5월은 종합소득세의 달입니다. 대부분의 개인사업자들이 씁쓸하게 지난 1년 동안의 영업 성적표와 세금 고지서를 받아들게 되는 달이지요. 올해도 신고는 5월 말까지 받되, 납부는 3개월 미루어 주어 8월 31일까지 납부하면 된다고 합니다. 단 부동산 임대사업자, 유흥사업자 등은 제외라고 합니다. 그렇지만 이건 사실 개인사업자 분들에게 해당되는 말은 아닙니다. [종합]소득세입니다. 지난 1년에 소득이 있었다면 모든 국민에게 5월 말까지 소득세 신고를 해야 할 의무가 부여되는 것이고, 사업자 등록을 하지 않았고 다른 누군가와 종속적인 고용관계를 맺거나 하여 근로소득, 연금소득, 혹은 연말정산되는 사업소득만으로 소득이 구성되신 분들이 아니라면 원칙적으로 모든 국내 거주자가 5월 말까지 종합소득세 신고를 할 의무를 가집니다. 이 중에 고의든 아니든 빼먹기 쉬운 것이 있는데, 개인간에 사적으로 지급되는 금원으로 대표되는 [기타소득]입니다. 개인에게 귀속되지만 [이자소득],[배당소득],[사업소득],[근로소득],[연금소득].[퇴직소득],[양도소득] 중 어떤 것으로도 분류할 수 없는 원천의 소득에 맨 마지막으로 적용되는 소득의 분류이며 이는 [소득 있는 곳에 세금 있다. 반드시]라는 조세정의를 구현하기 위한 까닭입니다. 어느 정도냐면 뇌물도 원칙적으로기타소득으로 분류되어 세금이 추징됩니다. (현 소득세법 21조 1) 홍남기 부총리의 경우 2020년 시행된 임대차 3법에 의해 본인 소유의 주택 임차인이 계약갱신청구권을 행사하여 일국의 경제 부총리이면서도 당장 거주할 주택을 구하지 못해 거리에 나 앉을 위기에 처하신 적이 있는데, 다행히 해당 임차인이 소정의 퇴거 위로금을 지급받고 뜻을 거두어 주셨다 하고, 홍남기 부총리께서는 위기를 면하셨습니다. 신규 입법에 따른 사상 유래가 없는 일이었기에 대체 부총리는 얼마의 퇴거 위로금을 지급한 것인가 모두들 궁금해 하게 되었습니다. 지금은 부총리의 일이지만 세를 사는 사람 세를 놓은 사람 누구에게나 해당 될 수 있는 일이고, 부총리가 지급한 금원이 향후 일반 국민 장삼이사들의 기준이 될 수 있기에 관심이 높아 이에 대한 선례를 만드는데 초석으로 삼고자 공개를 요구하였으나 홍남기 부총리 측은 사생활에 해당한다고 하여 공개를 거부하였습니다 https://www.sedaily.com/NewsVIew/1ZA9KXB1MC. 때문에 공식적으로 홍남기 부총리가 2020년 퇴직 위로금으로 지급한 금액은 확인되진 않았으나 2천만원정도라는 제보를 근거로 쓰여진 기사들이 아직까지 남아 있기에(https://www.hankyung.com/politics/article/202011030595Y) 이 글에서는 홍남기 부총리가 해당 세입자에게 지급한 금원이 2천만원인 것으로 가정하고 하술하고자 합니다. 이 글에서저는 퇴거 위로금의 세무처리에 대하여 논하고자 하는 것이지 금액의 진위여부는 중요한 것이 아니라서요. 1. 퇴거위로금은 기타소득으로써 과세되는 것인가. 대부분의 경우 기타소득으로써 과세될 확률이 높습니다.(https://www.mk.co.kr/news/economy/view/2020/11/1172893/) 본인이 받은 퇴거위로금이 현행 세법상 비과세에 해당하는 기타소득임을 주장하려면 최소한 둘 중 하나 1. 