합의 권리행사를 제한하는 위험을 수반할 수 있으므로 감독업무를 수행하는 공무원은 행정당국으로부터 독립성을 갖추고 사법당국의 통제를 받을 필요가 있다(§710)는 것이 ILO 결사의 자유 위원회의 입장으로 해석된다. 3. 해외사례 (1) 미국 미국은 ILO 협약 제87호 미비준 국가로서, 비준국가와 비교하였을 때 해당 협약의 효력이 직접적으로 발생한다고 보기 어렵다. 다만 ILO는 협약 제87호를 비롯한 8개 핵심협약은 비준하지 않은 회원국에게도 이를 존중하고 실현시키기 위한 의무를 부담한다고 정하고 있어, 미국이 ILO 협약 제87호 준수 의무를 전혀 부담하지 않는다고 볼 수는 없다. 미국은 노사 보고 및 공개절차법(Labor-Management Reporting and Disclosure Procedure Act, Landrum-Griffin 법) 제201조 이하에서 노동조합의 행정관청에 대한 보고의무를 정하고 있다. 이 법률은 노동조합에 일반적 회계감사를 수행해야 하는 의무를 부여하고, 연차회계보고서를 노동부장관에게 제출해야 하는 의무를 부과하고 있다. 이 보고서에는 노동조합의 자산, 부채, 수령금 및 그 출처, 조합 임원 및 노동조합이 고용한 자에게 지급된 금액에 관한 사항 등이 명시되어야 한다.(29 U.S.C. 431 제201조(a), (b)) 이러한 보고서와 문서의 내용에 관하여 조합원의 열람권이 보장될 뿐만 아니라(○ 29 U.S.C. 431 제201조(c)), 노동부장관에게 제출된 보고서와 문서를 누구라도 열람하거나 등사할 수 있다는 내용까지 포함되어 있다(29 U.S.C. 435 제205조). (2) 영국 영국은 본래 전통적인 노사자치주의에 입각하여 노동조합이 재산을 신탁하여 수탁자의 책임으로 관리하고, 수익자는 조합원이 아닌 노동조합으로 제한되어 조합원이 직접적으로 노동조합 재산 감시에 참여하기 어려운 구조를 가지고 있었다. 그러나 1980년대를 전후하여 노동조합이 전국적인 불법파업을 감행하는 등 문제가 발생하자, 국가가 개입하여 노동조합 내부의 민주주의 원칙을 보장한다는 명목 하에 적극적인 정보접근과 회계관련 조사가 가능하도록 변경되었다. 노동조합의 재정 관련 정보를 제출하고 설명해야 하는 의무, 조합원의 정보접근권, 회계감사 등에 관한 사항은 「노동조합 및 노동관계(통합)법」(Trade Union and Labour Relations (Consolidation) Act 1992 : TULRCA 1992)에 주로 명시되어 있다. (3) 프랑스 프랑스에는 노동조합 재정 또는 회계에 관한 노동관계법령상의 규정이 따로 마련되어 있지 않고, 노동조합이 스스로 민주적 운용에 관한 규율을 자체적으로 마련하여 이행하고 있다. 성문화된 법률은 없으나 관례화된 노동조합의 규약과 시스템을 통해 상당히 엄격한 관리가 이루어지고 있다. 예컨대 재정국장이 집행한 지출내역은 모두 사무국장의 동의를 얻어 집행부의 규율을 따라야 하며, 회계자료는 노동조합 본부의 안전한 곳에 보관되어야 한다. 또한 재정국장은 노동조합의 지도기관에 의무적으로 매달 정기 재정보고를 해야 할 의무를 부담하고, 조합 총회에서도 보고가 이루어진다. 나아가 노동조합의 감사위원회는 회계관리수칙에 대한 충분한 지식을 가진 후보자를 우선적으로 선발하여 구성하게 된다. 다만 행정관청에 대한 보고의무를 부담하지는 않는다. (4) 독일 독일 역시 프랑스와 마찬가지로 노동관계법령에서 재정 및 회계 등에 관한 규정을 따로 두고 있지 않고, 노동조합별 규약을 통해 자율적으로 관련 사항을 정하고 있다. 예컨대 독일 서비스산업노동조합(Vereinte Dienstleistungsgewerkschaft, Ver.di)은 회계감사위원회, 감독 및 고충처리위원회를 통해 조직의 재정 및 회계를 감독하고, 작성된 보고서를 이사회와 총회에 제출하고 있다. 