 https://www.nytimes.com/2021/09/10/us/politics/texas-abortion-law-facts.html 이번 달에 텍사스의 새로운 낙태금지법이 시행되었어요. 심장박동법이라고도 불리는 이 법안은 정말 정신나간 내용들이 담겨있는데, 심장박동이 들리는 시기인 6주부터 낙태는 원천금지되며, 강간이나 근친상간으로 인한 임신 등에도 예외없음. 그리고 가장 정신나간 부분은 저 칼럼에서도 설명하는 자경주의 정신이에요. 이 법은 형사처벌조항이 없어요. 그러니까 국가가 법을 집행하는 게 아니에요. 대신 모든 텍사스 시민들에게 불법낙태와 이를 원조하는 행위에 대해 소를 제기할 수 있는, Standing을 줍니다. 텍사스의 모든 시민이 텍사스 모든 여성과 태아의 신체의 당사자가 될 수 있음. 홀리몰리. 거기에 소를 성공적으로 진행한 사람에게는 포상금이 1만달러가 넘음. 진짜 내용이 너무 황당해서 더블체크했어요. 그리고 이 법으로 한 소송에 대해서는 피고 승소시 원고에게 피고의 법률비용을 부담하게 할 수 있는 텍사스 법원의 재량권도 무력화. 이제부터 서로 죽여라 정신이 소름이 끼침. 대부분의 낙태를 금지하고 낙태시술자에게 10년형까지 내리는 법을 입안했던 앨러바마는 실제 시행도 전에 바로 지방법원에서 효력정지당했어요. 대놓고 로 대 웨이드에 반하니까요. 물론 앨러바마의 의회의 목적 중 하나는 해당 법에 대한 위헌심판으로 로 대 웨이드 판례를 뒤집는 데 있었기 때문에 완전히 실패는 아니지만요. 앨러배마가 정면돌파를 시도했다면 텍사스는 우회로를 공략했어요. 로 대 웨이드는 국가와 개인 사이의 문제에 대해 판결내린거니까 이걸 민사문제로 만들면 어떨까? 당연히 법전문가들로부터 엄청난 비판이 있어요. 비단 낙태의 문제가 아니더라도, 전혀 상관없는 제 3자(third party)에게 당사자의 자격(standing)을 주고 민사소송을 제기할 수 있게 해준다는 게 쉽게 받아들일 수 있는 개념이 아니잖아요? 당사자의 극단적 확장이 민법원칙을 파괴하리라고 많은 이들이 우려해요. 그러나 이 법의 입안자 중 하나인 John Seago는 텍사스와 연방법체계에는 관련 전례가 있다며 반박했어요. 예를 들어 'Texas False Claims Act '같은 경우 일반 시민이 공공의료시스템인 메디케이드의 서비스를 대상자가 아님에도 부당하게 누렸다면, 제3자가 공익신고의 일환으로 소를 제기할 수 있도록 해놨거든요. 또 연방의 예로는 환경단체가 환경을 오염시킨 기업에게 민사소송을 낼 수 있게 허락한 법 등이 있어요. 연방의 경우에는 법해석이 갈 수록 엄격해져서, 법원은 환경단체에게 그 환경오염으로 직접적으로 피해입은 사람을 단체에 한 명 이상 포함시킬 것을 요구하긴 했지만요. 거기에 이 법의 적용대상은 엄청나게 광범위해요. 산모는 해당되지 않지만, 낙태시술사는 물론 낙태를 할 것을 알고도 이에 대해 도움을 제공한 사람이 모두 소송대상이 될 수 있음. 대표적으로 나오는 예시가 낙태시술소까지 운전해준 부모님도 소송당사자라는 거죠. 이건 끔찍한 상상같은 게 아니라 법 입안자가 직접 인정한 내용. 법이 시행되자마자 바로 시민단체들은 연방대법원에 긴급구제신청을 넣어 법의 효력을 정지시키려 했으나, 연방대법원은 5-4로 받아주지 않았어요. 긴급구제신청에 반대한 5명의 판사 중 3명은 트럼프가 임명한 고서치,캐버너휴,코니 배럿 Warning: Use of undefined constant no - assumed 'no' (this will throw an Error in a future version of PHP) in /home/redtea/html/a_skin/bbsd/view.php on line 133 Warning: Use of undefined constant no - assumed 'no' (this will throw an Error in a future version of PHP) in /home/redtea/html/a_skin/bbsd/view.php on line 146 Warning: Use of undefined constant vote - assumed 'vote' (this will throw an Error in a future version of PHP) in /home/redtea/html/a_skin/bbsd/view.php on line 161 10 이 게시판에 등록된 코리몬테아스님의 최근 게시물