이사비용, 중개 수수료 등에 대한 실비 변상적 성격의 금원이 대부분이며 이를 초과하지 않음 2. 받은 금원은 신체적, 정신적, 물질적 손상을 입었거나 명예의 훼손 등에 대한 위자료 성격의 금원이 대부분이며 이를 초과하지 않음 를 증명할 수 있어야 하는데 서로의 계약과 실행 내용이 어떻게 이루어진 경우에 이런 경우가 가능할 지 모르겠습니다. 2. 퇴거위로금이 기타소득으로 과세될 경우의 세무처리 홍남기 부총리가 2020년 10월 중 세입자 A씨에게 전세 퇴거위로금으로 금원 2천만원을 지급한 경우를 가정합니다. 현행 기타소득은 원천징수의무가 있는 소득이며 소득의 지급자가 원천징수의무자가 됩니다. 즉 이 건에서는 홍남기 부총리가 원천징수의무자로써 세법상 규정된 의무를 하여야 합니다. 이 건에서 홍남기 부총리는 2천만원의 금원을 지급하기로 계약을 하였더라도 2천만원의 금원을 다 세입자 A씨에게 주어버리면 안되고, 세법에서 규정된 원천징수세액을 제하고 남은 금액을 세입자 A씨에게 지급하여야 하며, 이 규정된 원천징수세액은 홍남기 부총리가 책임지고 국가에 납부하여야 합니다. 얼마의 세금을 떼고 주어야 할까요? 2020년 기타소득의 원천징수세율은 국세 20%, 지방세 2%하여 합계 22%이고, 기타세율 원천징수액은 다음과 같은 산식으로 계산됩니다. (소득금액 - 필요경비) * 세율 22% 소득금액은 확정입니다. 2천만원입니다. 필요경비란 소득을 창출하기 위해 필수적으로 지출해야 했던 금원의 성격인데, 강연, 자산의 일시적 대여, 복권당첨, 보상금 등 우발적 소득이 많은 기타소득의 경우 그러한 금원을 명확하게 구분해 내기 쉽지 않습니다. 때문에 대회 상금 및 주택입주지체상금의 경우 최소 80%를, 강의나 원고료 또는 일시적 인적용역을 제공한 경우 최소 60% 소득금액에 대한 필요경비를 인정해 주고 있고, 실제 필요한 경비가 이를 초과하였고 그를 증빙할 수 있는 경우 그 초과금액을 필요경비로 할 수 있습니다. 2020년 기타소득세율은 8.8%라고 서술하고 있는 곳이 여러군데 있는데, 이는 소득금액에 이미 필요경비 60%를 차감하여 그에 세율 22%를 곱한 계산입니다. 그렇다면 퇴거위로금의 경우 얼마의 필요경비를 인정받을 수 있을까요? 0%입니다. 주택 지체 상금처럼 법에 규정이 되어 있으면 모를까 퇴거위로금에 대한 필요경비를 규정한 법 조문은 현재 아무데도 없고, 실질적으로도 퇴거위로금을 받는데 무슨 필요경비가 발생했을 리가 만무합니다. 그러니 현재로써는 퇴거위로금에 대해서는 필요경비를 공제할 수 없다고 해석하는 게 가장 무난하다고 보입니다. 때문에 홍남기 부총리가 세입자 A씨에게 떼고 주어야 하는 금액은 440만원입니다. 세입자 A씨는 이를 제한 1560만원만을 받을 수 있습니다. 돈 문제는 이렇게 해결되었고 서류 문제는 아래와 같이 흘러갑니다. 