또한 중앙본부의 회계감사결과는 노동조합평의회에 제출하고, 예산집행 감사를 1년에 2회 시행한다. (5) 일본 일본은 주로 기업단위로 노동조합이 운영되고 있어 개별 노동조합의 규모가 크지 않고, 규약 등 내부규정에서도 민주적 운영에 관한 규율이 간략하게 명시된 경우가 많다. 일본은 「노동조합법」(労働組合法) 제5조 제2항에서 회계감사에 관한 규정을 두고 있으며, 모든 재원 및 용도, 현재의 경리상황 등을 나타내는 회계보고를 매년 1회 이상 조합원에게 공표할 의무를 노동조합에 부담하게 한다. 이때 회계보고는 총회 결의 등을 통해 선출된 직업적 자격이 인정되는 회계감사인(공인회계사, 감사법인, 신탁회사 등)이 확인한 증명서를 첨부해야 한다. 4. 소결 미국과 영국은 법령을 통해 노동조합 재무 및 회계상황에 관한 적극적인 보고 의무를 부과하고 있는데, 그러한 보고의 상대방에는 조합원 뿐만 아니라 행정관청 역시 포함된다. 또한 이를 위반한 경우에는 형사처벌될 가능성 또한 법령에 명시하여 강제성을 부여하였다. ILO는 행정관청이 노동조합에 정기적인 보고의무를 부과하는 것 자체는 가능하다고 하면서도, 정부가 노동조합 운영에 개입·간섭할 가능성이 있는 경우에는 의무부여에 관한 규정이 노동조합의 자율적 운영을 방해하여, 결과적으로 ILO 협약 제87호 제3조 위반에 해당할 수 있다는 의견을 피력한 바 있다. 이러한 해석에 비추어 본다면 미국과 영국이 택하고 있는 강력한 보고의무 부과 방침은 ILO 협약 제87호 제3조에 위배될 위험성을 내포한 것으로 판단된다. 다만 영국은 노동조합 명부를 관리하는 ‘인증관’에게 회계 및 재무상황을 보고하도록 정하고 있는데, 인증관이 독립성을 갖추고 사법당국의 통제를 받는다면 ILO 결사의 자유 위원회가 우려한 자율성 침해 우려를 상당 부분 불식시킬 수 있을 것으로 보인다. 독일과 프랑스는 별도의 법률 규제 없이 노동조합의 자체적 규율로서 재무 및 회계관련 사항이 내부관리되고 있고, 행정관청에 대한 보고의무나 이에 부수하는 형사처벌 가능성도 전혀 없다. Ⅳ. 정부의 회계자료 요구 및 입법안의 평가 1. 정부의 회계자료 요구 건 관련 평가 고용노동부는 조합원수 1천명 이상의 단위노동조합 및 연합단체 총 334개(민간 253개, 공무원·교원노동조합 81개)를 대상으로 2022. 12. 29. ~ 2023. 1. 31. 간 자율점검기간을 운영하였고, 2023. 2. 1.에는 노동조합법 제27조를 근거로 자율점검결과서와 증빙자료(표지 1쪽, 내지 1쪽)을 2023. 2. 15. 24시까지 관할 행정관청에 제출할 것을 요구했다. 해산신고된 노동조합을 제외하고 327곳의 대상 노동조합 중 36.7%(120개)는 정부 요구에 따라 자료를 제출하였으나, 대다수 노동조합(63.3%, 207개)은 자료제출에 불응하였다. 이 중 자율점검결과서, 표지, 내지를 전부 제출하지 않은 노동조합은 16.5%(54개)이며, 내지를 제출하지 않은 노동조합이 46.8%(153개)이다. 조직형태별로는 기업별 노동조합(46.2%), 초기업 노동조합(30.4%), 연합단체(20.3%) 순으로 자료제출비율이 조사되었다. 또한 소속 연합단체별로는 한국노총이 38.7%, 민주노총24.6%, 이외의 기타 연합단체 및 미가맹 노동조합이 41.6%로 조사되었다. 이후 고용노동부는 실제로 자료제출 요구를 거부한 52개 노동조합을 시작으로 과태료를 부과하기 시작했고, 양대 노총을 중심으로 고용노동부장관을 형법 제123조에 따른 직권남용권리행사방해죄로 고발하는 한편 과태료 부과처분에 대한 행정쟁송을 개시하였다. 고용노동부는 ILO 협약 제87호 및 결사의 자유 위원회 결정례의 해석상, 특별한 사유가 없는 이상에는 노동조합의 회계·재무 관련 자료에 대한 제출을 요구하기 어렵다는 점을 인지한 것으로 보인다. 이는 고용노동부가 대상 노동조합에게 회계·재무자료의 전부가 아닌 표지와 내지 각 1장만을 제출하도록 요구한 데에서 드러난다. 그러나 생각건대 ▲ 현행 노동조합법 제27조는 노동조합이 제출해야 하는 자료의 범위를 명확히 정하고 있지 않아 권리침해의 가능성이 높은 점, ▲ 영국 및 미국의 사례와는 달리 금번 고용노동부의 자료제출 요구는 연례보고서를 제출하도록 하는 등 사전에 예측 가능한 방식이라고 보기 어려운 점, ▲ 각 대상 노동조합 내에서 ILO 결사의 자유 위원회가 예외적으로 자료 제출을 요구할 수 있다고 인정한 ‘중대한 상황’이 발생했다고 볼 수 없는 점, ▲ 노동조합이 운영하는 전체 조합비 대비 정부지원금의 비중은 극히 미미한 점, ▲ 이러한 자료제출 요구가 노동조합의 자율적이고 민주주의적 운영에 어떠한 편익을 가져다 주는지 불명확한 점 등을 고려했을 때, 고용노동부의 자료제출 요구는 ILO 기본협약 제87호 및 비엔나협약 제27조를 위반한 것으로 평가하는 것이 타당할 것이다. 2. 관련 입법안 평가 21대 국회에서 노동조합법 제26조 및 제27조에 관하여 발의된 법안은 총 7건으로 확인된다. 이 중 이수진 의원 대표발의안을 제외한 6건의 발의안은 여당 소속 국회의원에 의하여 발의되었으며, 다소 내용상의 차이는 있으나 대체로 노동조합 회계감사원의 자격요건 및 절차적 요건을 정하거나, 특정한 기준을 충족하는 노동조합이 매년 행정관청 또는 외부에 회계·재무현황을 공개하도록 하는 내용을 담고 있다. 이는 영국의 입법안을 일부 차용한 것으로 이해된다. 그러나 이러한 법률안들은 관련 자료를 제출받는 행정관청 소속 공무원의 지위에 관해서는 따로 명시한 바 없다. 이는 ILO 결사의 자유 위원회가 노동조합 내부운영에 관한 자료를 제출받더라도, 행정당국에서 독립적이며 사법당국의 감독을 받는 공무원을 그 주체로 삼아야 한다고 권고한 것에 부합하지 않는다. 한편 이수진 의원 대표발의안은 제26조에 따라 조합원이 열람을 요구할 수 있는 노동조합 내부자료의 범위를 한정하는 한편, 행정관청의 자료제출 요청권을 명시한 제27조는 삭제하는 내용을 담고 있다. 이는 앞서 살펴보았던 프랑스·독일 모델에 따라 노동조합의 자율적인 내부운영을 활성화하기 위한 조치로 해석된다. 이 경우 ILO 협약 제87호 및 결사의 자유 위원회 결정례에 위배될 위험성은 매우 적을 것으로 보인다. Ⅴ. 결론 ILO 협약 제87호 제3조가 행정관청의 노동조합 운영 개입을 최소화해야 한다고 간명하게 명시한 것에 비하여, ILO 결사의 자유 위원회 결정례는 정부의 개입 가능성에 관하여 다소 모호한 입장을 견지하고 있다. 이는 각 국가의 노동환경과 노사관계, 노동조합의 발전도상이 전부 상이한 점을 고려하여, 개별적인 사정을 최대한 존중하고자 하는 노력에서 비롯한 표현으로 해석된다. 또한 국제법 영역에서 널리 활용되는 완곡적인 수사의 일환이라고 볼 수도 있을 것이다. 그러나 노사관계에 관한 ILO 협약들이 일관되게 정부의 노동조합 운영 개입을 최소화할 것을 요구하고 있고, 간섭 가능성을 확대하는 조치를 매우 경계하고 있는 것은 분명해 보인다. 이러한 상황에서 한국이 사실상 사문화되어 있던 노동조합법 제27조를 불러세워, 정부가 노동조합 운영에 개입하고 노동조합 활동을 위축시키며 여론전의 무기로 활용하고자 하는 작금의 상황은 매우 우려스럽다. 국제적 기준에 부합하는 노동관계법령의 구성을 위해서는 노동조합법 제27조를 삭제하거나, 행정관청이 자료제출을 요구할 수 있는 범위를 엄격히 제한하여 노동조합의 자율적 운영에 관한 부적절한 개입을 사전에 방지하는 조치가 필요할 것이다. ────────────────────────────────── 이번 학기의 기말 레포트로 제출한 글입니다. 어디 투고하기에는 퀄리티가 허접하고, 걍 버리긴 아까워서 올려봅니다. 편집이 귀찮아서 출처 각주는 그냥 싹 날렸습니다.