1. (2020년 10월) 홍남기 부총리는 2천만원을 지급하기로 한 세입자 A씨에게 1560만원을 지급하고 기타소득지급명세서 2부를 작성하여 1부는 세입자 A씨에게 배부. 1부는 본인이 보관해야 합니다. 2. (2020년 11월) 홍남기 부총리는 10일까지 [원천징수이행상황명세서]를 작성하여 거주지역 세무서에 제출 및 원천징수한 국세 400만원을 거주지역 세무서에 납부. [지방세 특별징수분 신고서]를 작성제출하고 지방세 40만원을 납부해야 합니다. 3. (2021년 2월) 홍남기 부총리는 10월에 보관해 두었던 기타소득 지급명세서를 국세청에 2월 28일까지 제출할 의무가 있습니다. 4. (2021년 5월) 세입자 A씨가 일반 회사원이었다고 근로소득만으로 소득이 구성되어 있었다고 가정합시다. 이 경우 회사에서 2월 연말정산을 알아서 해주고, 5월 종합소득세 신고 같은 건 A씨가 신경 쓸 일이 아니었는데 2021년에는 A씨 거주를 관할하는 세무서가 일을 잘 하고 있다면 A씨에게 4월 말쯤 기타소득이 신고되었다며 2020년 종합소득세 신고 유형이 변경되어 A씨도 이번 5월 말에 신고된 기타소득을 합산하여 종합소득세 신고를 해야 한다는 통지가 도착합니다. 위에서 2월에 홍남기 부총리가 기타소득 지급명세서를 국세청에 제출하였기 때문입니다. A씨를 과세소득 4800만원, 과세표준 3800만원 정도의 근로소득을 지급받는 중견사원이라 생각하면 현행 누진세 구조에 따라 기타소득 2000만원 중 800만원은 15%의 한계세율을, 1200만원은 24%의 한계세율을 적용받아 408만원의 세금이 나옵니다. 돈 없는데 어디서 이런 돈을 구하죠? 아니오. 이미 작년 10월에 홍남기 부총리님이 400만원을 국세로 떼어가셨습니다. 그게 사실 지금 내야 할 돈을 미리 대신 내준 겁니다. 그래서 그만큼은 낼 필요 없고 8만원만 더 내면 되겠군요. 지방세는 8천원. A씨는 당장 자기 주머니에서 돈이 몇백만원 나가는 줄 알았는데 8만 8천원만 내면 된다니 일단 안심이긴 한데, 작년에 홍남기 부총리님이 떼간 440만원은 자기가 받지 못하는 돈이고 자기 손에는 1560만원만 남았었는데, 거기다 또 죽도록 세무서 들락 거려 신고서 작성하랴 또 8만8천원 세금을 더 내야 된다니 결국은 속이 쓰립니다. 그런데 사실 이것도 A씨에게 너무 유리하게 가정한 겁니다. 만약 A씨가 근로소득자가 아니라 사업소득자였다면 공제 항목이 훨씬 적어져 같은 소득을 올리더라도 세율이 훨씬 높을 거고. 연금이나 금융소득이 많다면 건강보험료까지 상승할 가능성이 있습니다. 솔직히 국가 의전 서열 10위 이내의 권력자를 상대로 이런 딜을 걸 강심장인 분이면 보통 분이 아닐 거 같고 소득 자체가 훨씬 높지 않을까 생각이 되네요. 여기서 주의할 점은 밑줄이 쳐진 부분은 이 거래에 있어서 소득의 지급자이자 법률에 규정된 원천징수의무자인 홍남기 부총리의 이행사항이란 것입니다. 저 부분이 이행되지 않았으면 그에 대한 법률상 제재는 모두 다 홍남기 부총리가 지게 됩니다. 예를 들어 1번을 이행하지 못하고 A씨에게 2000만원을 다 줘버렸다? 그래도 홍남기 부총리는 11월에 원천징수세액 440만원을 국세청과 관할지방청에 납부 해야 합니다. 그러고 그 다음에 A에게 부당이득반환청구 소송을 걸어 돌려 받든지 말든지 해야 합니다. 2번을 이행하지 않았다? 홍남기 부총리 이름으로 원천징수 미납부 가산세가 떨어지고 조세범 처벌범상 원천징수 불이행범이라는 이름이 붙습니다. 3번을 이행하지 않았다? 홍남기 부총리 이름으로 지급명세서 미제출 가산세가 떨어지고, 세무서는 홍남기 부총리가 기타소득지급명세서를 제출하지 않았으니 세입자 A씨에게 2천만원의 기타소득이 있다는 사실을 알 수가 없습니다. 세무서가 맡은 바 일을 잘 하고 있어도 4월에 A씨에게 통지가 가지 않을 것이며, 때문에 A씨는 아무것도 모르고 5월을 넘기게 되네요. 나중에 고칠 수는 있지만 공무원들 두번 세번 일시키는 거고 벌금도 붙겠지요. 홍남기 부총리 입장에서는 돈도 내 주머니에서 나가는데 정작 내가 지고 있는 법적인 의무까지 훨씬 많다? 세금까지 알아서 떼 가지고 신고해서 내 주어야 한다? 어쩌겠습니까 법이 이런 걸. 이건 임대차 3법 처럼 갑자기 생긴 법도 아니고 옛날부터 이랬습니다. 3. 세무처리의 어려움 대부분의 기타소득 신고는 지급받는 분들이 지급명세서 제출을 거부하는 경우가 많습니다. 물론 위에서 보았듯이 세금부담도 높습니다. 그것에 더해서 기타소득 지급 거래는 어느정도 구린 면이 있는 경우가 많아서 그렇습니다. 부총리 사례를 봅시다. 세입자 A씨는 자신이 양보하지 않으면 홍남기 부총리가 아주 우스운 꼴을 당하게 될 수 있다는 강점을 거래의 수단으로 삼아 위로의 명목으로 금원을 얻어내었습니다. 이런 건 법률상으론 아무 문제가 없을 지 몰라도 그렇게 떳떳한 거래는 아니지요. 그런데 소득 지급명세서를 제출한다는 것은 세무당국에 이러한 이유로 이러한 거래가 있었다는 사실을 외부로, 그것도 공기관 정부에 대놓고 알리는 꼴이 됩니다. 떨떠름한 수익을 올린 입장에서 떨떠름한 일일 수 밖에 없습니다. 때문에 세금을 얼마나 내게 되는가는 부차적인 일이고, 그냥 이건 우리 둘만 아는 일로 놔뒀으면 좋겠다, 라는게 이런 거래가 있었던 분들이 통상 취하는 입장이지요. 돈을 주는 입장에서도 더 다투기 싫을 뿐만 아니라 본인이 까먹지 않고 이행해야 되는 부분도 많고, 그렇게 이행한다고 해서 딱히 이득이 되는 것도 아닙니다. 누가 나를 표적조사하지 않는 이상 따로 공무원이 나를 조사해 이런 일이 있었다는 걸 밝혀낼 확률 또한 거의 없습니다. 그래서 소득 지급자와 소득 수급자의 이해 관계가 맞아 떨어져 그냥 우리 둘만 아는 일로 하자. 라는 합의가 이루어지는 경우가 많습니다. 다른 게 아니라 바로 이런 경우가 탈세입니다. 물론 홍남기 부총리님의 경우에 행정관료의 수장으로써 법률상 검토와 이행해야 할 사항들이 빈틈없이 처리가 되어 있을 것이라고 믿습니다. 그렇지만 저희와 같은 장삼이사는 다른게 아니라 진짜 [몰라서] 해야 할 신고나 납부를 빼먹거나 할 수가 있습니다. 애초에 본인 소득세 문제는 회사 연말정산 때 인사과에 연말정산 서류 제출하는 걸로 끝냈던 회사원 같은 사람이 퇴거위로금을 지급하거나 받으면서 이건 기타소득이라 원천징수를 해야 하고 나중에 5월에 따로 종합소득세 신고 의무가 있다 이런 사실은 알려주는 사람이 없으면 나이를 얼마나 먹었든, 사회경험이 얼마나 쌓였든 영역이 다르면 아예 모를 수가 있어요. 하지만 외부에서는 이를 구분할 방법이 없고, 따라서 고의로 거래 사실을 숨긴 경우에 준하는 세법상 제제와 처벌을 받게 됩니다. 때문에 5~10년 내로 정부 요직을 노리시는 홍차넷 분들은 청문회 열릴 때 이런 걸로 탈세 혐의를 쓰지 않도록 각별히 주의를 부탁드리며 다른 이의 퇴거를 굳이 위무해야 하는 일이 최대한 발생하지 않기를 기원하겠습니다.
